HomeMy Public PortalAboutORD 91/18Al ORDINANCE NO. 91/18 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AMENDING ORDINANCE NO. 83-1 OF THE TOWN OF GULF STREAM, AS AMENDED, THE OFFICIAL ZONING ORDINANCE OF THE TOWN, SO AS TO PROVIDE THAT WITHIN ALL ZONING DISTRICTS OF THE TOWN THERE SHALL BE A MAXIMUM HEIGHT FOR THE FIRST FLOOR FINISHED FLOOR ELEVATION WHICH SHALL NOT EXCEED ONE FOOT ABOVE THE SEVEN FOOT MINIMUM FINISHED FLOOR ELEVATION EXCEPT WHERE THE EXISTING GRADE IS HIGHER THAN PLUS 8 FEET IN WHICH INSTANCE THE MAXIMUM FIRST FLOOR ELEVATION SHALL NOT EXCEED THE AVERAGE ELEVATION OF THE EXISTING GRADE AT THE LOCATION OF THE STRUCTURE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Ordinance No. 83-1, as amended, the Official Zoning Ordinance of the Town of Gulf Stream, is hereby amended at Section IV, "Definitions", number 73, "Floor", so as to amend said definition to read as follows: 1173 Floor. The top surface of an enclosed area in a building (including basement), i.e., top of slab in concrete slab construction, or top of wood flooring in wood frame construction. The maximum height of the first floor finished floor elevation shall not exceed one foot above the seven foot minimum finished floor elevation except where the exiting grade is higher than plus eight feet, in which case the maximum first floor elevation shall not exceed the average elevation of the existing grade at the location of the structure." Section 2. Ordinance No. 83-1, as amended, is amended at Section VII, "RS Residential Single Family District", to include an additional regulation to read as follows: "Finished Floor Elevation. The maximum first floor finished floor elevation for any structure shall not exceed one foot above the plus seven foot minimum finished floor elevation, except where the existing grade is higher than plus eight feet, in which case the maximum first floor elevation shall not exceed the average elevation of the exiting grade at the location of the structure." Section 3. Ordinance No. 83-1, as amended, is amended at Section VIII, "RM Multiple Family Residential District", to include an additional regulation to read as follows: 11 "Finished Floor Elevation. The maximum first floor finished floor elevation for any structure shall not exceed one foot above the plus seven foot minimum finished floor elevation, except where the existing grade is higher than plus eight feet, in which case the maximum first floor elevation shall not exceed the average elevation of the exiting grade at the location of the structure." Section 4. Ordinance No. 83-1, as amended, is amended at Section IX, "OR Outdoor Recreational District", to include an additional regulation to read as follows: "Finished Floor Elevation. The maximum first floor finished floor elevation for any structure shall not exceed one foot above the plus seven foot minimum finished floor elevation, except where the existing grade is higher than plus eight feet, in which case the maximum first floor elevation shall not exceed the average elevation of the exiting grade at the location of the structure." Section 5. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 6. Repeal of Ordinances in Conflict. All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 7. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Gulf Stream. Section 8. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. PASSED AND ADOPTED in a regular, adjourned session on first reading this day of final reading on this MAYOR day of 2 , 1991, and for a second and 1991.
