HomeMy Public PortalAbout14-8738 SEVERANCE PAY FOR ASSISTANT CITY MANAGER DAVID CHIVERTON Sponsored by: City Manager RESOLUTION NO. 14-8738 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, TO PROVIDE FOR SEVERANCE PAY FOR ASSISTANT CITY MANAGER DAVID CHIVERTON, IN THE EVENT OF TERMINATION; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, it is the desire of the City Commission of the City of Opa-locka to afford reasonable severance to Assistant City Manager David Chiverton,in recognition of his service to the City of Opa-locka, in the event he shall be terminated as Assistant City Manager; and WHEREAS the City Commission recognizes that the position of Assistant City Manager is an executive position,and accordingly reasonable severance to a departing Assistant City Manager is appropriate. NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. In the event that David Chiverton is terminated as Assistant City Manager of the City of Opa-locka,while still employed in that position,the City Commission agrees that he shall be entitled, in addition to any unused sick and personal time he may have accrued(per City policy), to a severance equal to his salary and benefits which would accrue if he continued to be employed in said position, for a period of three (3) months (if terminated without cause) or for a period of one month(if terminated with cause, such as conviction of a crime,malfeasance or misfeasance). Said severance is to be paid,50%within one week of termination,and the remaining 50%within 30 days Resolution No. 14-8738 of termination. Section 3. This resolution shall take effect immediately upon adoption. PASSED AND ADOPTED THIS 8th day of January, 2014.
