Mayor Vandernail called the meeting to order at 6:00 p.m.

2. Approval of Agenda:
Trustee Soles moved, and Trustee Waldow seconded the motion to approve the
agenda Motion carried: 6-0.
3. Executive Session
For a conference with the Town Attorney for the purpose of receiving legal advice on
specific legal questions under C.R.S. Section 24-6-402(4) (b) For the purpose of
determining positions relative to matters that may be subject to negotiations, developing
strategy for negotiations, and/or instructing negotiators, under C.R.S. Section 24-6-
402(4)(e) regarding litigation to include the TM Durbin, and TA McGowan and TP
Trotter.
Trustee Soles moved, and Trustee Miller seconded the motion to open the Executive
Session at 6:02 p.m. Motion carried: 6-0
Trustee Soles moved, and Trustee Waldow seconded the motion to close the Executive
Session at 6:51 p.m. Motion carried: 6-0
Attorney's Opinion Required by C.R.S. 24-6-402(2)(d.5)(II)(B).
As the attorney rep =--nting the Town of Fraser, I am of the opinion that the entire
executive session, whic was not recorded, constituted a privileged attorney-client

For a conference with the City Attorney for the purpose of receiving legal advice on
specific legal questions under C.R.S. Section 24-6-402(4) (b) For the purpose of
determining positions relative to matters that may be subject to negotiations, developing
strategy for negotiations, and/or instructing negotiators, under C.R.S. Section 24-6-
402(4)(e) regarding franchise agreement. and to include the TM Durbin, and TA
McGowan.
The Executive Session was tabled to a future meeting.
5. Consent Agenda

b) Ordinance 461 Town Treasurer
Trustee Soles moved, and Trustee Waldow seconded the motion to approve the
consent agenda. Motion carried: 6-0.
6. Public Hearing and Possible Action Regarding
a) Regarding Right of Way Vacation, Old King Road and Forest Trail Road
Mayor Vandernail opened the Public Hearing Regarding Right of Way Vacation, Old
King Road and Forest Trail Road
Clark Lipscomb from Cornerstone Holdings, LLC and Dan Harvey representing Winter
Park presented to the Board.
Mr. Harvey requested that the matter be tabled and the hearing continued to allow
Winter Park time to further review the matter. Mr. Lipscomb consented, on behalf of the
petitioner, that the hearing could be continued until January 23, 2019.
Trustee Soles moved and Trustee Miller seconded the motion to continue the Public
Hearing Regarding Right of Way Vacation, Old King Road and Forest Trail Road to
January 23, 2019. Motion carried 6-0.
Town Attorney McGowan was excused after the Public Hearing regarding Right of Way
Vacation, Old King Road and Forest Trail Road.
b) Regarding Right of Way Vacation, Johns Drive
Mayor Vandernail opened the Public Hearing Regarding Right of Way Vacation, Johns
Drive
Trustee Soles moved and Trustee Quinn seconded the motion to close the Public
Hearing Regarding Right of Way Vacation, Johns Drive. Motion carried 6-0.
bi) Trustee Soles moved, and Trustee Quinn seconded the motion to approve
Ordinance 466 Right of Way Vacation Johns Drive. Motion carried: 5-1, Nay Waldow
c) Regarding Rendezvous East Mountain Filing 11 Easement Vacation
Mayor Vandernail opened the Public Hearing Regarding Rendezvous East Mountain
Filing 11 Easement Vacation

Trustee Waldow moved and Trustee Soles motioned to close the Public Hearing
Regarding Rendezvous East Mountain Filing 11 Easement Vacation.
Motion carried 6-0.
ci) Trustee Soles moved, and Trustee Quinn seconded the motion to approve
Ordinance 464 Rendezvous East Mountain Filing 11 Easement Vacation. Motion
carried 6-0.
d) Regarding 2019 Budget
Mayor Vandernail opened the Public Hearing Regarding 2019 Budget
TM Durbin presented to the Board.
Trustee moved, and Trustee seconded the motion to continue the Public Hearing
Regarding 2019 Budget. Motion carried 6-0.
7. Discussion and Possible Action
a) Attainable Housing PIF Incentive Program Renewal
Trustee Miller recused himself from the discussion.
An amended Attainable Housing PIF Incentive Program Resolution will be presented at
the TB Meeting on December 5, 2019.

Trustee Soles moved, and Trustee Quinn seconded the motion to adjourn. Motion
carried: 6-0. Meeting adjourned at 9:35 p.m.
