AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING,
AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF
JEFFERSON, BY REZONING 0.14 ACRES FROM RS-2 LOW DENSITY RESIDENTIAL TO
RS-4 MEDIUM DENSITY RESIDENTIAL AND REZONING 0.19 ACRES FROM RS-2 LOW
DENSITY RESIDENTIAL TO C-O OFFICE COMMERCIAL, FOR LAND ADDRESSED AS
1707 STADIUM BOULEVARD, DESCRIBED AS PART OF LOT 20 OF H.A. SWIFT AND A.
THOMPSON SUBDIVISION, JEFFERSON CITY, COLE COUNTY, MISSOURI, AND
ENDORSING AN AMENDMENT ON THE DEVELOPMENT PLAN MAP OF THE
COMPREHENSIVE PLAN TO REFLECT SUCH CHANGE.
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning
have in all matters been complied with; and
WHEREAS, The zoning ordinance requires consistency between the comprehensive plan
and the zoning map and the proposed zoning change would necessitate a
change to the Comprehensive Plan Development Plan Map.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is rezoned from RS-2 Low Density
Residential to RS-4 Medium Density Residential: A tract of land situated in and being a part
of Lot 20 of H.A. Swift and A. Thompson Subdivision; also being a part of the tract of land
described by deed recorded in Deed Book 392, Page 199 of the Records of Cole County,
Missouri all being in the Northwest Quarter of Section 13, Township 44 North, Range 12
West, Cole County, Missouri; said tract being more particularly described as follows:
Commencing at the Northwesterly Corner of Lot 20 of H.A. Swift and A. Thompson
Subdivision as recorded in Deed Book 001, Page 009 of the Records of Cole County, MO;
thence S00°00'00"E, along the Easterly Right of Way Line of Southwest Boulevard 5.00 feet;
thence leaving said Easterly Right of Way Line N89°58'1 5"E along the Southerly Right of Way
Line of Stadium Boulevard 142.39 feet to the point of beginning;thence continuing along said

Residential to Medium Density Residential (Detached) and in Section 2 from Low Density
Residential to Commercial.
Section 4. This ordinance shall be in full force and effect from and after its passage
and approval.

Case No. P09011 — 1707 Stadium Boulevard; Rezoning from RS-2 to RS-4 and C-O
and Comprehensive Plan Amendment. Application filed by Bert Doerhoff, property
owner, to rezone 0.14 acres from RS-2 Low Density Residential to RS-4 Medium Density
Residential and to rezone 0.2 acres from RS-2 Low Density Residential to C-O Office
Commercial and an associated amendment to the Comprehensive Plan. The property is
located on the south side of Stadium Boulevard approximately 175 feet east of Southwest
Boulevard. The property is described as part Lot 20 of H.A. Swift and A. Thompson
Subdivision, Jefferson City, Cole County, Missouri. (Harms Inc, Consultant)
Mr. Barron described the proposal and explained that the subject property is currently
being utilized as a single family residential lot. He stated that the request is to establish two
separate zoning districts on the property of which the rear of the property is proposed as C-O
Office Commercial and the front of the property is proposed as RS-4 Single Family
Residential. Mr. Barron explained that the intent is to not only divide the lot in two pieces but
to construct a commercial parking on the rear of the property. He stated that the parking lot
would be accessed by an easement from the neighboring property. Mr. Barron explained that
the front portion of the property would require rezoning to a higher residential zoning
classification because the minimum lot standards of the RS-2 zoning district would not allow
a parcel division to be approved.
Mr. Bert Doerhoff, 1301 Southwest Boulevard, spoke regarding this request and
explained that his existing business consists of 4,800 square feet of office space and only 19
parking spaces to accommodate staff and clients. He stated that a commercial parking lot
would be constructed at the rear of the property to serve the existing business. Mr. Doerhoff
clarified that the existing house facing Stadium Boulevard will remain as single family
residential.
No one spoke in opposition to this request and no correspondence was received.

Mr. Barron gave the Planning Division staff report and explained that the Comprehensive
Plan Amendment will show the rear portion of the property as commercial and the front
portion of the property as medium density residential detached. He stated that rezoning the
rear of the property to commercial would not appear to create any major land use conflicts.
Mr. Barron explained that rezoning the front portion of the property to a higher form of single
family residential zoning would allow for the intended parcel division and would not result in a
substandard residential lot.
Mr. Nunn moved and Mr. Yarnell seconded to recommend approval of the
Comprehensive Plan Amendment to show the front portion of the property as Medium
Density Residential detached and the rear portion of the property as Commercial, to the City
Council. The motion passed 7-0 with the following votes:
Aye: George, Hagan, Mihalevich, Nunn, Robinett, Stacey, Yarnell
Mr. Nunn moved and Mr. George seconded to recommend approval of rezoning the front
portion of the property from RS-2 to RS-4 and the rear portion of the property from RS-2 to C-
O, to the City Council. The motion passed 7-0 with the following votes:

commercial land at the intersection of Stadium Boulevard and Southwest
Boulevard.

into account during the adoption of the Comprehensive Plan.

Case No. P09011 — 1707 Stadium Boulevard; Rezoning from RS-2 to RS-4 and C-O and Comprehensive
Plan Amendment. Application filed by Bert Doerhoff, property owner, to rezone 0.14 acres from RS-2 Low
Density Residential to RS-4 Medium Density Residential and to rezone 0.2 acres from RS-2 Low Density
Residential to C-O Office Commercial and an associated amendment to the Comprehensive Plan. The property
is located on the south side of Stadium Boulevard approximately 175 feet east of Southwest Boulevard. The
property is described as part Lot 20 of H.A. Swift and A. Thompson Subdivision, Jefferson City, Cole County,
Missouri. (Harms Inc, Consultant)
Nature of Request
This rezoning and comprehensive plan amendment request is for a tract of land that consists of 0.34 acres and is
currently utilized as a single family residential lot. The request is to establish two separate zoning districts on
the property. The rear of the property is proposed as C-O Office Commercial and the front of the property is
proposed as RS-4 Single Family Residential. The property would later be divided into two pieces along the
zoning boundary line via an administrative parcel division. The purpose for the request is to facilitate the
construction of a commercial parking lot at the rear of the property and continue to utilize the existing home on
the property as a single family residence. The commercial zoning at the rear of the property would allow for a
commercial parking lot, which would serve the existing office building located on the corner of Southwest
Boulevard and Stadium Boulevard. The residential zoning at the front of the property would allow for a smaller
lot size than is allowed in the current RS-2 zoning of the property. The minimum lot size for the RS-2 zoning
district is 10,000 square feet while the minimum lot size for the RS-4 zoning district is 6,000 square feet. The
proposed lot size for the single family portion of the property is approximately 6,400 square feet.

Comprehensive Plan Amendment:
While the intended use of the property is currently designated as low density residential on the development
plan map of the comprehensive plan, the property is immediately adjacent to a commercial node located at the
intersection of two arterial streets. A re-designation of the rear portion of the property to commercial would be
a logical expansion of the commercial node that would not be a major change in the intended use pattern for this
area. A re-designation of the front portion of the property to medium density residential (detached) could be
considered a transition between the adjacent commercial and low density residential designations. Staff
recommends approval of the Comprehensive Plan Amendment.
Rezoning Request:
The requested commercial zoning would be a logical expansion of the existing node of commercial zoning
located at the intersection of Southwest Boulevard and Stadium Boulevard. The commercial rezoning at the
rear of the property would not appear to create any major land use conflicts and the expansion of the
commercial node would be a benefit to the adjacent commercial operations. The requested rezoning of the front
portion of the property to a higher form of single family residential zoning would allow for the intended parcel
division and would not result in a substandard residential lot, especially considering the close proximity of the
existing house to commercial operations. Staff recommends approval of the request to rezone the property.

1. Approval of the amendment to the Development Plan Map of the Comprehensive Plan to show the front
portion of the property as Medium Density Residential (detached) and the rear portion of the property
as Commercial.
2. Approval of the request to rezone the front portion of the property from RS-2 to RS-4 and the rear
portion of the property from RS-2 to C-O.
