CITY OF MEDINA
RESOLUTION NO. 95-02
RESOLUTION CALLING FOR PUBLIC HEARINGS ON THE
IMPROVEMENT OF MEDINA ROAD FROM BROCKTON LANE
TO HOLY NAME DRIVE AND ON THE ASSESSMENT
THEREOF
WHEREAS, the city council has previously received and reviewed a report from
Bonestroo Rosene Anderlik & Associates with reference to the improvement of Medina
Road from Brockton Lane to Holy Name Drive and the assessment of benefitted
properties for a portion of the cost thereof .
NOW, THEREFORE, BE IT RESOLVED by the City Council of Medina
Minnesota:
1. The feasibility report for the improvement of Medina Road from
Brockton Lane to Holy Name Drive by placement of stabilization fabric,
drain tile and twelve inches of gravel base and four and a half inches
of bituminous surfacing, twenty-four feet in width with six foot gravel
shoulders is accepted by the city council.
2. The council will consider the improvement of the above portion of
Medina Road in accordance with the report and the assessment of
abutting property for a portion of the cost of the improvement pursuant
to Minnesota Statutes, Chapter 429, which project is estimated to cost
in excess of $100,000.
3 . The public hearing on the proposed improvement shall be held on March
7, 1995 in the council chambers at city hall beginning at 7:30 p.m. and
the clerk -treasurer shall give mailed and published notice of such
hearing and improvement. The notice shall be published twice, a week
a part, and the hearing shall be at least three days after the second
publication. The clerk -treasurer shall give mailed notice not less than
ten days prior to the hearing to the owner of all parcels proposed to be
assessed.
4. The clerk -treasurer, with the assistance of the city engineer shall also
calculate the proper amount to be special assessed for such improvement
against every benefitted lot or parcel, without regard to cash
valuation, as provided by law and he shall file a copy of the proposed
assessment in his office for public inspection.

5. A hearing to pass upon the proposed assessment shall be held on March
7, 1995 in the council chambers at city hall beginning at 7:30 p.m. All
persons owing property affected by such assessment shall be given an
opportunity to be heard thereon.
6. The clerk -treasurer is hereby directed to cause a notice of the
assessment hearing to be published once in the official newspaper at
least two weeks prior to the hearing. He shall also cause mailed notice
to be given to the owner of each parcel described on the assessment roll
not less than two weeks prior to the hearing.
7. The owner of any property so assessed may, at any time prior to
certification of the assessment with the county auditor, pay the whole
of the assessment on such property, with interest accrued to the date
of payment, except that no interest shall be charged if the entire
assessment is paid within 30 days from the date of the assessment . The
owner may at any time thereafter, pay the entire amount of the
assessment remaining unpaid, with interest accrued December 31st of
the year in which such payment is made. Such payment must be made
before November 15th or interest will be charged through December 31
of the succeeding year.

The motion for the adoption of the foregoing resolution was duly seconded by member
James Johnson and upon vote being taken thereon, the following voted in favor
thereof: Ferris, Johnson, Ann Thies, Philip Zietlow and Mayor Anne Theis.
and the following voted against same:
None.
Whereupon said resolution was declared duly passed and adopted.
