\�TOWN OF GULF STREAM, PALM BEACH COUNTY,
evV FLORIDA, AMENDING ORDINANCE NO. 83-1, OF THE
TOWN OF GULF STREAM, AS AMENDED, THE OFFICIAL
ZONING ORDINANCE OF THE TOWN, SO AS TO PROVIDE
IN THE RS RESIDENTIAL SINGLE FAMILY DISTRICT
THAT FOR ALL LOTS LOCATED WITHIN SAID
DISTRICT, FOR SECOND FLOOR CONSTRUCTION, SAID
SECOND FLOOR AREA SHALL NOT BE IN EXCESS OF
THIRTY PERCENT OF THE TOTAL OF FIRST FLOOR AIR
CONDITIONED SPACE; PROVIDING THAT THE OUTSIDE
WALLS OF SECOND STORY CONSTRUCTION SHALL BE
SET BACK AT LEAST FOUR FEET FROM THE SIDE
WALLS OF THE FIRST FLOOR; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF
CONFLICTING ORDINANCES; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN
OF THE TOWN OF GULF
STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Ordinance No. 83-1 of the Town of Gulf Stream,
as Amended, the Official Zoning Ordinance of the Town, is hereby
amended at Section VII, "RS RESIDENTIAL SINGLE FAMILY DISTRICT", so
as to provide an additional provision as follows:
"Second Story Construction
A. The second floor of any two story structure shall
not exceed, in square footage, thirty percent (30%)
of the total of the square footage contained within
the air conditioned living space of the first
floor.
B. The exterior walls of any second story structure
shall be set back at least four feet (41) from the
exterior walls of the first floor construction."
Section 2. Severability.
If any provision of this Ordinance or the application thereof
is held invalid, such invalidity shall not affect the other
provisions or applications of this Ordinance which can be given
effect without the invalid provisions or applications, and to this
end the provisions of this Ordinance are hereby declared severable.
Section 3. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Gulf Stream, Florida, or
parts thereof which conflict with this or any part of this
Ordinance are hereby repealed.
Section 4. Codification.
This Ordinance shall be codified and made a part of the
official Code of Ordinances of the Town of Gulf Stream.

Section 5. Effective Date.
This Ordinance shall take effect immediately upon its passage
and approval, as provided by law.

reading this day of , 1991, and for a second and
final reading on this day of , 1991.
