HomeMy Public PortalAbout1994-045ri Member Ann Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 94-45 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO H & J PARTNERSHIP/JORDAN AUTOMOTIVE FOR AN AUTO REPAIR BUSINESS AT 3600 HICKORY DRIVE WHEREAS, H & J Partnership/Jordan Automotive ("Applicant" ) has applied for a conditional use permit to construct a 5,000 sq. ft. automotive repair center at 3600 Hickory Drive; and WHEREAS, the Applicant must obtain a conditional use permit for this use; and WHEREAS, the planning commission reviewed this matter at its meeting on June 14, 1994 and the city council reviewed the application on July 5, 1994; and WHEREAS, it has been determined that the proposed use will not adversely affect the development of adjacent property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the above purpose, subject to the following terms and conditions : 1. Exterior storage on the site shall be limited to not more than five vehicles parked outside the building during non -business hours; 2. The exterior of the building shall be constructed to meet city code requirements; 3. Any signs erected on the site must comply with city code requirements; 4. Any roof top or outside mechanical equipment shall be screened from view from adjacent properties and right-of-ways; 5. Exterior trash containers shall be screen with an opaque material architecturally compatible with the building; 6. The Applicant shall install and maintain the landscaping specified on the plan approved by city staff; 7. The Applicant shall install at least 18 parking stalls on the property; RR373044 ME230-208 8. Concrete curb and gutters shall be required around the parking area; 9. It is acknowledged that the site plan meets the hard surface coverage requirements of the city's ordinance; 10. The hours of operation shall be limited to 6 a.m. to 10 p.m. daily; 11. The number of employees shall not exceed 6; 12. Any exterior lighting must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property or right-of-way; 13. Site drainage and utility easements shall be required as specified by the city engineer; 14. There shall be no outside bells or loud speakers; 15. The plans for the building are subject to review by the fire department; 16. The existing water main shall be extended to provide a fire hydrant in accordance with the requirements of the city engineer; 17. The Applicant shall dedicate an easement for roadway purposes for the extension of Tower Drive in a location required by the city engineer; 18. The Applicant shall properly dispose of hazardous waste materials in accordance with the Hennepin County Environmental Management Code; 19. Hennepin Conservation District requirements shall be met; 20. The Applicant shall submit cash, a letter of credit or similar financial guarantee in the amount of $70,650 to the city in order to insure completion of required site improvements; 21. The Applicant shall extend an eight inch water sanitary sewer line from the manhole on Hickory Drive to the property line if required by the city engineer; and 22. The Applicant shall pay a fee to the city in an amount determined by staff to represent the actual cost to the city of reviewing this conditional use permit application. Dated: July 19 , 1994.
