ORDINANCE NO. 1448
AN ORDINANCE OF THE CITY OF LYNWOOD
AMENDING URGENCY ORDINANCE NO. 1444
WHICH IMPOSES A MORATORIUM ON THE
ESTABLISHMENT OR EXPANSION OF RECYCLING
FACILITIES WITHIN ALL LAND USE ZONES OF
THE CITY, EXTENDING THAT MORATORIUM TO
DECEMBER 17, 1997, AND DECLARING THE
URGENCY THEREOF
THE CITY COUNCIL OF THE CITY OF LYN[nI00D DOES ORDAIN AS
FOLLOWS:
Section 1. Section 2 of Ordinance No. 1444 is amended in
its entirety to read as follows:
"Section 2. The moratorium established in-Section 1 above
does not apply to the following:
(a) The construction of buildings or structures for
which all permits have obtained as of the effective date
of this interim ordinance.
(b) The processing and approval by the Lynwood
Redevelopment Agency of any project involving a new or
expanded recycling use where the governing board of the
Agency has made a determination that the project will
substantially advance the goals and objectives of the
redevelopment process and will contribute towards the
elimination of blight in a redevelopment project area."
Section 2. In accordance with Government Code Section
65858(d), the City Council did, on January 21, 1997, issue a
~-written•report-°-describing the measures taken to alleviate the
conditions which led to the adoption of Ordinance No. 1444 and
thereafter conducted a noticed public hearing as required by
Government Code Section 65858(a) In accordance with applicable
law, Ordinance No. 1444 is extended for a period of ten months and
15 days to December 17, 1997 and shall thereupon be of no further
force and effect.
Section 3. The City Council, the Planning Commission and
the Department of Community Development are continuing to study
various measures to alleviate the conditions which led to the
adoption of Ordinance No. 1444, which conditions are recited in
Section 4 of Ordinance No. 1444 and which continue to pose a
current threat to the public health, safety and welfare. This
Ordinance extending Ordinance No. 1444 will ensure that no
approvals or entitlements for recycling facilities will be granted
under the zoning ordinance or other ordinances so as to conflict
with future zoning regulations now under consideration and study.
Section 4. The City Council incorporates by this reference
the findings set forth in Section 4 of Ordinance No. 1444 and
further determines that this Ordinance e_2teridirig Ordinance-ATO. 1444
is necessary to prevent a current and immediate threat to the
public health, safety and welfare. This Ordinance is an urgency
Ordinance and shall take effect immediately.
