HomeMy Public PortalAbout1994-068Member James Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 94-68 RESOLUTION GRANTING CONDITIONAL USE PERMIT REGARDING ACCESSORY STRUCTURES TO CHERYL B AZINET WHEREAS, Cheryl Bazinet (Applicant) has requested permission to increase the number or the size of accessory structures on the property located at 3003 Hamel Road by constructing a third accessory structure or by expanding an existing accessory structure so that the combined size of the accessory structures exceeds 3000 square feet; and WHEREAS, the city's zoning ordinance requires a conditional use permit in order to have more than two accessory structures or when the cumulative area of the accessory structure exceeds 3,000 square feet; and WHEREAS, this matter has been reviewed by the planning commission at its meeting of September 14, 1994 and by the city council at its meeting of October 4, 1994; and WHEREAS, it has been determined that the proposed new or expanded accessory structures on the property will not impede the normal and orderly development of adjacent lands for purposes for which they are zoned. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following conditions: 1. The total area in accessory structures on the property shall not exceed 5,350 square feet whether in two accessory structures or in three accessory structures; and RHB77246 ME230-213 2. The new or expanded accessory structure shall be for personal use for the Applicant's animals and shall not be used by the Applicant in connection with any commercial activity on the property; 3. No animals shall be allowed in the machine shed; 4. The exterior of the accessory buildings must be compatible with the existing buildings on the property; 5. Manure must be removed from the site in accordance with the regulations of the city and of the Minnesota pollution control agency; and 6. The Applicant agrees to pay the city an administrative fee in the amount determined by the staff to represent the actual cost to the city of reviewing this application. Dated: October 18 , 1994.
