CALL TO ORDER CITY COUNCIL TEMPLE CITY, CALIFORNIA REGULAR MEETING May 19, 2015 AGENDA ITEM ?.A-2 Mayor Chavez called the Regular City Council meeting to order at 7:30 p.m. 2. ROLL CALL PRESENT: ABSENT: ALSO PRESENT: 3. INVOCATION Councilmember-Fish, Man, Sternquist, Yu, Chavez Councilmember-None City Manager Cook, City Attorney Vail, City Clerk Kuo, Administrative Services Director Hause, Parks and Recreation Director Burroughs, and Community Development Director Forbes Pastor Jim Walden, Temple City Baptist Church, provided the Invocation. 4. PLEDGE OF ALLEGIANCE Jim Clift, Temple City residentfTransportation and Public Safety Commissioner, led those present in the Pledge of Allegiance. 5. CEREMONIALIPRESENTATIONS-None 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Adam Hsu, Field Representative for Congresswoman Judy Chu, invited the public to attend an upcoming Scam Prevention Workshop hosted by Congresswoman Chu's office, on June 6, 10 a.m., at the Arcadia Community Center. Karen Noyes, Children's Librarian with Temple City Library, announced upcoming library activities. T.K. Washuta, a member of the public, spoke about overhead canopy at bus stops and street median landscaping along Rosemead Boulevard. He also spoke about ValuMart. APPROVAL OF MINUTES Fish, Man, Sternquist, Yu, Chavez None None The City Council is requested to review and approve: 1) Minutes of the Special City Council Meeting of May 5, 2015; 2) Minutes of the Special City Council Meeting of May 5, 2015; 3) Minutes of the Regular City Council Meeting of May 5, 2015; and 4) Minutes of the Special City Council Meeting of May 11, 2015. Action: Approved. B. PLANNING COMMISSION ACTIONS-MEETING OF APRIL 28,2015 The City Council is requested to review the Planning Commission actions of their regular meeting of April28, 2015. Action: Received and filed. C. APPROVAL OF CONSULTANT SERVICES AGREEMENT WITH JAN PRO CLEANING SYSTEM FOR JANITORIAL SER\/ICES FOR FISCAL YEARS (FY) 2015-18 The City Council is requested to review and approve the Consultant Services Agreement with Jan Pro Cleaning Systems for janitorial cleaning services for various City facilities at Live Oak Park and City Hall complex. Action: 1) Approved a three-year Consultant Services Agreement with Jan Pro Cleaning System for janitorial cleaning services; and 2) Authorized the City Manager to execute the agreement in an amount not to City Council Minutes May 19, 2015 Page 3 of 10 exceed $213,314.76 over the three-year term. D. APPROVAL OF AGREEMENT WITH CLS LANDSCAPE MANAGEMENT, INC. FOR LANDSCAPE MEDIAN MAINTENANCE SERVICES FOR FISCAL YEARS (FY) 2015-18 The City Council is requested to review and approve the agreement for landscape median maintenance services with CLS. Approval of this agreement will allow for ongoing maintenance to the various medians and planters on Baldwin Avenue, Santa Anita Avenue, Lower Azusa Road, Encinita Avenue, Las Tunas Drive and Rosemead Boulevard. Action: 1) Approved a three-year Consultant Services Agreement with CLS Landscape Management for landscape median maintenance services; and 2) Authorized the City Manager to execute the agreement in an amount not to exceed $215,730.00 over the three-year term. E. APPROVAL OF AGREEMENT WITH WEST COAST ARBORISTS, INC. FOR TREE MAINTENANCE SERVICES FOR FISCAL YEAR (FY) 2015-16 West Coast Arborists is a California Corporation located in Anaheim with over 40 Certified Arborists and over 100 Certified Tree Workers. Due to ongoing issues and uncertainties with the DIR's wage determination, staff is recommending the City enter into a one-year agreement with West Coast Arborists, with three additional one year renewal options, instead of a longer contract (i.e., 30-years or 5-years). This option allows for more flexibility for the City should the wage determination change again. Action: 1) Approved a one-year Agreement with West Coast Arborists, Inc. for tree maintenance services; and 2) Authorized the City Manager to execute the agreement in an amount not to exceed $100,000.00 over the one-year term. F. ADOPTION OF RESOLUTION NO. 15-5085. DECLARING THE CITY'S INTENTION TO LEVY AND COLLECT LIGHTING AND MAINTENANCE DISTRICT ASSESSMENTS FOR FISCAL YEAR (FY) 2015-16 AND ESTABLISHING THE TIME AND PLACE FOR HEARING PUBLIC OBJECTIONS. City Council Minutes May 19, 2015 Page 4 of 10 H. The City Council is requested to accept the Engineer's Report for the Temple City Citywide Lighting and Maintenance District for Fiscal Year (FY) 2015-16 and adopt Resolution No. 15-5085. Action: Accepted the Engineer's Report and adopted Resolution No. 15-5085. THIRD QUARTER TREASURER'S EXPENDITURE SUMMARY REPORTS FINANCIAL REPORT REPORT, REVENUE AND AND CAPITAL IMPROVEMENT The City Council is requested to receive and file the Third Quarter (i.e., January-March 2015) City Treasurer's Report, Revenue Summary Report, Expenditure Summary Report and the Capital Improvement Financial Report. Action: Received and filed the Third Quarter City Treasurer's Report, Revenue Summary Report and the Capital Improvement Financial Report. I. SECOND READING AND ADOPTION OF ORDINANCE NO. 15-1003 AMENDING MUNICIPAL CODE SECTION 2-6C-5 TO REDUCE SIZE OF THE PUBLIC ARTS COMMISSION City Council directed staff to prepare and an ordinance reducing size of the Public Arts Commission from seven to five members. Action: Waived further reading and adopted Ordinance No. 15-1003 amending Municipal Code Section 2-6C-5 to reduce size of the Public Arts Commission from seven to five members. J. ADOPTION OF RESOLUTION NO. 15-5086 APPROVING PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 15-5086 authorizing the payment of bills. Action: Adopted Resolution No. 15-5086. Consent Calendar Item G was heard out of agenda order. G. FISCAL YEAR (FY) -CITY BUDGET -THIRD QUARTER BUDGET AMENDMENTS City Council Minutes May 19, 2015 Page 5 of 10 Throughout the fiscal year, staff monitors revenues and expenditures and makes recommendations for revised revenue estimates and adjustments to appropriations quarterly. City Manager Cook shared that the City received a notice from California Joint Power Insurance Association on Thursday, May 14, regarding retro adjustment billing for City's Worker's Compensation coverage. This adjustment is not reflected in the third quarter amendment. Staff will present a report at the next City Council meeting regarding this adjustment as there will be expenses incurred during this fiscal year. Councilmember Sternquist made a motion to authorize staff to revise various budgeted appropriations for the FY 2014-15 City Budget to ensure revenue estimates are accurate and actual spending levels are within budgeted appropriations during the current fiscal year. CONSIDERATION OF A REQUEST FROM THE LOS ANGELES COUNTY SHERIFF'S DEPARTMENT AND THE LAW ENFORCEMENT TORCH RUN FOR SPECIAL OLYMPICS FOR TEMPLE CITY TO CO-SPONSOR THE 2015 SPECIAL OLYMPICS WORLD SUMMER GAMES LAW ENFORCEMENT TORCH RUN FINAL LEG AND CEREMONY IN TEMPLE CITY PARK ON JULY 19, 2015 The Los Angeles County Sheriff's Department and the Law Enforcement Torch Run for Special Olympics has requested the City co-sponsor the 2015 Special Olympics World Summer Games Law Enforcement Torch Run Final Leg and Ceremony in Temple City Park on July 19, 2015. Council's approval is required to waive any and all fees and deposits for use of the Performing Arts Pavilion and for assistance in coordinating the publicizing the event. Public Safety Supervisor Ariizumi gave a brief summary of the staff report. City Council discussed and commented on the request to co-sponsor the 2015 Special Olympics World Summer Games Law Enforcement Torch Run Final City Council Minutes May 19, 2015 Page 6 of 10 Leg and Ceremony in Temple City Park. Mayor Chavez opened public comment. Hearing no request to speak, Mayor Chavez closed public comment. Councilmember Yu made a motion to approve the request from the Los Angeles County Sheriffs Department and the Law Enforcement Torch Run for Special Olympics to co-sponsor the 2015 Special Olympics World Summer Games Law Enforcement Torch Run Final Leg and Ceremony in Temple City Park on July 19, 2015; and waive all fees and deposits for use of Temple City Park and Pavilion. Seconded by Councilmember Sternquist and unanimously carried by the following votes: AYES: Councilmember: ABSTAINED: Councilmember: NOES: Councilmember: Fish, Man, Sternquist, Yu, Chavez None None B. APPROVAL OF VEHICLE LEASE AND MAINTENANCE PROGRAM Due to a limited capacity for the City to effectively develop and maintain a comprehensive vehicle maintenance and replacement program, contracting with EFM for the lease of City vehicles, maintenance and on-going replacement will ensure the City's vehicle operations are effective and cost efficient. City Manager Cook spoke briefly regarding the short and long term benefits of a vehicle lease and maintenance program. Administrative Services Director Hause gave a brief overview of the vehicle lease and maintenance program. City Council discussed and commented on the vehicle lease and maintenance program. Mayor Chavez opened public comment. Jerry Jambazian, Temple City business owner, asked questions regarding tree trimming vehicles. Hearing no further request to speak, Mayor Chavez closed public comment. City Council requested more information regarding the benefits of implementing a vehicle lease and maintenance program. Councilmember Yu made a motion to continue this item to a future meeting to City Council Minutes May 19, 2015 Page 7 of 10 allow staff to bring back additional information for Council consideration regarding the vehicle lease and maintenanr,e program. Update on Governor's Conservation Order City Manager Cook reported on this item under "Update from City Manager". B. Scam Awareness Workshop Workshop information was announced during Agenda Item 6 Public Comment. 12. UPDATE FROM CITY MANAGER Mayor Chavez and City Manager Cook reported out on a meeting the City had with four of five water purveyor (i.e., Cal American, East Pasadena, Sunny Slope and Golden State) for the City this morning. 13. UPDATE FROM CITY ATTORNEY City Attorney Vail shared that he will not be attending the next City Council meeting. 14. COUNCIL REPORTS REGARDING AD HOC OR STANDING COMMITTEE MEETINGS A. He shared that staff will be presenting an ordinance to repeal back in parking in municipal parking lots for City Council consideration in an upcoming meeting. D. CIVIC CENTER MASTER PLAN STANDING COMMITTEE (Mayor Pro Tern Yu and Councilmember Fish)-Formed 5/13/2013 No Report. E. STRATEGIC PLAN IMPLEMENTATION STANDING COMMITTEE (Mayor Chavez and Councilmember Sternquist)-Formed 1/27/2014 No Report. F. LAS TUNAS DOWNTOWN REVITALIZATION STANDING COMMITTEE (Mayor Chavez and Mayor Pro Tern Yu)-Formed 2/18/2014 Mayor Pro Tern Yu reported on the standing committee's meeting on May 8 meeting. The standing committee gave staff directions and staff will bring a report to City Council for consideration in an upcoming meeting. G. FUTURE DEVELOPMENT OF CITY PROPERTIES STANDING COMMITTEE (Mayor Pro Tern Yu and Councilmember Man)-Formed 2/18/2014 No report. H. AUDIT STANDING COMMITTEE (Mayor Chavez and Mayor Pro Tern Yu)-Formed 7/15/2014 No report. I. FACILITIES, PUBLIC WORKS, AND INFRASTRUCTURE AD HOC COMMITTEE (Mayor Pro Tern Yu and Councilmember Man) -Formed 2/4/2014 No report. J. COMMISSION APPLICATION REVIEW AD HOC COMMITTEE (Mayor Chavez and Councilmember Sternquist)-Formed 1/20/2015 Mayor Chavez reported that the ad hoc had its first round of interviews with the applicants on Monday, May 18. Second round of interviews will be on Tuesday, May 26. Ad hoc committee recommended applicants will interview City Council Minutes May 19, 2015 Page 9 of 10 in front of full City Council on Wednesday, June 3. K. REVIEW OF RULES AND PROTOCOLS (Mayor Chavez and Councilmember Man)-Formed 4/21/2015 Mayor Chavez reported on the ad hoc committee's meeting this afternoon and staff will bring back a staff report to update a section of the City Council and Commissioner Protocol. L. VETERANS DAY CELEBRATION (Councilmember Sternquist and Councilmember Fish)-Formed 4/21/2015 No report. Mayor Chavez established a standing committee to meet with the City's water purveyors. Mayor Chavez appointed himself, Planning Commissioner Haddad, and Councilmember Fish. The standing committee will address on-going issues of water conservation and state mandate regarding water usage. 15. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER FISH Councilmember Fish reported on the conferences (Southern California Association of Government and California Contract Cities Association) she attended, Miss Temple City Ambassadors Program, and commented on residents who are already doing their part in conserving water. B. COUNCILMEMBER MAN Councilmember Man reported on a conference (California Contract Cities) he attended and the Miss Temple City Ambassadors Program. C. COUNCILMEMBER STERNQUIST Councilmember Sternquist reported on the conferences (Southern California Association of Government and California Contract Cities Association) she attended. She also reminded the public to beware of Asian Tiger mosquitoes infestation and should report any sighting of the mosquitoes. D. MAYOR PROTEM YU Mayor Yu reported on the conference (California Contract Cities) he attended. City Council Minutes May 19, 2015 Page 10 of 10 E. MAYOR CHAVEZ Mayor Chavez invited the public to attend upcoming Los Angeles County Sanitation District events. He reported on a Temple City Historical Society event he attended and Miss Temple City Ambassador's Program. He reminded the public that deadline to apply for the City's Youth Committee is end of May. 16. ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Mary Kokayko, Temple City resident, shared information she gathered from local water companies. 17.
