AN ORDER RELATIVE TO A PRIVATE WAY EASEMENT AGREEMENT (66 GALEN
STREET), A HIGHWAY EASEMENT AGREEMENT (66 GALEN STREET), A
HIGHWAY EASEMENT AGREEMENT (51-57 WATER STREET) AND A PUBLIC
PARKS EASEMENT (66 GALEN STREET) TO BE CONVEYED TO THE CITY OF
WATERTOWN AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE
EASEMENTS ON BEHALF OF THE CITY
WHEREAS, Galen Street Owner, LLC is developing property located at 66 Galen
Street, Watertown, and, in connection with certain zoning approvals granted by the
Zoning Board of Appeals in Case Number ZBA 2020-22-SP/SR, the developer or its
affiliate agreed as follows:
A. To support the City's multimodal transportation goals by allowing vehicular
(including MBTA buses) and pedestrian access and the placement of utilities
within a private right of way, to be known as Technology Way, located
between Water Street and Galen Street, as set forth in a Grant of
Easement (Private Way Easement Agreement) (66 Galen Street,
Watertown, MA); and
B. To grant a highway easement for the purposes of the operation,
maintenance, repair and replacement of sidewalks, crosswalks, ramps,
streetlights, landscaping, bus shelters, inspector booths, street signs, traffic
control lights and signs and fire hydrants and related facilities, as set forth in
a Grant of Easement (Highway Easement Agreement) (66 Galen Street,
Watertown, MA); and
To grant a highway easement for the purposes of the operation,
maintenance, repair and replacement of sidewalks, crosswalks, ramps,
streetlights, landscaping, bus shelters, inspector booths, street signs, traffic
control lights and signs and fire hydrants and related facilities, as set forth in
a Grant of Easement (Highway Easement Agreement) (51-57 Water
Street, Watertown, MA); and
D. To grant a public parks easement for all purposes for which public parks are
lawfully used in the City of Watertown, including, without limitation, public
rest, recreation, enjoyment and assembly, as set forth in a Grant of
Easement (Public Parks Easement) (66 Galen Street, Watertown, MA).
NOW THEREFORE BE IT ORDERED: That the City Council agrees, in connection
with the development of 66 Galen Street by Galen Street Owner, LLC to accept
easements as set forth in the aforesaid documents.
AND FURTHER, that the City Council hereby authorizes the City Manager to accept
and execute the aforesaid easements on behalf of the City.
