HomeMy Public PortalAbout1994-055Member Ann Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.94-55 RESOLUTION GRANTING AN AMENDED CONDITIONAL USE PERMIT TO ADAM'S PEST CONTROL, INC. WHEREAS, Adam's Pest Control, Inc. ("Applicant") received an amended conditional use permit on November 16, 1993 pursuant to Resolution No. 93-86 to construct an addition to the business on the property located at 872 T.H. 55; and WHEREAS, the Applicant has proposed an another amendment to the conditional use permit to allow construction of an enclosed hallway; and WHEREAS, the planning commission reviewed the proposed amendment at its meeting of July 12, 1994 and concluded that the addition to the existing structure would not interfere with the normal and orderly development of adjacent property; and WHEREAS, the city council reviewed the matter at its meeting of August 2, 1994 and reached a similar conclusion. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that an amended conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. Fire department data sheets must be maintained by the Applicant on site; 2. There may be no outside storage on the property; 3. Any exterior lighting added after November 16, 1993 shall be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property or right-of-way; 4. The enclosed hallway shall be constructed according to the plans submitted to and approved by the city building official; RHB74450 ME230-198 5. The Applicant shall pay to the city a fee in the amount determined by the city staff to represent the city's actual cost in reviewing this amended conditional use permit application; and 6. Resolution No. 93-86 granting the first amended conditional use permit is hereby rescinded. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota that nothing in this resolution shall be construed to authorize the operation of a motel or similar business on the property and that the Applicant shall refrain from engaging in such business activity.
