HomeMy Public PortalAboutORD 73/01ORDINANCE NO. 73_1_ AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA, AMENDING A PORTION OF SECTION I ENTITLED "DISTRICTS AND BOUNDARIES THEREOF" OF THE ZONING ORDINANCE, ORDINANCE 108 AS AMENDED, OF THE TOWN OF GULF STREAM FLORIDA, BY ADDING A NEW DISTRICT ENTITLED "OUTDOOR RECREATIONAL DISTRICT"; AMENDING THE ZONING MAP TO REFLECT THE NEW DISTRICT, AND BY ADDING A NEW SECTION TO ZONING ORDINANCE 108 AS AMENDED OF THE TOWN OF GULF STREAM, FLORIDA, NUMBERED "VA" AND ENTITLED "OUTDOOR RECREATIONAL DISTRICT" WHICH CONTAINS THE ZONING PRO- VISIONS OF SUCH DISTRICT, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. WHEREAS, the Town of Gulf Stream has been substantially developed since the passage of the original zoning Ordinance; "M WHEREAS, one of the reasons the Town of Gulf Stream has remained an attractive community enjoying low population density has been the existence of three clubs within the Town that are primarily devoted to outdoor recreational activities, which results in substantial and needed open space and green area within the community which benefits all of its residents; and WHEREAS, the Town Commission wishes to insure to the extent that it can, that the property presently owned by THE LITTLE CLUB, INC., the GULF STREAM GOLF CLUB, INC. and the GULF STREAM BATH AND TENNIS CLUB, INC. or its subsidiary, will remain substantially open and will not be developed as residences which would result in greatly increased density of population; and WHEREAS, the adoption of this ordinance will protect the health, welfare and safety of the residents of the Town; and WHEREAS, the Planning Board of the Town of Gulf Stream, Florida, has recommended the amendment of Section I of Zoning Ordinance 108 of the Town of Gulf Stream, Florida, entitled "Districts and Boundaries Thereof" by adding a new district entitled "Outdoor Recreational District"; amending the zoning map to reflect the new district, and by adding Section VA defining "Outdoor Recreational District"; and WHEREAS, the above proposal was submitted to the Town sitting as a Zoning Commission; and WHEREAS, at least twenty-one (21) days notice of a Public Hearing was properly given; and WHEREAS, written notice to owners of property within five hundred (500') feet of the proposed districts has been properly given; and WHEREAS, all of the other requirements of Section XII entitled "Changes and Amendments" of the Zoning Ordinance of the Town of Gulf Stream, Florida, have been complied with; and WHEREAS, the Town Commission has held a Public Hearing with due public notice as required by law to consider this amendment; and WHEREAS, the Town Commission has determined that the amendments proposed are in accord with the Zoning Ordinance in general and sound zoning practices and will serve to promote the purposes of zoning set forth in the Town Zoning Ordinance; and WHEREAS, all the requirements of Chapter 176, Florida Statutes (1971) and of the Zoning Ordinance of the Town of Gulf Stream, Florida, with regard to the amendment of said ordinance have been met; now, therefore, BE IT ORDAINED by the Town Commission of the Town of Gulf Stream, Florida, as follows: Section 1: That Section I of Zoning Ordinance 108 as amended of the Town of Gulf Stream, Florida, entitled "Districts -2- and Boundaries Thereof" be and the same is hereby amended to add a new district as follows: "OUTDOOR RECREATIONAL DISTRICT" Section 2: That the Official "Zoning Map of the Town of Gulf Stream, Florida" as amended, be and the same hereby is amended to reflect the " Outdoor Recreational District" herein created as shown on the attached amended Zoning Map. Section 3: That Section V of the Zoning Ordinance of the Town of Gulf Stream, Florida, be and the same hereby is amended to add a new Section numbered "VA" which section shall read as follows: Section VA OUTDOOR RECREATIONAL DISTRICT A. Land may be zoned as "Outdoor Recrea- tional" if: 1) it is primarily used for boating, golf, tennis, swimming and/or athletics; 2) it is owned by the public or a club as defined else- where in the Zoning Ordinance, which has at least 250 members; 3) it consists of three (3) acres or more; and 4) more than seventy (70) percent of the land area is devoted to outdoor recreation as defined in this paragraph, and open space and parking. B. Uses permitted shall only be the following: 1. Outdoor recreation as defined above; 2. Club facilities for social, recrea- tional, fraternal and benevolent pur- poses; 3. Accessory buildings and uses custo- marily incident to any of the above uses, including club houses, golf house, rest facilities, swimming pools, tennis courts and pro shops. C. Building Height Limit: 1. No new building shall exceed two and one-half (2 1/2) stories or thirty- five (35) feet in height; however, any existing club building may be altered and repaired from time to time as shall be necessary for the effective operation and maintenance of such club. D. Front Yard Required: 1. There shall be a front yard of not less than twenty-five (25) feet in depth and a width of not less than one hundred (100) feet. -3- E, Side Yard Required: 1. There shall be side yards of not less than ten (10) feet on each side of a structure, including porches, projections, cornices and eaves, and no building shall be nearer than twenty (20) feet from any other building, including por- ches, projections, cornices and eaves, on the adjoining lot. F. Rear Yard Required: 1. There shall be a rear yard having a depth of not less than five (5) feet. Section 4: All ordinances or parts of ordinances in conflict herewith, be and the same are hereby repealed. Section 5: This ordinance shall take effect ninety (90) days following its adoption. 1973.
