AUTHORlZlt'IG PROFESSIONAL SERVICES FOR SPECIAL MATTERS
PURSUAi'IT TO THE BOROUGH'S FAIR Ai'iD OPEN PROCUREi\IENT
PROCESS/MciHANThION & SCOTLAND, LLC
WHEREAS, the Borough ofCarterd ("Borough"), is in need of specialized legal
services; and
WHEREAS, the Borough has solicited and received proposals for said professional
services for2010 pursuant to the New Jersey Statute Fair and Open Process; and
WHEREAS, McManimon & Scotland, L.L.e. has exceeded the qualifications for
providing said services and has been placed upon the list of approved professionals to
provide said services; and
'WHERE"AS, the Law Director of the Borough o{Carteret has approved the provision of
the below services; and
WHEREAS, the.ChiefFinanclal Officer has certified that funds are or will be
available for said purpose.
1. Green Acres Waterfront Open
Space Acquisition
S 4,000.00 (reimbursable open
space funding)
2. Hazardous Materials Response
Funding Litigation/Agreement
S 9,500.00 (resulting in
approximately 5335,000.00
in annual industrial
supplemental hazmat
response funding to the
Borough for 10 years)

NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the
Borough ofCarteret, County of Middlesex, Stale of New Jersey, as follows:,
1. The proposal from McMailimon & Scotland,. L.L.C. for specialized
legal services and amounts listed above is hereby approved.
2. This action is approved as an award ofa professional services contract
pursuant to N.J.S.A 40A:U-5(1)(a) awarded pursuant to the
Borough's Fair and Open process as authorized by law.
3. A copy of this Resolution be fonvarded to the Borough's Purchasing
Department for payment pursuant hereto and McManimon &
Scotland,. L.L.C,
Adopted this 6th day of May, 2010
and certified as a true copy of the
original on May 7, 2010.
