HomeMy Public PortalAbout14-8744 APPROVE DESIGNATING AS A FILM FRIENDLY ENVIRONMENT Sponsored by: Commissioner Santiago RESOLUTION NO. 14-8744 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, TO APPROVE DESIGNATING THE CITY OF OPA-LOCKA AS A FILM FRIENDLY ENVIRONMENT, WITH THE CITY COMMISSION HAVING THE AUTHORITY TO APPROVE FILM PERMIT REQUESTS AND THE FILMING POLICY FOR THE CITY OF OPA-LOCKA; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Commission of the City of Opa-locka("City")desires to promote the City in a positive manner, and desires to attract positive film, television and photography opportunities from commercial companies; and WHEREAS, to create a"film friendly"environment for film, commercial television and still photography companies ("film industry"), the City intent is to depict the historic Opa-locka structures and City-owned property in a positive light; and WHEREAS,the City has developed a Policy statement for the film industry, to ensure no unnecessary disturbance to the residents and business community; and WHEREAS,welcoming the commercial media industry to"film friendly"Opa-locka would enhance businesses throughout the City, create jobs, and increase the City's revenue; and WHEREAS,the City Commission of the City of Opa-locka approves designating the City as a"Film Friendly"environment with the City Commission having authority to approve or deny film permit requests and the filming policy for the City. NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Resolution No. 14-8744 Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka hereby approves designating the City of Opa-locka as a "Film Friendly" environment, with the City Commission having the authority to approve or deny film permit requests, and the filming policy for the City of Opa-locka. Section 3. This resolution shall take effect immediately upon adoption. This resolution also acknowledges the City of Opa-locka as a municipality that desires to attract positive film, television and photography opportunities from commercial production companies. The City recognizes the benefit of attracting positive publicity has on area businesses, residents and the City's image. The City of Opa-locka desires to create a "film friendly" environment for commercial film, television and still photography companies to increase shoots within the City. It's the intent of City officials to depict Historic Opa-locka structures and city-owned property in positive publicity efforts, including for the use in commercial film, television and still photography. Therefore, the City of Opa-locka can approve or reject a film permit based upon the type of television show, film or still photography underlying theme and elements within the script. Financial Impact: Revenue for labor for using off-duty police officers, filming on city property and other services rendered can be added to the general fund. Plus, there are indirect benefits of these production companies purchasing materials locally, using labor from city residents, and eating at local restaurants, thereby allowing the city to benefit from the sales tax revenue we collect. Ui p City of Opa-locka Filming Policy PLEASE READ THE REQUIREMENTS BELOW The City of Opa-locka welcomes inquiries from responsible producers and location managers in the film and television industries. We have in Opa-locka a myriad of location possibilities, including the beautiful historic City Hall with its Moorish architecture. To ensure that the filming of movies,television programs, commercials and special events does not unnecessarily disturb the residents or businesses in this community,the City of Opa-locka has adopted a Policy Statement containing the rules and procedures all film companies must follow. The City reserves the right to revoke filming privileges if these policies are violated. OPA-LOCKA RULES AND PROCEDURES 1. The City of Opa-locka desires to create a"film friendly"environment for commercial film,television and still photography companies to increase shoots within the City. It's the intent of City officials to depict Historic Opa-locka structures and city-owned property in positive publicity efforts, including for the use in commercial film,television and still photography. Therefore,the City of Opa-locka can reject a film permit based upon the type of television show,film or still photography underlying theme and elements within the script. 2. Opa-locka City Commission must approve the filming permit.Because the City's approval process can be time consuming, film companies must contact the City Manager's Office at least 30 business days in advance of the shooting date. Upon Commission review and approval applicants will then be able to obtain a permit issued through the City Manager's Office. 3. The business license application and filming permit form must be completely and accurately filled out. Any omissions may result in delays and perhaps in additional expense.Any changes to the location,time or the character of scenes described in the permit application must be provided to the appropriate City departments(generally City Manager's Office, Community Development and Police)at least two weeks in advance. Failure to advise the City of such material changes may result in the revocation of the permit. 4. All film companies must obtain and maintain an insurance policy having a minimum coverage at all times of$1 million General Liability and $1 million for property coverage. Said insurance policies shall name the City of Opa-locka and their officers, employees, elected officials and members of boards or commissions as additional insured. Said insurance shall apply as primary insurance and no other insurance maintained by the additional insured will be called upon to contribute with insurance provided by this policy. The policy must state, "will give the City of Opa-locka 30 days advance written notice of any changes in coverage or cancellation."The Opa-locka Risk Management contact must approve any exceptions to the above requirements. 5. The Film Company must reimburse any and all costs incurred by the City. Typical costs may include personnel services rendered by the Police,Fire,Harbor and Public Works Maintenance Departments. In most cases,such costs are estimated prior to the shoot and are due and payable prior to issuance of the filming permit, in addition to the daily business license fee. Failure to reimburse the City within 30 days of the receipt of the invoice for additional expenses may result in the denial of future filming rights. 6. All Federal, State, County and local laws and ordinances must be obeyed by the cast and crew of the Film Company and by any independent contractor(s)retained by the Film Company.The film company shall be responsible for the business license fee,plus penalties, if any service providers(e.g. catering service, auxiliary power providers,vehicle rental services)fail to obtain a Opa-locka Business License. 7. A Notice of Intent To Film must be completed and delivered to all affected residents and businesses within a 200 foot radius of every filming site not less than 72 hours prior to the arrival of the production company equipment.At the discretion of the City,the notice requirement can be reduced to 24 hours for small,one day shoots(e.g. commercial advertising.)The notice must contain the name of the Production Company and the production manager's and/or location manager's phone number. Proof of the noticing must be submitted to the City Manager's Office prior to receiving approval to shoot.For multiple unit dwellings or office buildings,proof of notification to the apartment/condominium or building manager shall be deemed sufficient. 8. Pedestrian and vehicular access to homes and businesses may not be blocked without the prior written consent of the parties being impacted.Proof of the consent must be submitted to the City Manager's Office prior to receiving approval to shoot. In addition,a parking plan must be submitted to the City with information on where and how many vehicles and what type will be required to park, including optional shuttle plans as needed.Excessively large or numerous vehicles must be approved prior to the permit application being approved. 9. The permittee may not interfere with street sweeping,refuse collection or other City activity that may be taking place in or around the filming site. Within reason,the City will attempt to accommodate the sound and access needs of the Production Company. 10. Special permission,which the City reserves the right to withhold,is required for: A.Evening shooting(outside of 8 a.m.to 9 p.m.,Monday-Saturday,9 a.m.to 8 p.m. Sunday.)Filming in residential locations can be extended with signatures of approval from residents within a 200 foot radius of all affected film sites as follows: 51%of said residents to extend by one hour;90%of said residents to extend to 6 a.m. and/or midnight; 100%of said residents to extend before 6 a.m. or after midnight. B.Excessive noise due to volume,duration or kind(e.g.explosions,gunfire), including that from generators. C.Pyrotechnics, flames,explosions,crashes and other similar"on location" special effects. D. Filming on any City owned property. In general the City Manager,Police,and Community Development Departments(as appropriate) must be contacted for permission and/or review if any of these elements are included within the script. 11. All production vehicles and vehicles of the cast and/or crewmembers shall be visibly identified with the name of the production company. Such identification shall be placed on the windshield or dashboard of all vehicles while on location. 12. Film companies will be required to restore all property to its original condition and to remove all litter generated during the course of shooting prior to leaving all film locations each day. 13. At the discretion of the City, a plot plan of the filming location(interior and exterior)and a synopsis of the film script may be required. 14. The City reserves the right to revoke filming privileges if circumstance arise during the course of shooting which are, in the City's opinion, deleterious to the rights of its residents or businesses or is in any way too dangerous. 15. The Police Department will suspend any filming operation not authorized by permit or when permit conditions are violated. Filming will also be suspended if any laws or ordinance are violated. 16. For purposes of contact during filming,rehearsal, stage set-up or strike,the filming company must provide the City with the name of an on filming site company representative who can be immediately available for contact, in person or via cellular phone,telephone or pager,when filming and related activities are taking place in the City. 17. The City of Opa-locka is required to be included in production credits for filming on City property. The City of Opa-locka is requested to be included in production credits when filming takes place on private property, commercial or residential. B-Roll Filming 18. Permits are usually not required for general B-Roll filming in Opa-locka. 19. A Film Permit is not required as long as the following criteria are met: •You have 5 or less people •You are not obstructing the sidewalk •You are not obstructing a lane of traffic Should your production overstep these guidelines,you may be cited by the Police. 20. Productions need to ensure that they have the proper permission from a property owner prior to entering upon their property to capture B-Roll. As a general rule in Downtown Opa-locka, the property is private from the edge of the building(or overhang)to the sidewalk. The portion from sidewalk to curb/street is City owned property. Filming on Sidewalks 21. City of Opa-locka off duty personnel WILL BE required if the filming impedes or disrupts foot traffic. 22. Please check with the City Manager's Office regarding your exact location. Locations, dates and times will have an impact of the determination of the need for off duty personnel. 23. A mandatory inspection of the filming location will be conducted by Opa-locka's City Manager's Office and/or designee affected by the filming to ensure Scope of Work is followed. A violation will require the Motion Picture Coordinator for the affected department to assign an off duty personnel in order for filming to continue.Rate for the last minute request will be double the going rate of pay for the off duty personnel and will begin upon the notification of the production company. Streets 24. All street closure requests are subject to Police approval. All street barricading and signage placement must be done by a licensed barricade company and set up according to the city of Opa- locka approval.The City's Police Department may limit filming during rush hour traffic that impacts major thoroughfares. Use if City Vehicles as Picture Cars 25. Only City of Opa-locka employees may operate city vehicles used as picture cars.All vehicles may not indicate the City of Opa-locka,or any derivation thereof,and must be covered at the filming location(removal may not occur in post). Rate Information The City of Opa-locka will charge fees for services rendered.
