A RESOLUTION OF 'P HE CITY C"OUi~CIL OF THE CITY OF' LYNW(:~OD AUTHORIZING
AND DIRECTING THE CONDEMNATION OF CERTAIN REAL PROPERTY N THE
COUNTY OF LOS ANGELES, STATE OF CALIFORNIA r'4ND DECL,ARiNG THE PUBLIC
NECESSITY TfiEREF'OR
WHEREAS, the City c?f Lynwood is authorized by virtue of thr* Statues of
the State of California to take prog~e~rty by. corYdemnation and to hotel, iAse aru9 enjoy
said property as necessary to thF fu?.l e~~ercise of its pouter,
NOW, THEREFORE, the: City Council of flee Ct;j of Lynwood hereby does
resol<,e as follows:
SI~.CTlON la The City Council of the City of Lynwood has found a.nd
determined and does hereby find and determine that the public interest and necessity
require for public use the acquisition, construction, completion, operation and
maintenance by said City of Lynwood of certain pub tic improvements, to Wlth; easement
for storm drain purposes, and that a certain real property situated ir, the City
of Lynwood, County of Los Angeles, State of California, is rkecessary therefor.
SECTION 2~ The real property, the acquisition of which is required for
the public interest and necessity for the us~:s and purpose: sat forth in Section 1
hereof, is situated in the City of L,.ynwood, County of Los Angeles, State of California,
and is more particularly described as follows:
Parcel 40~ (Peach Street Storm Drain and Road fmprovernent)
That portion of the portion of Lot 39, Tract Noo 2551n lying
southerly of the westerly prolongation of the northerly tine of Lot
37 of said Tract No, 255Y, as shown on map filed in Book 24, pages
78, 79 and 80, of Maps, in the office of the Recorder of the Couryty
of Los Angeles, on the included maps, and within the following
boundaries„ Beginning at a point of intersection of the westerly pro-
l.oi~agation of the northerly tube of Lot 37 and the westerly Hine of Lot 39,
that said point of intersection being southerTty 9.660 02 feet from the
northerly corner- along westerly line of said Lot 39, therbce easterly
50 33 feet along said westerly prolongation to the easterly tine of the
westerly 50 33 feet of said lot 39; thence southerly 530 04 feet along
said easterly line to the northerly tine of the southerly 7e 00 feet of
said Lot 39y thence westerly along the fleet mentioned northerly tone
to the westerly tine of Oast mentioned tot; thena:e northerly 59, 18 feet
to the point of beginningo
SECTION 3. Said public improvement is planned and located in the
manner which will be most compatible with the greatest public good and the least
private injury,
SECTION 4, The law firm of Rutan and Tucker, attorneys for the
City of Lynwood, is hereby directed to bring action in the Superior Court of the State
of California in the name of the City of Lynwood, to condemn for eminent domain
proceedings the property described in Section 2 hereof. Said attorneys are authorized
and instructed to make application to said Court for an Order fixing the amount of
security by way of money deposits as said Court may direct and for an Order permitting
the City of Lynwood to take possession and use of said real property for the uses and
purposes herein described.
SECTION 5. For the purposes of bringing such action, the firm of
Rutan and Tuoker is hereby empowered to incur, in the name of the City of Lynwood
all obligations and expenses incidental thereto.

regular meeting held on the second day of September
