HomeMy Public PortalAboutORD 92/07NO. 92/7 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 66 OF THE CODE OF ORDINANCES RELATING TO ZONING, SO AS TO AMEND ARTICLE VI, DISTRICT REGULATIONS, DIVISION 2, RS SINGLE-FAMILY RESIDENTIAL DISTRICT, SECTION 66-199 REGARDING LOCATION OF ACCESSORY USES SO AS TO INCLUDE PROVISIONS FOR SETBACKS FOR PAVING, DECKING OR OTHER BUILT-UP SURFACES; SETTING FORTH PROVISIONS FOR THE LOCATION OF MECHANICAL EQUIPMENT; AMENDING ARTICLE VI, DISTRICT REGULATIONS, DIVISION 3, RM MULTIPLE - FAMILY RESIDENTIAL DISTRICT, SECTION 66-240, DIVISION 4, OR OUTDOOR RECREATIONAL DISTRICT, SECTION 66-263 AND DIVISION 6, P PUBLIC FACILITIES DISTRICT, SECTION 66-302, REGARDING ACCESSORY BUILDING REQUIREMENTS SO AS TO PROVIDE REGULATIONS FOR THE LOCATION OF PAVING, DECKING OR OTHER BUILT-UP SURFACES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Chapter 66 of the Code of Ordinances of the Town of Gulf Stream, Florida, relating to Zoning, is hereby amended at Article VI, "District Regulations", Division 2, "RS Single - Family Residential District", Section 66-199, "Location of accessory uses", so as to read as follows: "Sec. 66-199. Location of accessory structures. An accessory structure including, but not limited to, cabanas, enclosed swimming pools, unattached garages, paving and decks, mechanical equipment, and gazebos, shall be located on the same lot or parcel of land as that of the main residence building and shall be in conformity with the setback requirements set forth herein, excepting the following: (1) Unenclosed swimming pools may be located at 15 feet from the property line. (2) Paving, decking, or other impervious or semi - impervious, built-up surfaces, other than those intended for use by vehicles, which extend no more than four inches (411) above the highest abutting finished grade elevation may be located within required setbacks, but shall be no less than three feet (31) from any property line, provided they are screened from adjacent properties with a wall, fence, or hedge of at least four feet (41) in height. (3) For lots of less than 20,000 square feet, mechanical equipment including, but not limited to, air conditioner compressors, cooling towers, pool pumps and filters, of not more than four feet (41) in height may extend not more than five feet (51) into required side and rear yard setbacks provided they are 1 screened from an off premise view with a wall, fence or hedge. Notwithstanding the above, in no case shall said mechanical equipment be located in a required setback closer to a property line than to the structure which it serves. (4) Accessory structures provided for in Article VIII of this chapter shall conform to the setback requirements specified therein." Section 2. Chapter 66 of the Code of Ordinances of the Town of Gulf Stream, Florida, relating to Zoning, is hereby amended at Article VI, "District Regulations", Division 3, "RM Multiple - Family Residential District", Section 66-240, "Accessory building requirements", so as to read as follows: "Sec. 66-240. Accessory building requirements. For all accessory structures in the multiple -family residential district the following requirements shall be observed: (1) All accessory structures shall observe the same setbacks required for the principal structure(s), excepting the following: a. Paving, decking, or other impervious or semi -impervious, built-up surfaces, other than those intended for use by vehicles, which extend no more than four inches (411) above the surrounding finished grade elevation may be located within required setbacks, but shall be no less than three feet (31) from any property line, provided they are screened from adjoining properties with a wall, fence or hedge of at least four feet (41) in height. (2) No garage or other accessory building shall be erected before the principal building is under construction to the point of being fully enclosed." Section 3. Chapter 66 of the Code of Ordinances of the Town of Gulf Stream, Florida, relating to Zoning, is hereby amended at Article VI, "District Regulations", Division 4, "OR Outdoor Recreational District", Section 66-263, "Accessory building requirements", so as to read as follows: "Sec. 66-263. Accessory building requirements. For all accessory structures in the outdoor recreation district the following requirements shall be observed: (1) All accessory structures shall observe the same setbacks required for the principal structure(s), excepting the following: a. Paving, decking, or other impervious or semi -impervious, built-up surfaces, other than those intended for use by vehicles, OA which extend no more than four inches (4") above the surrounding finished grade elevation may be located within required setbacks, but shall be no less than three feet (31) from any property line, provided they are screened from adjoining properties with a wall, fence or hedge of at least four feet (41) in height. (2) No garage or other accessory building shall be erected before the principal building is under construction to the point of being fully enclosed." Section 4. Chapter 66 of the Code of Ordinances of the Town of Gulf Stream, Florida, relating to Zoning, is hereby amended at Article VI, "District Regulations", Division 6, "P Public Facilities District", Section 66-302, "Accessory building requirements", so as to read as follows: "Sec. 66-302. Accessory building requirements. For all accessory structures in the public facilities district the following requirements shall be observed: (1) All accessory structures shall observe the same setbacks required for the principal structure(s), excepting the following: a. Paving, decking, or other impervious or semi -impervious, built-up surfaces, other than those intended for use by vehicles, which extend no more than four inches (411) above the surrounding finished grade elevation may be located within required setbacks, but shall be no less than three feet (31) from any property line, provided they are screened from adjoining properties with a wall, fence or hedge of at least four feet (41) in height. (2) No garage or other accessory building shall be erected before the principal building is under construction to the point of being fully enclosed." Section 5. Severability. If any provision of this ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 6. Repeal of Ordinances in Conflict. All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. 3 Section 7. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Gulf Stream. Section 8. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law.
