HomeMy Public PortalAbout1994-036Member Ann Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. -� RESOLUTION GRANTING AN AMENDED CONDITIONAL USE PERMIT TO DOUGLAS LEATHERDALE AND LOUISE LEATHERDALE FOR LARGE ACCESSORY STRUCTURES AT 2075 COTTONWOOD TRAIL WHEREAS, by Resolution No. 89-4, adopted January 17, 1989, the city of Medina granted a conditional use permit to Douglas Leatherdale and Louise Leatherdale ( "Applicants") for conditional use permit to allow construction of a second accessory building on their property at 2075 Cottonwood Trail; and WHEREAS, the Applicants have requested permission to add 4,000 square feet to the existing stable of 15,350 square feet for a total of 19,350 square feet of accessory structure; and WHEREAS, this matter was reviewed by the planning commission at its meeting on May 10, 1994 and by the city council on June 7, 1994; and WHEREAS, the city council has determined that the amended conditional use permit would not adversely impact development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that an amended conditional use permit be granted to the Applicants for the above purpose, subject to the following conditions: 1. The two accessory structures, including the new addition may not exceed 25,000 square feet in size; 2. The number of horses maintained on the property may not exceed 20; 3. There shall be no commercial boarding of horses on the property; 4. Site drainage shall be reviewed and approved by city staff; 5. There shall be no living quarters in either accessory structure; 6. The fire marshall shall review the plans for the existing barn; RHB71727 ME230-128 7. The Applicants shall maintain all fencing on the property in good repair; 8. Manure must be removed from the property according to the requirements of the Minnesota pollution control agency; 9. Any exterior lighting shall be designed and constructed so that the globe is recessed and open only on the bottom and no light is cast directly on any adjacent property or roadway; 10. There shall be no exterior loudspeakers or telephone bells; 11. The Applicant shall pay a fee to the city in the amount determined by staff to represent the actual cost to the city of reviewing this amended conditional use permit; and 12. Resolution No. 89-4 is hereby revoked. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota that the City's willingness to grant this amended conditional use permit for two accessory structures containing up to 25,000 square feet is solely due to the size of the Applicants' property (approximately 28 acres) and that the City reserves the right to review this conditional use permit upon subdivision of the Applicants' property. The right to review this conditional use permit includes the right to modify the conditions under which it is issued or to revoke it if warranted in the opinion of the City. Dated: June 21 , 1994.
