I��J4o AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A PRELIMINARY PUD PLAN FOR PROPERTY ADDRESSED AS 2131 EAST McCARTY STREET; DESCRIBED AS PART OF THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 16, TOWNSHIP 44 NORTH, RANGE 11 WEST, JEFFERSON CITY, COLE COUNTY, MISSOURI. WHEREAS, Midwest Block and Brick Inc, are owners of the real estate hereinafter described, being located in Jefferson City, Cole County, Missouri, and more particularly described as follows: Part of the Northeast Quarter of the Southeast Quarter of Section 16, Township 44 North, Range 11, West, City of Jefferson, Cole County, Missouri, being more particularly described as follows: From the northeast corner of the Southeast Quarter of said Section 16; thence S401 1'32"E, along the Section Line, 1247.34 feet to the northerly right-of-way line of EAST McCARTY STREET; thence N71°27'56"W along the northerly right-of-way line of EAST McCARTY STREET, 386.41 feet to the southeasterly corner of the tract described in Book 565, page 27, Cole County Recorder's Office, thereof, also being the southwesterly corner of the tract described in Book 181, page 183, Cole County Recorder's Office, and the POINT OF BEGINNING for this description; thence along the boundary of said tract described in Book 565, page 27 the following courses: N71°27'56"W, 491.11 feet, thence N4 021'18"W, 476.18 feet; thence N83°25'39"E, 230.00 feet; thence N86°01'11"E, 109.74 feet; thence N86 007'44"E, 112.45 feet to the northeasterly corner of said tract described in Book 565, page 27, also being the northwesterly corner of the tract described in Book 181, page 183; thence S4 023'29"E along the easterly line of said tract described in Book 565, page 27, also being the westerly line of said tract described in Book 181, page 183, 674.43 feet to the point of beginning. Containing 6.00 acres. WHEREAS, it appears that the procedures set forth in the zoning code relating to zoning have in all matters been complied with, as said property owners submitted to the Planning and Zoning Commission and City Council a Preliminary PUD Plan for the above referenced property. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Preliminary PUD Plan and Narrative submitted by Central Missouri Professional Services, Consultant, on file as Case No. P09005 in the Jefferson City Planning Division and attached hereto as "Exhibit 1" is hereby approved for the above land referenced herein with the following conditions: 1. The Final PUD Plan shall address the following items: Initially, Umless speeified otherwise, improvements shall be completed within S 12 months of approval of the PUD Plan. A. Allowed land uses for the property shall be limited to indoor storage, and indoor manufacturing of pre-cast concrete products with outdoor operations and storage. B. All Outdoor lighting shall conform to the requirements of the C-2 General Commercial zoning district as outlined within the Jefferson City Zoning Code. 1 SUBSTITUTE C. Signage shall be governed by the Advertising and Sign Code as it exists, or may be amended. D. Employee and customer parking lots shall meet the parking lot landscaping requirements of the Jefferson City Zoning Code. E. Employee and customer parking lots shall be paved within 6 months. F. Driveways, including those serving outdoor storage areas, shall be paved within -7 2 years. G. Paving of access driveways and construction of sidewalk along East McCarty Street shall be coordinated with the Department of Community Development and completed as soon as practical (as determined by the Director of Community Development) in terms of design plans for the future reconstruction / expansion of East McCarty Street. Driveway entrances to the site shall be paved within 2 years. H. Truck parking areas and outdoor storage areas may be established with an aggregate surface. I. Compliance with the performance standards of industrial uses as outlined within the Jefferson City Zoning Code (Section 35-41.8.28). appl --to--th" . K. Off site improvements associated with the existing Midwest Block and Brick operation located at 2203 East McCarty Street shall be completed within S 12 months and shall consist of a 25 foot wide type C bufferyard along the east property line and a 6 foot tall wall to screen the view (from McCarty Street and the adjacent property) of the storage area at the southeast corner of the property. Section 2. No common areas are proposed and no lands are dedicated to public use with this PUD Plan. Section 3. The Council adopts the revised PUD plan of May 15th, 2009 for the property identified thereon as "Coy's Property' only as submitted by the applicant. Section 4.
