AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND APPROVING
THE FINAL SUBDIVISION PLAT OF EMILY LANE SUBDIVISION, SECTION ONE, A
SUBDIVISION OF THE CITY OF JEFFERSON, MISSOURI.
WHEREAS, Dale and Alvyne Scheperle, owners of the real estate hereinafter described,
having submitted to the City Council a plat of said real estate, being located in Jefferson City, Cole
County, Missouri, and being part of the Southwest Quarter of the Southwest Quarter of Section 8,
Township 44 North, Range 12 West, and part of the Northwest Quarter of the Northwest Quarter
of Section 17, Township 44 North, Range 12 West, in the City of Jefferson, Cole County, Missouri,
more particularly described as follows: From the southwest corner of Section 8, Township 44
North, Range 12 West, Cole County, Missouri; thence N6 032'04"W, along the Section Line, 813.10
feet to the most northerly corner of a tract described by deed of record in book 401, page 939,
Cole County Recorder's Office; thence S55 048'04"E, along the northerly line of the aforesaid tract
described in book 401, page 939, 309.05 feet to the northeasterly corner thereof; thence

WHEREAS, it appearing that said plat has been fully and properly signed and accepted by
the owner of said subdivision, known and referred to as the Final Subdivision Plat of Emily Lane
Subdivision, Section One, that all taxes have been paid, that in all respects the requirements of
Chapter 445, RSMo, entitled "Plats" have been fully complied with by the owner of said
subdivision, and that in all respects the requirements of the Planning and Zoning Commission of
the City of Jefferson, Missouri, relating to plats and subdivisions have been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. That the Final Subdivision Plat of Emily Lane Subdivision, Section One, lying,
being and situated within the corporate limits of the City of Jefferson, Missouri, as shown by the
said plat attached hereto and made a part of this ordinance, is hereby approved and accepted by
the City Council of the City of Jefferson, Missouri.
SECTION 2. The Mayor and City Clerk are hereby authorized and directed to endorse
acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of
Jefferson.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

Case No. P09013 — 4700 Block of Old Lohman Road; Final Subdivision Plat of
Emily Lane Subdivision, Section One. Application filed by Dale and Alvyne Scheperle,
property owner, for a final plat of 3.99 acres on land zoned RA-1 High Density
Residential. This proposed final plat includes 11 residential lots. The property is located
on the northern side of Old Lohman Road approximately 250 feet west of South Country
Club Drive. The property is described as part of the Southwest Quarter of the Southwest
Quarter of Section 8 and part of the Northwest Quarter of the Northwest Quarter of
Section 17, Township 44 North, Range 12 West, Jefferson City, Cole County, Missouri
(Central Missouri Professional Services, Consultant)
Mr. Barron described the proposal and explained that the Preliminary Plat was approved
by the Planning and Zoning Commission on February 12, 2009. He stated that the subject
property consists of 11 lots on 3.99 acres and is zoned RA-1 High Density Residential. Mr.
Barron explained that one new street to be named Emily Lane is proposed to access Old
Lohman Road from the existing entrance on the property frontage.
Mr. Mike Bates, Central Missouri Professional Services, 2500 E. McCarty Street, spoke
regarding this request. Mr. Bates explained that the driveway access issues discussed at the
February 12, 2009 Commission meeting have been resolved. He stated that they are
proposing to submit Section Two for consideration at the April 9, 2009 Commission meeting.
Mr. Bates stated that he concurs with staff comments and recommendations.
No one spoke in opposition to this request and no correspondence was received.

Mr. Wade gave the Engineering Division staff report and explained that driveway access
will be from Old Lohman Road for proposed Lots 1, 2, 10 and 11 with the following
stipulations: (1) only one entrance per lot with a common drive for all units, not individual
drives to each unit; and (2) turnarounds will need to be constructed on the lots so that
vehicles will not have to back out onto Old Lohman Road. He stated that these provisions
are slightly different from what was proposed during preliminary plat approval however they
are acceptable to the Director of Public Works and the Scheperle's. Mr. Wade explained that
a four(4)foot wide sidewalk is proposed along Emily Lane and a five (5)foot wide sidewalk is
proposed along Old Lohman Road.
Mr. Nunn inquired of who is responsible for the widening of Old Lohman Road. In
response, Mr. Wade explained that the developer is responsible for widening Old Lohman
Road along proposed Lots 1 and 2.
Mr. Nunn moved and Mr. George seconded to recommend approval of the Final Plat of
Emily Lane Subdivision, Section One to the City Council subject to compliance with the
comments and technical corrections of the Engineering Division. The motion passed 7-0 with
the following votes:

Case No. P09013 — 4700 Block of Old Lohman Road; Final Subdivision Plat of Emily Lane
Subdivision, Section One. Application filed by Dale and Alvyne Scheperle, property owner, for a final
plat of 3.99 acres on land zoned RA-1 High Density Residential. This proposed final plat includes 11

Background
This Major Subdivision Plat is for a new residential subdivision. The Preliminary Plat for this subdivision
was approved by the Planning and Zoning Commission on February 12, 2009.
Description of Proposed Plat
Zoning: RA-1 High Density Residential
Size of Property: 3.99 Acres
Number of Lots: 11
Lot Sizes: Smallest Lot—0.27 acres
Largest Lot—0.43 acres
Streets: One new street,named Emily Lane,would be platted with the Final Plat.
Sidewalks: Sidewalks are indicated on the Preliminary Plat along Emily Lane and along Old Lohman
Road.
Staff Recommendation
Staff recommends approval of the final subdivision plat subject to the following:
1. Compliance with the comments and technical corrections of the Engineering Division.

ENGINEERING STAFF RECOMMENDATION-
Recommend approval.
Existing Infrastructure Summary
* Infrastructure exists in the vicinity. New sidewalk is planned along Emily Lane and Old
Lohman Road. Storm water detention is not a specific requirement in this development,
as lots proposed are residential lots. Sanitary sewer exists on this property and is
proposed to be extended to serve all proposed lots.
Improvements Summary
Roadway, Storm Water/Erosion Control
* Roadway, storm water and erosion control plans are being reviewed and are nearly in
approvable form.
* A turnaround has been shown past the last lots of Section One (1) so that drive access to
the last lots in Section One (1) will be unrestricted.
* In discussions with the owner, driveway access will be from Old Lohman Road for
proposed Lots 1, 2, 10 and 11 with the following stipulations;
1. Only one entrance per lot(a common drive for all units, not individual drives
to each unit)
2. Turnarounds will need to be constructed on the lots so that vehicles will not
back out onto Old Lohman Road. A note has been added to the plat indicating
this.
This provision is slightly different that what was proposed during preliminary plat
approval, but is acceptable to the Deputy Director for Public Works.
* Widening of Old Lohman Road and addition of curb and gutter along proposed Lots 1
and 2 is being reviewed as part of the street improvements.
Sanitary Sewer
The proposed development is served by an existing sanitary sewer main running through
the property. A sewer main extension is proposed to serve the lots within the
subdivision. Sanitary sewer main extension plans are being reviewed and are nearly in
approvable form.
Sidewalk
* A four (4) feet sidewalk is proposed along Emily Lane. A five (5) feet sidewalk is
proposed along Old Lohman Road.
Street Access /Traffic Impact
Emily Lane is proposed to access Old Lohman Road from the existing entrance on the
property frontage.
* Parking is proposed on one (1) side (the east side) of Emily Lane.
Fire Hydrants /Street Li{7hts
* Facilities exist along Old Lohman Road. Facilities within the subdivision are proposed in
accordance with City standards.
