Harry & Associaties for the Final Design and Construction Phases of Architectural and Engineering Services Sponsored by: City Manager RESOLUTION NO. 13-8704 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH M.C. HARRY & ASSOCIATES, INC., FOR THE FINAL DESIGN AND CONSTRUCTION PHASES OF ARCHITECTURAL AND ENGINEERING SERVICE PLANS; IN AN AMOUNT NOT TO EXCEED $237,600.00, A NON-BUDGETED ITEM; PAYABLE FROM ACCOUNT NUMBER 44-541823; PROVIDING FOR INCORPORATION OF RECITALS; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Opa-locka desires to enter into an agreement with M.C. Harry & Associates, Inc., for the Final Phase of the design and construction phase of architectural and engineering plan for the Historic City Hall; and WHEREAS, the Final Phase will include documentation and preparation for the construction phase - renovation and repair to prevent building degradation, and restoration of the Building, including improving/ replacing primary mechanical, electrical, plumbing and fire protection systems and all necessary plans and specifications; and WHEREAS,the City Commission of the City of Opa-locka desires to authorize the City Manager to enter into an agreement with M.C. Harry for the preparation of final architectural and engineering plans to be funded in its entirety by a grant from Miami-Dade County. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: Section 1. The recitals to the preamble are hereby incorporated by reference. Section 2. The City Commission of the City of Opa-locka, Florida, hereby directs and authorizes the City Manager to enter into an agreement with M.C. Harry& Associates, Inc., for the final design and construction phases of architectural and engineering plans for the Resolution No. 13-8704 Historic City Hall; in an amount not to exceed $237,600.00, a non-budgeted item; payable from Account Number 44-541823. Staff Summary: MC Harry and Associates, Inc. was selected by the city commission of the city of Opa-locka to provide professional Architectural and Engineering services for the Rehabilitation of the Historic City Hall Building. The phase-I of the scope to assess existing condition; prepare base drawings to identify the improvement requirements has been successfully completed. However,we do have up to$650,000 approved by Miami Dade County to expend on the project. To date,we have approved two contracts for the project: MC Harry and Associates Phase I -$181,160 and Mary Means -$60,000. The total so far is$241,160. This agenda item for MC Harry for Phase 2A and Phase 2B amounts to$237,600 will bring expenses to$478,760,well within the$650,000 contract with Miami Dade County. Therefore,we do have the dollars for this project and I will add it to the FY 2014 Budget Amendment. If we can contract with the County for the remaining$1.35 million before April 2014, I will add that to the amendment as well. Thank you. Financial Impact: The engineering services will be for rehabilitation of Old City Hall in FY 2012. Most of the stucco on exterior walls is being deteriorated because of the water infiltration through the roof and windows. Visible mold and water damage have been observed on this building. As a result, this is causing stucco to lose its bond and is affecting the masonry walls. Recommendation(s): Staff recommends approval in order to move ahead with the rehabilitation of Historic City Hall. Analysis: The engineering services from the qualified firms, experienced in the restoration of historic buildings, will assist City staff and contractors to rehabilitate Historic City Hall. M.C. Harry&Associates proposes to provide professional Architectural and Engineering services identified below for the Rehabilitation of Historic Opa-locka City Hall Building RFQ # 12-0706100, pursuant to the Contract Agreement with the City of Opa-locka for Architectural and Engineering Services. M.C. Harry & Associates has successfully completed Phase 1 of the services, which was the Conditions Assessment & Recommendations Report of the Historic Opa-locka City Hall (Administration Building) and the adjacent Historic Fire Station Building. The purpose of this proposal is to outline and detail, the next phase of professional Architectural and Engineering services to related the final design related to the restoration and rehabilitation of the main Administration Building. Our final report outlines the restoration/repair approach most beneficial to the condition of both buildings and the site's overall masterplan currently under development by Mary Means and Associates as your Programming and Planning Consultant. Phase 2 of the professional services will implement the restoration and the rehabilitation of the Administration Building. Subsequent phases, which the City may be implement at a later date, will address site improvements, restoration and rehabilitation of the Fire Station Building, potential tenant improvements for the Administration Building and any renovations of accessory structures on the site. The Administration Building is currently unoccupied and suffers a degree of damage from water intrusion, termite infestation and general neglect. Phase 2 would restore and rehabilitate the building in two stages, Phase 2A & Phase 2B. Our fee proposal is limited to scope of work related to these two construction packages. h., SCOPE OF WORK Repairs & Remediation Phase 2A: This package will implement the initial renovation and repair program to stabilize and prevent further building degradation. This phase of the work is limited to the permanent repair of the damaged roof cap of the observation Tower of the Administration Building, a major source of water intrusion into the building; removal of all water damaged materials, mold and mildew removal and building fumigation for --- termites. MCHarry and Associates will prepare Construction Documents(plans and specifications)to define a bid package which will be made available for bidding by the City to fast-track the repairs to the building. Restoration & Rehabilitation Phase 2B This package will provide for the Restoration of the Administration Building, including the exterior envelope, interior finishes, improve/replace the primary Mechanical, Electrical, Plumbing and Fire Protection systems and prepare the building to receive final, use-specific, interior improvements. The design documentation of this phase will start concurrently with Phase 2A with the intent of having the construction document package ready to start construction as soon as Phase 2A construction is completed. MCHarry and Associates will prepare Construction Documents (plans and specifications)to define a bid package which will be made available for bidding by the City. Future Phases: Future phases of improvements are not included at this time, and will be defined as needed. October 18,2013 Rehabilitation of Historic Opa-Locka City Hall Building RFQ#12-0706100 AE Fee Proposal—Phase 2A&2B—Rev 1 Page 2 BASIC SERVICES The professional Architectural and Engineering Services will include all Architectural, Structural Engineering, and Mechanical, Electrical and Plumbing Engineering Services as outline below. Basic Services are defined for this project as follows: 1. Construction Documents Phase: We will prepare Final Construction Documents setting forth all design drawings and specifications needed to obtain competitive bids from qualified contractors; and to obtain a building permit to construct the Project. • Phase 2A: Repairs& Remediation: We will prepare Construction Drawings, and specifications to define the scope of work needed to allow the city to request bids for construction. We will provide an AE estimate of the Probable Construction Cost. We will provide progress sets in PDF format for review and approval at 90%and Final Construction Documents stages. i. 90% CD: shall include all documents and technical specifications, including engineering sheets; ready for final technical review and comment ii. Final Contract Documents: shall be the 90% set, updated with all comments, and shall be ready to bid/submit for permit. • Phase 2B: Restoration & Rehabilitation: We will prepare Construction Drawings, and technical specifications to define the scope of work needed to allow the city to request bids for construction. We will provide an AE estimate of the Probable Construction Cost. We will provide progress sets in PDF format for review and approval at 30%, 60%, 90% and Final Construction Documents stages. i. 30% CD: shall include base floor plans; ceiling plans; elevations and the beginning of details; ii. 60% CD: shall include the above information, in more advanced detail, and the initial engineering information; iii. 90% CD: shall include all documents and specifications, including engineering sheets; ready for final technical review and comment iv. Final Contract Documents: shall be the 90% set, updated with all comments, and shall be ready to bid/submit for permit. • NOTE: Normal procedure dictates that the City will need to provide the AE with the 'Division 0' documents of the specification. This includes the Instructions to Bidders, General Conditions, the Contract for Construction, and defines construction Insurances, bonds and other requirements. MCHarry will coordinate this owner provided documents with the technical specifications. 2. Permitting Phase — applies to both phase 2A and 2B packages: Upon completion of the Contract Documents, we will provide the City with assistance in filing for, and obtaining the necessary building permits. We will provide up to two (2) hard copy sets of plans, signed and sealed by the professionals of record for submittal to the building department. We will respond to all review comments by the Building Department and revise the plans as needed to resolve those comments. 3. Historic Preservation Board: We have NOT included services to present a summary of the project scope to the Historic Preservation Board, as it is considered an OPTIONAL service. If it is required, the AE fees needed will be funded from the Additional Services Allowance. 4. Bidding and Award of Contract: — applies to both phase 2A and 2B packages: During the phase of the work, the City will be obtaining competitive bids from qualified contractors. We will provide the city with a copy of the technical bid documents (plans and specifications) for the City to advertise and distribute. MCHarry will Attend pre-bid meeting with potential bidders, respond to questions from bidders, assist with preparation of addenda as needed, assist with evaluation of the bids and award recommendation as needed. Construction Phase Services: — applies to both phase 2A and 2B packages: During the construction phase of each package, MCHarry will assist the City with limited professional services to assure the construction work is being done in conformance with the plans and specifications; Specifically we will: • Visit the construction site on a periodic basis; and attend regularly scheduled construction meetings (assumed every 2 weeks); • We will provide responses to contractor requests for information (RFI); and provide interpretations to the Construction Documents as needed; • We will provide review and approval of required shop drawings; • We will assist the city as needed with review and recommendations for contractor pay applications; • Upon the contractor reaching substantial completion (the work has been completed to a level that it can be used); the AE will provide a site visit and detailed punch list; • Upon completion of the punch list, the AE will visit the site and sign off on all completed punch list work. • We will update the plans to reflect minor changes made during construction based on contractor provided markup of the drawings, and provide the City with a final PDF copy of thee record drawings. We will also provide the City with a disk containing the AutoCAD (*DWG) files for the project for your records. COMPENSATION The TOTAL compensation shall include Basic Services plus the allowances for Reimbursable Expenses and Additional Services as outlined below. The City shall not be liable for any fee, cost, expense or reimbursable expense or other compensation beyond this amount without further authorization. BASIC SERVICES M.C. Harry & Associates shall perform the Work detailed in this Proposal for a Lump Sum Basic Services fee of Two Hundred Seven Thousand, Six Hundred dollars and no cents ($207,600)for Phase 2A and 2B. See detailed summary of compensation below. REIMBURSABLE EXPENSE Reimbursable Expenses are for direct costs expended for the benefit of the City by MCHarry and Associates. Reimbursable expenses shall include Regulatory fees, if any; special printing or renderings requested by the City; out of town travel (not expected); Cost of testing related to the work (environmental, hvac test and balance, material testing) We have recommended an allowance (Not to Exceed) amount of Ten Thousand dollars ($10,000.00). ADDITIONAL SERVICES Additional Services are in addition to Basic Services and are only provided if authorized in advance by the City. We have recommended an allowance (Not to Exceed)amount of Twenty Thousand dollars ($20,000.00) Additional Services can include changes to previously approved documents; design services related to added or unforeseen scope; services required due to the default of the contractor; services required by an extended construction phase services beyond the original anticipated schedule. Compensation shall be invoiced to the City monthly in proportion to the tasks completed. Retainage, if any shall be released upon successful completion of each task. Dear Mr. Baker: This is our REVISED proposal, based in-part on our negotiation meeting of November 6,2012 our meeting of December 6,2012 and information obtained this past month.This fee proposal assumes the City will engage Mary Means+Associates as your Programming and Planning Consultant. M.C. Harry and Associates will collaborate with this firm,but they will perform the bulk of the tasks as outlined in their agreement. M.C. GENERAL BACKGROUND: The Opa Locka City Hall is a historically significant building and is listed on the National Register of Historic Places. The building,featuring Morrish Revival Architecture,was completed in 1926 by architect Bernhardt E. Muller and was last restored in 1987. MCHarry and Associates is presenting herewith a full service team to develop rehabilitation/restoration/enhancement program that will respect the building's unique history and original design. Historic City Hall has been unoccupied for several years and suffers a degree of damage from water intrusion, termite infestation and general neglect. MC Harry Associates has been engaged by the City to conduct an analysis of existing conditions and develop a program for complete restoration to be implemented in phases. Phase 1 shall include a complete conditions assessment, leading to a budget and work plan for implementation; FUTURE PHASES: Future phases of our services will be for Basic Services related to the development of the construction documents, assistance with obtaining permits, and construction administration of the subsequent restoration efforts as they are developed. We cannot provide the fees for this phase of the work at this time until we conclude the Condition Assessment. Each phase will have its own fee and schedule. The final 'use' of the Historic City Hall has not been determined, but we will assume that the building will continue to be used for public purposes, providing general meeting spaces and offices for the City, therefore the initial scope of the project will be as follows for Phase 1: SCOPE OF WORK The Phase 1 work shall be organized in four (4) tasks. These tasks are not necessarily sequential; and in-fact will be completed simultaneously. MCHarry has researched local archives and located many of the original drawings, but they are only available in photographic, non-scaled documents. We propose to develop existing condition drawings (site plan, floor plans, reflected ceiling plans, elevations, building sections) in Auto-CAD (DWG)for use as the base documentation. The following are the tasks required: 1. We will visit the site with a team of architects to take field measurements of all building elements. 2. We will develop CAD floor plans, roof plan,exterior elevations and sections of the existing building using a combination of the information from the archives, plus the measured data. Deliverables for this Task Auto-CAD(DWG);submitted in PDF format:site plan,floor plans, reflected ceiling plans, elevations, building sections. Fee/Compensation: $27,000.00 Task 3—Collaborate with Planning+Programming Consultant. The City has or will engage Mary Means +Associates who will provide the City with Programming and Planning services designed to evaluate future uses of the building, and the possible impact those uses might have on the restoration scope. MCHarry will collaborate with the City staff and Mary Means + Associates to review the scope of the renovations/ restoration to build concurrency between the required scope, available budgets and expectations. We anticipate the following tasks leading to a consensus for the future use of the Opa- Locka City Hall. 1. Meetings with City staff and Mary Means + Associates to consider and outline potential future uses;and receive your input, ideas and thoughts for consideration. 2. MCHarry will develop conceptual floor plan and site graphics to graphically represent the various options for future use. 3. Attend Community Input Workshop (hosted by the City and organized by Mary Means + Associates) to present the concepts and ideas, and to encourage the community to participate in the planning. The City will select three consultants to compete in providing professional engineering services, based on an agreed-upon specific scope of services and fees. Financial Impact: The engineering services will be for rehabilitation of Old City Hall in FY 2012. Funding for the engineering services will come from CDBG dollars assigned to Segal Park if approved by the City Commission. Implementation Time Line: As soon as possible. Lesislative History: Resolutions#08-7363, 10-8041 and 10-8107 City Hall was built in 1926. The external envelop of the building including roof are in poor condition. Most of the stucco on exterior walls is being deteriorated because of the water infiltration through the roof and windows. Visible mold and water damage have been observed on this building. As a result, this is causing stucco to lose its bond and is affecting the masonry walls. Recommendation(s): Staff recommends approval in order to move ahead with the rehabilitation of Historic City Hall. Analysis: The engineering services from the qualified firms, experienced in the restoration of historic buildings, will assist City staff and contractors to rehabilitate Historic City Hall.
