CITY OF MEDINA
RESOLUTION NO.94-42
RESOLUTION VACATING HICKORY DRIVE, ACCORDING
TO THE PLAT OF GRIER INDUSTRIAL PARK
WHEREAS, the plat of Grier Industrial Park, on file with Hennepin County,
Minnesota, contains an easement for right-of-way for Hickory Drive in the southwest
corner of said plat; and
WHEREAS, the City has on its own motion and without benefit of a petition
from a majority of abutting land owners proposed to vacate the easement; and
WHEREAS, the city council has conducted a public hearing on the vacation of
the easement, following two weeks' published and posted notice and 10 days' mailed
notice to affected property owners; and
WHEREAS, the council has determined that there exists no public need to
retain the easement and it is in the public interest that it be vacated.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota as follows:
1. The roadway easement legally described on Exhibit A attached hereto is
vacated.
2. The clerk -treasurer is hereby authorized and directed to prepare a notice of
completion of these proceedings and present same to the Hennepin County
auditor in compliance with Minnesota Statutes, Section 412.851.
