I discussed the a -mail below with Joe Pike and see no reason not to proceed with the procurement of the SFWMD and other agency approvals after Conditional Plat Approval and prior to Final Plat Approval by the Town. The Town would be protected seeing that the owner of the property would not be able to subdivide and sell the lots without the final plat approval. Once Final Plat approval is issued then the owner would be in a position to sell lots, but it would be after all other agency approvals are secured. I reviewed the drainage plans for this subdivision and it is quite a bit more straight forward in regards to engineering design and permitting than the Hidden Harbor Plat was and the approvals were handled in the same method. At this time I have not seen the preliminary plat and will need to perform a more thorough review of the engineering/drainage plans when they are available. I left you a voicemail yesterday but figured that I would follow up via email to provide a little more detail on my request. I have spoken with Bill Thrasher and Marty Minor about this issue and Marty suggested that I get your opinion. Mr. Thrasher is asking to see some sort of preliminary approval from SFWMD prior to being scheduled for the preliminary plat approval with the Architectural Review Board and the Commission. I had suggested that we handle it the same way the plat approval was done on the previous project in that the Plat approval be conditioned on supplying SFWMD (and all other appropriate agency approvals) prior to the Town actually RECORDING the plat. This way, we the applicant does not need to proceed to final engineering design to obtain such an approval before we know if the lot configuration, access and other issues are satisfactory to the Town. Should the plat configuration change based on Architectural Review or Commission input, then that permitting effort would be wasted. Bill and Rita reminded me that we provided a No -Notice letter from SFWMD the last time around, but that was when we thought we were not going to go through and obtain a full ERP permit from Water Management. Moreover, the District is now implementing a new "10-2" Self -Certification process so the No -Notice process is being phased out. The bottom line is that we intend to obtain a full ERP Permit for this project also, even though I believe it will qualify for the 10-2 self certification process. This step is being offered to the Town and the neighbors as an extra level of comfort that we are not trying to take any short cuts and will not degrade the existing drainage of the neighborhood once this project is developed. However, since the Town has no site plan approval process in place, the Platting process is the de facto site plan approval, so we feel the appropriate time to offer SFWMD and other agency approvals is AFTER Conditional Plat approval and PRIOR to plat recordation. If, for some unforeseen reason, the appropriate approvals cannot be obtained, then that is the risk of the Applicant - not the Town. It would just mean that the Town would never record the Plat and the subdivision would never be perfected. Please let me know your thoughts and opinion on this matter, as we are unable to schedule our Plat application with ARPB or the Commission until we arrive at a consensus.
