The Department of Tourism budget was discussed. Captal projects
including the mini -park and a fund for beach renourishmwnt were
considered. Comments were made on the depletion of the Tourism
Department Reserve.
Also discussed were use of County inspectors in the building
department and revenue derived from all permits.
The council decided that a luncheon would be held to honor re-
tired councilman, John Beatty, at which time a silver tray would be
presented to him.
The meeting adjourned at 5:45 P.Y.

COUNCIL MINUTES
August 30, 1983
The Council of Bal Harbour Village met Tuesday, August 30, 1983 at
9:30 A.M. in the Village Hall.
Present: Mrs. Antiles and Messrs. Laikin, Printup Sherman and Taplin
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and Alan S. Gold, Village Attorney.
On motion of Mr. Printup, seconded by Mrs. Antiles and voted the
minutes of July 26, 1983 were approved as submitted.
Mr. Maley said the DeFreitas family, owners of a proposed restaurant
in the Bal Harbour Shops had submitted extensive references for themselves
and the persons who will help them operate the restaurant. The Village
Clerk read
Resolution No. 265
setting forth the requirements for operation of the restaurant. Mr. Maley
suggested that an addition be made to incorporate our code section referring
to soundproofing. On motion of Mr. Taplin, seconded by Mrs. Antiles and
voted the resolution was passed as amended.
The Council discussed with Mr. John Gronda, special labor counsel
for the Village, the lawsuit against Bal Harbour brought by Sidney Marcus,

a police officer terminated for sleeping on the job. Mr. Maley said a
settlement had been offered Mr. Marcus to terminate the lawsuit, who
contends that the manner in which he was fired was wrong. Mr. Marcus
wanted $25,000 which the Village refused. Mr. Gronda said he needs
some guidance on the upper limits of a settlement. As it stands,
Mr. Marcus has suggested $12,500, the PBA said they will consider sub-
mitting a $10,000 offer to Mr. Marcus. After deliberation it was moved
by Mr. Taplin, seconded by Mr. Printup and voted that Mr. Gronda negotiate
with the attorney for the PBA for a figure lower than $10,000, the final
figure to be approved by the council.
Mr. John Cherin of Arthur Anderson & Co. auditiors for the Village,
reviewed their preliminary memorandum on Village accounting procedures.
Included were suggestions for active council participation in the budget
process, segregation of duties by hiring an additional person for pur-
chasing and finance duties and two signatures on checks over $2,000.
Mr. Cherin said he believed the village could recoup the cost of a $25,000
person as 40% of the budget is in outside expenses. Mr. Taplin said he
does not believe we need a full time comptroller and suggested that
Arthur Anderson could set up a system or procedure for purchasing. Mr.
Cherin said the firm could design a system for about $2,000. Mr. Maley
suggested that Arthur Anderson make the recommendations which we can
implement using present personnel first. It was moved by Mr. Laikin,
seconded by Mrs. Antiles that the report be adopted.
Mr. Maley read the proposal of the firm of O'Leary - Shafer - Cosio &
Associates, Landscape Architects. The cost proposed is $10,000 on com-
pletion of preliminary design and cost estimates, plus $15,000 upon
completion of detailed working drawings and specifications. This is based
on an estimated $300,000 - $350,000 project. Mr. Gutenstein of the Resort
Tax Advisory Committee said they would like an overall plan for five years,
as part of the master plan to be developed, regardless of final cost.
It was moved by Mr. Taplin, seconded by Mr. Printup and voted to accept
the proposal of O'Leary - Shafer - Cosio for the design portion of the
bid for a complete master plan.
Mr. Maley reported that there are three unpaid residential street
improvement assessments. Our attorney suggests a foreclosure procedure
if the liens cannot be collected at this time. it was agreed that the
three persons should be called to see if the liens are collectible
without legal process.
Mr. Gold said that the State Constitution says public funds can
only be used for public purposes, which are defined broadly. However,
it is his opinion that a village contribution to the United Fund would
not be a lawful purpose.
Mr. Gerald Gutenstein of the Sheraton Bal Harbour reviewed their
plans for the 1984 Orange Bowl Marathon and how Bal Harbour will benefit
from the exposure. He said the Sheraton will also be headquarters for the
Orange Bowl 10K race in February. He asked for a donation of $5,000 for
the Orange Bowl Marathon. It was moved by Mr. Laikin, seconded by Mr.
Printup and voted that $5,000 be expended from the Resort Tax funds in
support of these promotions.

of the Beau Rivage hotel requested permission to use eight
during the week of September 5, 1983 for the erection of a
during a convention. On motion of Mr. Taplin, seconded
and voted the request was granted.
Mr. Maley said each resident had received a copy of the special
hurricane Bulletin put out by the village. He noted that most
people will provide for themselves during a storm, but that the village
is in the process of completing arrangements for a shelter in a church
in North Miami for Bal Harbour residents. Dade County will try to
staff the shelter.
Mr. Sherman read a letter from Representative Barry Kuten assuring
us that the village will receive funds for the beach renourishment as
soon as they are appropriated by the next session of the Legislature.
Mr. Maley announced that the first public hearing on the 1983-84
proposed budgets would take place at 5:05 P.M. this evening. The
second meeting is set for 5:05 P.M. on September 13, 1983.
Mr. Maley informed those present that the village needs recommend-
ations for an appointment to the Library Advisory Committee and asked
anyone who knows of a person who might be interested in the position to
contact him.
On motion of Mr. Taplin, seconded by Mr. Printup the meeting was
adjourned at 12:15 P.M.

BUDGET HEARING
August 30, 1983
The first Public Hearing on the proposed 1983-84 Budgets was
held Tuesday, August 30, 1983, at 5:05 P.M. in the village hall.
Present:
Mrs. Antiles and Messrs. Laikin, Printup, Sherman and
Taplin
Also present were Fred W. Maley, Village Manager, and Mary T.
Wetterer, Village Clerk.
The Council reviewed the proposed budgets. Mr. Maley explained
that the budgets reflected an 8% salary increase for police officers and
5% for the balance of the employees. Also included was a new item for $18,000
to complete storm sewer repairs in the residential district. He said he
had considered the tax levy at the same rate of 3.50 mills as last year
as suggested by council. Due to the fact the village does not have any
service charges and fear of depletion of General Fund reserves, he is
recommending the 3.65 mills. The council and those present discussed
the village's salary structure. The Mayor appointed a committee of Fred
Maley, Sol Taplin, Gerry Gutenstein, and gteve Bobby to review starting
