HomeMy Public PortalAbout20091209 - Appropriations Committee - Meeting MinutesTown of Hopkinton Appropriation Committee (AC) Minutes of Meeting on Wednesday, December 9, 2009 Town Hall, First Floor, Main St., Hopkinton, MA In attendance: Stuart Cowart Heidi Krieger Ron Eldridge Norman Khumalo Mary Lou Haroian Joe Karner Chairman Eldridge called the meeting to order at 7:00 pm. The Committee welcomed Dan McIntyre and JT Gaucher from the DPW. The Committee convened to reconsider a motion passed at its previous meeting on December 2, 2009 in support of Article # 2 of the Special Town Meeting (STM) scheduled for next Monday, December 14, 2009. Some of the dollar amounts in the previous motion were incorrect. Stuart moved and Joe seconded a reconsideration of Article #2 of the 12/14/2009 STM. The motion passed by a vote of 4 – 0. Stuart moved and Joe seconded that the Chairman be authorized to make the attached motion pursuant to Article 2 of the Warrant of the December 14, 2009 STM, and that the Committee recommend an affirmative vote by the STM on such motion. The motion passed by a vote of 4 – 0. Joe moved and Stuart seconded a motion to approve the minutes of our December 2, 2009 minutes. The motion passed unanimously. Joe moved and Stuart seconded a motion to adjourn at 7:55 pm. The motion passed unanimously. 12/09/09 Motion(Appropriation Committee): We move that the Town vote to raise and appropriate $12,392,232.73 for the purpose of financing the design, development, construction, reconstruction, extension and upgrade of sewers, sewage systems, intermunicipal connections and sewage treatment and disposal facilities, including pumping stations and force mains, and all related systems, appurtenances, facilities, the acquisition of all necessary easements and interests in land, and the replacement of water pipes and other services and utilities, including, without limitation, all costs thereof as defined in Section 1 of Chapter 29C of the General Laws, said sum to be spent under the direction of the Town Manager; and, to meet this appropriation or any portion thereof, to transfer a sum of $1,419,437.73, said sum constituting the unspent balance of the appropriation voted pursuant to Article 30 of the 1996 Annual Town Meeting, a sum of $2,927,000, said sum constituting the unspent balance of the appropriation voted pursuant to Article 12 of the 2006 Annual Town Meeting and a sum of $4,499,295, said sum constituting the unspent balance of the appropriation voted pursuant to Article 19 of the 2007 Annual Town Meeting; and further, to meet this appropriation, to authorize the Town Treasurer, with the approval of the Board of Selectmen, to borrow $3,546,500 and issue bonds or notes therefor under Chapter 44 of the General Laws and/or Chapter 29C of the General Laws or any other enabling authority; that such bonds or notes shall be general obligations of the Town unless the Town Treasurer, with the approval of the Board of Selectmen, determines that they should be issued as limited obligations and may be secured by local system revenues as defined in Section 1 of Chapter 29C; that the Town Treasurer, with the approval of the Board of Selectmen, is authorized to borrow all or a portion of such amount from the Massachusetts Water Pollution Abatement Trust established pursuant to Chapter 29C; and, in connection therewith, to enter into a loan agreement and/or security agreement with the Trust and otherwise to contract with the Trust and the Department of Environmental Protection with respect to such loan and for any federal or state aid available for the project or for the financing thereof; that the Board of Selectmen is authorized to enter into a project regulatory agreement with the Department of Environmental Protection, to expend all funds available for the project and to take any other action necessary to carry out the project; and that the Board of Selectmen is authorized to apply for and accept any grants and loans that may be available for the purposes specified herein, including, but not limited to, Federal Stimulus Funds and the Massachusetts Opportunity Relocation and Expansion (MORE) Jobs program; provided, however, that the full amount authorized herein, less any grants, gifts or other sums received in connection with the purposes of this authorization, shall be assessed as betterments on properties within the area to be served by facilities funded hereby; and provided further that no expenditures made in fulfillment of the Town's obligations under the 2001 Intermunicipal Agreement for Wastewater Collection, Treatment and Disposal, executed by and between the Towns of Hopkinton and Milford, shall be authorized pursuant to this Article until the Town has received written notification from the Commonwealth that it has been awarded a grant from the MORE Jobs program or another grant program, and that no contract to implement the plans and specifications submitted by the Town to the Department of Environmental Protection as Contract CWSRF-2942 shall be awarded until the Town has received written authorization of Water Pollution Abatement Trust financing therefor.
