HomeMy Public PortalAbout1994-056Member Ann Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.94-56 RESOLUTION GRANTING A VARIANCE TO CHARLES NOLAN AND ELIZABETH NOLAN WHEREAS, Charles Nolan and Elizabeth Nolan ("Applicants") have requested permission to construct a single family house on the property located at 2935 Willowood Farm Road, which is legally described as Lot 3, Block 1, Willowood Farm, with a mound septic system located 60 feet from the wetlands; and WHEREAS, the city's individual septic system ordinance, sections 720.01 etof the Code of Ordinances, requires a setback in such instances of 150 feet; and WHEREAS, Section 721.03 of the City Code of Ordinances requires that variances from the strict interpretation of the ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the Planning Commission considered the Applicants' request at their meeting of July 12, 1994 and recommended approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicants regarding this application. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for the above variance be granted, subject to the following conditions: 1. The house and septic system must be constructed in strict conformance with the plans, specifications and drawings submitted by the Applicants and approved by the City; RHB74452 ME230-8 2. The alternate septic site must be staked and undisturbed prior to and during construction of the house; and 3. The Applicants must pay to the City an administrative fee in the amount necessary to reimburse the City for its actual expenses associated with reviewing this variance request. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina that the variance hereby granted is justified by the change in wetland laws and regulations since the platting of the lot, the topography of the lot and the soil conditions present on the property.
