HomeMy Public PortalAbout13-8702 Amend Resolution 11-8250 Regarding Approval of all Litigation Matters Sponsored by: Commissioner Santiago RESOLUTION NO. 13-8702 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA TO AMEND RESOLUTION 11-8250, REGARDING CITY COMMISSION APPROVAL OF ALL LITIGATION MATTERS PRIOR TO EXPENDITURE; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, on June 8, 2011, the City Commission of the City of Opa-locka adopted Resolution 11-8250; which states that all litigation must be approved by the Commission prior to expenditure; and WHEREAS, the City Commission of the City of Opa-locka desires to amend Resolution 11-8250, to provide that any and all litigation matters initiated by the City be approved prior to expenditure, but with the exception that litigation matters where another party is suing the City, can be defended by the City Attorney prior to authorization; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka, hereby amend Resolution 11-8250, to state that the City Commission shall approve any and all litigation matters initiated by the City prior to expenditure, except those litigation matters where another party is suing the City, which may be defended by the City Attorney prior to authorization. Section 3. This Resolution shall take effect immediately upon adoption. PASSEWANDADOFFED this 23rd day of October, 2013.
