HomeMy Public PortalAbout1994-069Member James Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.94-69 RESOLUTION GRANTING CONDITIONAL USE PERMIT FOR A PRIVATE RESIDENTIAL DOG KENNEL FOR ADDISON AND CYNTHIA PIPER WHEREAS, Addison Piper and Cynthia Piper (Applicants) have requested permission to construct a private residential dog kennel at the property located at 2505 Willow Drive; WHEREAS, a conditional use permit is required for such purposes; and WHEREAS, this matter has been reviewed by the planning commission at its meeting on September 14, 1994 and by the city council at its meeting on October 4, 1994; and WHEREAS, it has been determined that the proposed private residential dog kennel will not interfere with the development of adjacent property for purposes for which it is zoned. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicants for the stated purpose, subject to the following conditions; 1. It is acknowledged that the kennel is for the personal and private use of the Applicants and may not be used for breeding dogs or any other commercial activity related to dogs; 2. The maximum number of dogs permitted on the property is six; 3. All waste material must be disposed of in accordance with the ordinances of the city and the regulations of the Minnesota pollution control agency; 4. The Applicants must take immediate and appropriate action to abate any nuisance caused by barking dogs on the property; 5. The Applicants must maintain the property in a manner consistent with the site plan approved by the city; RHB77242 ME230-212 6. The Applicants must maintain all dogs in conditions consistent with the standards of the Hennepin County Animal Humane Society; 7. The city reserves the right to conduct an annual review of the property to ensure continued compliance with the terms and conditions of this permit; 8. The city reserves the right to modify or amend the terms and conditions of this permit as development occurs on adjacent properties if necessary to prevent the occurrence of a nuisance; 9. The Applicants agree to reimburse the city for all costs, including legal expenses, involved in any effort necessary to enforce the terms of this conditional use permit or any ordinance related thereto; and 10. The Applicants shall pay to the city an administrative fee in the amount determined by the staff to represent the actual cost to the city of reviewing this application. Dated: October 18 , 1994.
