CALL TO ORDER: Mayor ProTem Dennis called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, July 6, 1982, in the Council Chamber of the City Hall. 2. The invocation was given by Pastor Paul Kopp, First. Baptist Church, 6019 N. Baldwin Avenue. 3. The Pledge of Allegiance to the Flag was, led by Mayor ProTem Dennis. 4. ROLL CALL: Present: Councilmen- Atkins, Dennis, Gillanders, Swain Absent: Councilmen - Tyrell Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Kimbrough, Planning Director Shaw, Parks and Recreation Director Kobett, and Julie Estrada, Temple City Times Councilman Atkins moved to excuse Mayor Tyrell for cause, seconded by Councilman Gillanders and carried. At this time, Mayor ProTem Dennis presented a Certificate of Recognition to Mrs. Madeline Jacobs, stating that Mrs. Jacobs has assisted the Animal Control Officer on numerous occasions and also has contributed funds annually for the past few years to purchase small animal control devices. On accepting her Certificate, Mrs. Jacobs expressed her appreciation for the fine work of the animal control officer, Bill Hart. 5. CONSENT CALENDAR: At the request of a gentleman in the audience, I tem B(1) was removed from the Consent Calendar. On motion by Councilman Atkins, seconded by Councilman Swain, Items A and B(2) through M on the Consent Calendar were approved as recommended. A. APPROVAL OF MINUTES - Regular Meeting of June 15, 1982 Approved as written. B. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of June 22, 1982 (2) INITIATE A MORATORIUM ON NEW CONSTRUCTION WITHIN THE C -1 ZONE Adopted urgency Ordinance No. 82 -520 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY. OF TEMPLE CITY ENACTING AN INTERIM ZONING ORDINANCE PURSUANT TO THE PROVISIONS OF SECTION 65858 OF THE CALIFORNIA GOVERNMENT CODE IMPOSING A MORATORIUM ON NEW CONSTRUCTION AND ON BUILDING PERMITS FOR DEVELOPMENTS WITHIN THE' C-1 ZONE PENDING PLANNING COMMISSION STUDIES WITH RESPECT THERETO. (3) PLANNING COMMISSION ACTION Received and filed a memo from the Planning Commission relating to action taken at their regular meeting held June 22, 1982. C. RELEASE OF CLAIM - CITY. HALL FLOOD DAMAGE Authorized City Manager to sign release and endorse Liberty Mutual Insurance Company check which was co- payable to the City and Commercial Union Insurance Company, which action finalizes the claim for damages as a result of water damage which occurred in October, 1981. Council Minutes, July 6, 1982 - Page 2 D. RENEWAL OF AGREEMENTS: (1) CHAMBER OF COMMERCE Approved renewal for a one year period from July 1, 1982 through June 30, 1983. (2) PUBLIC RELATIONS COORDINATOR Approved renewal for a one year period from July 1, 1982 through June 30, 1983. (3) AUDITING SERVICES Approved auditing services for fiscal year 1982 -83 and authorized City Manager to countersign letter of agreement. E. PROPOSED USE OF CDBG FUNDS FOR IMPROVEMENTS ASSOCIATED WITH THE MYDA CUL -DE -SAC Authorized the City Manager to file a revised application which incorporates the Myda cul -de -sac project (Edwards Theatre Project) F. RELEASE OF FALCON TV SECURITY FUND Approved release of Certificate of Deposit in the amount of $500,000. and authorized City Manager to sign release. G. REVISION OF CABLE TV PAY SERVICE CHARGES Approved a revised pay service charge being marketed in the City as outlined in their letter dated June 28, 1982. H. REQUEST AUTHORIZATION TO PREPARE SPECIFICATIONS FOR CONVERSION OF CITY -OWNED STREET LIGHTS Authorized staff to prepare specifications and solicit bids for the conversion of city -owned street lights. I. ELIGIBILITY FOR FEDERAL SURPLUS PERSONAL PROPERTY PROGRAM Adopted Resolution No. 82 -2088 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DESIGNATING AUTHORIZED REPRESENTATIVES TO ACQUIRE FEDERAL SURPLUS PROPERTY. J. RESOLUTION NO. 82 -2089: AUTHORIZING COUNTY TO COLLECT SPECIAL ASSESSMENTS FOR CITY -WIDE LIGHTING DISTRICT Adopted Resolution No. 82 -2089 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING THE ADDITION OF SPECIAL ASSESS- MENTS TO THE TAX BILLS. K. RESOLUTION NO. 82 -2090: SB 821 - PEDESTRIAN FACILITIES FY 1982 -83 Adopted Resolution No. 82 -2090 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING THE APPLICATION FOR PEDESTRIAN FUNDS AUTHORIZED UNDER SB 821 AND APPROVING THE ADOPTION OF ITS SIDEWALK IMPROVEMENT PROGRAM. L. RESOLUTION NO. 82 -2091: EMPLOYMENT OF PERSONNEL Adopted Resolution No. 82 -2091 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL. M. RESOLUTION NO. 82 -2092: WARRANTS AND DEMANDS Adopted Resolution No. 82 -2092 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $334,349.19, DEMAND NOS. 4140 THRU 4279. 1 1 Council Minutes, July 6, 1982 - Page 3 CONSENT CALENDAR ITEM B(1) WATER SYSTEM ADEQUACY STUDY Edwin Jenkins, 9714 Callita Avenue, Arcadia, asked whether Council would read the Study done by Planning staff and reviewed by the Planning Commission with recommendations to the City Council. Mayor ProTem Dennis directed attention to the length of the study and read the Planning Commission recommendations that: 1) the City Council make an official request to East Pasadena Water Company to rectify the problems noted in the Study; 2) that if there is no resolution of the problems noted in the study, a complaint be filed with the PUC; 3) that the City Attorney be directed to review potential legal recourses available to the City in resolving the problems identified in the Study; and 4) pursue the concerns identi- fied in the Study on behalf of the people affected before the PUC. Mr. Jenkins requested a copy of the Study and was told he could obtain one from the Planning Department. Councilman Atkins moved to approve all recommendations of the Planning Commission as set forth in memo dated June 23, 1982 and on file in the City Clerk's office, seconded by Councilman Swain and carried. 6. UNFINISHED BUSINESS: A. PUBLIC HEARING: PROPOSED AMENDMENT TO ZONING CODE RELATING TO COMMERCIAL RECREATIONAL USES FROM C -2 TO C.U.P. City Manager Koski presented background information stating the Planning Commission, at their regular meeting held June 8, 1982, held a public hearing and recommended to City Council an amendment to the Zoning Code to permit bowling alleys, billiard parlors, movie theatres, skill game arcades and other similar commercial recreational uses only with a conditional use permit. The uses are presently listed in Section 9380 as a permitted use in the C -2 zone, however the proposed amendment will clarify the City's policy relative to businesses in- volving large assemblages of people requiring that at all times they have a conditional use permit. A Negative Declaration has been filed pursuant to the California Environmental Quality Act of 1970. Mayor ProTem Dennis declared the public hearing open and invited anyone wishing to speak to come forward. There being no one come forward to speak, Councilman Atkins moved to close public hearing, seconded by Councilman Gillanders and carried. Councilman Atkins moved to Certify the Negative Declaration of Environetnental Impact, seconded by Councilman Swain and carried. City Attorney Martin presented Ordinance No. 82 -521 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 9380(A) AND 9202 OF THE TEMPLE CITY ZONING CODE for first reading by title only. Councilman Atkins moved to waive further reading, seconded by Councilman Swain and carried. 7. NEW BUSINESS: None. I 8. COMMUNICATIONS: None. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward. RECESS TO CRA: At this time Council recessed to meet as the Community Redevelopment Agency, Chairman Tyrell.being absent; approved the minutes of the regular meeting held June 15, 1982, approved agreement for auditing services, and approved request from Burger King to construct a flagpole. The minutes are set forth in full in the records of the Agency. Council Minutes, July 6, 1982 - Page 4 RECONVENE AS CITY COUNCIL: 10. ACTION ON REQUEST BY CRA: There was no action to be taken. 11. MATTERS FROM CITY OFFICIALS: A. City Manager's Vacation Request On motion by Councilman Atkins, seconded by Councilman Swain, City Manager's request for vacation was approved.. B. City Manager Koski stated that following the meeting Falcon would show some footage of the construction of the theatre develop ment and the Council meeting which is being taped. C. Councilman Swain stated she had received calls from three residents expressing their concern about illegal fireworks. Councilman Gillanders stated last year there were 16 fireworks re- lated fires and none this year and credited law enforcement's crack down on the distribution of illegal fireworks. Julie Estrada of the Temple City Times stated there was a fire on Live Oak Avenue Tuesday afternoon and illegal fireworks is suspected to be the cause of the $50,000 damage. Mayor ProTem Dennis stated there has been a decrease in the problems. In his opinion if the Council is going to consider the future use and sale of safe and sane fireworks it should be done within the next month or so in order for the organizations which rely on the sale of fireworks as their major earning project to make other plans. D. Councilman Gillanders directed attention to SB 33 which has come out of the Senate Transportation Committee which would require every vehicle to have a yearly smog inspection as well as inspection of other safety features and expressed the hope that citizens will con- tact their legislators to oppose this bill. Councilman Swain stated that Matt Jacobs, Chairman of the Chamber of Commerce Legislative Committee is in the audience this evening and that the committee had met this morning and again voted to send a letter opposing SB 33. E. Mayor ProTem Dennis stated the Council had received material from WeTip and that Council had budgeted $500 to help finance the program. Councilman Atkins moved to approve the $500 allocation for fiscal year 1982 -83 be sent at this time, seconded by Councilman Gillanders and carried. 12.
