HomeMy Public PortalAbout1994-035Member Arai Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. y ,3<_f RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO NORTH STAR MATTRESS FACTORY, INC. FOR A FACTORY AND SHOWROOM ON LOT 1, BLOCK 1 GRIER INDUSTRIAL PARK WHEREAS, North Star Mattress Factory, Inc. ("Applicant") has requested permission to construct a factory and showroom facility at 3795 Pinto Drive, which property is legally described as Lot 1, Block 1 Grier Industrial Park; and WHEREAS, the proposed use requires a conditional use permit under the city's zoning ordinance; and WHEREAS, the planning commission reviewed this matter at its meeting on May 10, 1994 and the city council reviewed the application on June 7, 1994; and WHEREAS, the city council has determined that the proposed factory/showroom facility will not interfere with development of adjacent property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the above purpose, subject to the following conditions: 1. There shall be no exterior storage on the site; 2. Any signs erected on the site must comply with all zoning requirements; 3. The landscaping to be installed on the east side of the lot shall include 8 spruce trees a minimum of 6 feet in height, in accordance with a plan submitted and approved by the city staff; 4. Roof top or outside mechanical equipment shall be screened from view from adjacent properties and right-of-ways; 5. All landscaping to be installed shall be in accordance with a plan approved by city staff . The Applicant shall maintain all landscaping and replace dead landscaping as necessary; 6. The parking area shall be constructed in accordance with city requirements; RBB71725 ME230-206 7. The loading areas shall be constructed in accordance with city requirements; 8. The hours of operation shall be Monday through Friday, 7 a.m. to 10 p.m.; Saturday, 7 a.m. to 6 p.m.; and Sunday, 10 a.m. to 6 p.m.; 9. The number of employees shall not exceed 15; 10. Any exterior lighting must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property or right-of-way; 11. Site drainage shall be reviewed and approved by the city engineer prior to issuance of a building permit; 12. The Applicant shall install a sprinkling system in the building in accordance with city requirements; 13. The fire department shall review and approve plans for the building; 14. The Applicant shall enter into a development agreement with the city, including a deposit of $60,173, to insure completion of required site work; and 15. The Applicant shall pay a fee to the city in an amount determined by staff to represent the actual cost to the city of reviewing this conditional use permit NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota that the following variances shall be granted: 1. Reduce side yard set back (south side) from 30 feet to 10 feet; 2. Reduce rear yard set back from 30 feet to 24 feet; and 3. Reduce set back for parking area in the front of the lot from 25 feet to 7 feet. The above variances are justified by the hardship which exists due to the shape of the lot. Dated: June 21 , 1994.
