Section 1. Chapter 42, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to Building and Building Regulations, is hereby
amended at Article II, "Construction Standards", to add a new Section 42-30,

Section 3. Chapter 58, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to Planning and Development, is hereby amended
at Article VI, "Land Clearing", Section 58-137, "Exemptions", to read in its

Sec. 58-137. Exemptions.
The provisions of this article shall not apply to:
(1) The removal of trees on public lands, public rights-of-way or
easements conducted by or on behalf of public utilities, or a federal,
state, county municipal or other governmental agency in pursuance of its
lawful activities or functions.
(2) The removal of trees or the moving or deposition of soil upon lots
previously developed and for which a building permit has previously been
granted, except in the instance where the redevelopment activity will
destroy trees in excess of 8" in caliper b or alter 50 percent or
more of the landscaped area of the developed site.
(3) The land clearing permit requirement shall not be construed to
prohibit the removal or elimination of excessive accumulations of untended
growth of weeds, undergrowth or other dead or living plant life as may be
required.

Section 4. Chapter 58, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to Planning and Development, is hereby amended
at Article VI, "Land Clearing", as follows:

Section 5. Chapter 58, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to Planning and Development, is hereby amended

Section 6. Chapter 58, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to Planning and Development, is hereby amended
at Article VI, "Land Clearing", Section 58-138, "Application fee", to be
replaced in its entirety with the following:
Sec. 58-140 Application fee.
The application fee for a land clearing permit shall be as established
in the fee schedule adopted by the town commission.
Section 7. Chapter 62, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to Subdivisions, is hereby amended at Section
62-6, "Alignment of streets; provisions for utilities", to read in its entirety

Sec. 62-6 Alignment of Streets; provisions for utilities; access
requirements
Land shall be so subdivided and platted or mapped that the proposed
streets or public ways shall conform as nearly as practicable to existing
streets and public ways, in proximity to such tract of land. It shall
also show the proposed width and grade of streets in such tract of land,
width and grade of sidewalks, the proposed system of sewers and drainage
and the arrangements to be made for providing the tract of land with
water, gas or other public utility service. The minimum width for anv
access easement shall be 30 feet in order to accommodate 20 feet of

request for replat. Such additional costs shall be paid to the town by the
applicant prior to the official filing of the record plat.
Section 9. Chapter 66, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to Zoning, is hereby amended at Article I, "In
General", Section 66-1, "Definitions", to modify the definition of "structure

Structure height shall mean the vertical distance measured from the
point of base flood elevation to the highest point of a structure unless
otherwise specified in this code. For a rooftop super -structure, height
shall be measured from the highest point of the roof to the highest point
of such structure.
Section 10. Chapter 66, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to Zoning, is hereby amended at Article V, "Site
Plans", Division 2, "Architectural/Site Plan Review -- Levels 1, 2 and 311,
Section 66-141, "Applicability", Subsection (1), "Projects requiring level 1
architectural/site plan review", revising paragraph (1) d., as follows: (words

Section 66-141, "Applicability", Subsection (3), "Projects requiring level 3
architectural/site plan review", to insert a new paragraph (3)k and renumber the

(k) Clearing of more than 508 of a site's existing vegetation;
(1) Development proposals which otherwise require a level 2

Section 14. Chapter 66, of the Code of Ordinances of the Town of Gulf

Section 66-235, "Side yard required", to add a new subsection (c) as follows:

Section 16. Chapter 66, of the Code of Ordinances of the Town of Gulf

"North Ocean Boulevard Overlay District", Section 66-325, "Mitigation", to amend

Section 17. Chapter 66, of the Code of Ordinances of the Town of Gulf

Sec. 66-330. Recreational Uses.
Section 18. Chapter 66, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to Zoning, is hereby amended Article VIII,
"Supplementary District Regulations", Division 2, "Accessory Structures and
Recreational Facilities", Section 66-367, "Swimming Pools", Subsection (e), as

(e) Unless otherwise specified elsewhere in this code unenclosed or
open swimming pools in the "RS" single-family residential district shall

78 -foot centerline setback.
Section 19. Chapter 66, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating Zoning, is hereby amended at Article VIII,
"Supplementary District Regulations", Division 2, "Accessory Structures and
Recreational Facilities", Section 66-367, "Swimming Pools", Subsection (g), as

(g) All pools shall be enclosed by a self-locking, child resistant fence,
wall or equivalent barrier at least four feet high, except as provided
elsewhere in this code, and in no event shall a pool be exposed to open
view from any public roadway.
Section 20. Chapter 66, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to Zoning, is hereby amended at Article VII,
"Supplementary District Regulations", Division 2, "Accessory Structures and
Recreational Facilities", Section 66-369, "Docks", Subsection (5), "Ancillary

(5) Ancillary structures permitted. Ancillary structures including hand-
rails, steps, swim ladders and up to a maximum of four dolphins, one
boat lift and one davit (alternatively two three davits), two water
hookups, two electrical outlets in excess of 115 volts, two lights,
and one dock box shall be permitted in accordance with the provisions
of this chapter. Boathouse, fleating deeks, fixed covers, fixed
benches, fixed fish cleaning apparatus, fixed maintenance apparatus,
fuel pumps, sewage pump -outs, flagpoles and diving platforms/boards
shall be prohibited.
Section 21. Chapter 66, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to the Design Manual, a new subsection is hereby
added at the end of Article VIII, "Supplementary District Regulations", Division
2, "Accessory Structures and Recreational Facilities", Section 66-369, "Docks",
Subsection (6)(h), "Locations and dimensions", as follows: (words underlined are

Section 22. Chapter 66, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to the Design Manual, a new subsection is hereby
added at the end of Article VIII, "Supplementary District Regulations", Division
5, "Parking", Section 66-916, "Parking of recreational equipment or commercial
vehicles- On property", Subsection (a)(2), as follows: (words underlined are

(2) The location for such parked equipment shall be in the rear yard or
in the side yard to the rear of a line established by the front building line

adjacent to the side yard where the equipment is located; provided, however,
that on corner lots such equipment shall not be parked on the side yard which
faces a public street, and also provided that such parked equipment shall not
exceed eight feet in height and shall be fully screened from off -premises view.
Section 23. Chapter 66, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to the Design Manual, is hereby amended at
Article VIII, "Supplementary District Regulations", Division 6, "Setbacks",
Section 66-431, "State Road AIA", Subsection (a), as follows: (words underlined

(a) There is hereby fixed the setback distance for the construction and
erection of buildings and improvements along the right-of-way of State
Road AlA through the town at 78 feet from the centerline of the road
unless otherwise specified in the code.
Section 24. Chapter 44, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to Concurrency management, is hereby amended at
Article II, "Administration", to repeal Section 44-34, "Annual concurrency
report", in its entirety.
Section 25. Chapter 70, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to the Design Manual, is hereby amended at
Article II, "Single -Family Districts", Section 70-27, "District Descriptions",

(a) Based on neighborhood characteristics, five single-family zoning
districts have been established: Gulf Stream Core, Ocean West, Beachfront,
North/South (which maV also be referred to as the "Fringe" District)
Fringe and Place Au Soleil.
Section 26. Chapter 70, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to the Design Manual, is hereby amended as
follows:
All references to "Fringe" or "RS -F" in Chapter 70 and in the Appendices
are hereby changed to "North/South" and "N/S", respectively.
Section 27. Chapter 70, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to the Design Manual, is hereby amended at
Article IV, "Site Development Regulations", Section 70-68, "Lot size and
Dimensional requirements", to change the Beachfront District Minimum lot width
from 100 feet to 150 feet.
Section 28. Chapter 70, of the Code of Ordinances of the Town of Gulf
Stream, Florida, relating to the Design Manual, is hereby amended at
Article IV, "Site Development Regulations", Section 70-70, "Floor area

(7) Areas in attics that cannot be used for living area shall not be
included if the ceiling height does not exceed 6-1/2 feet and there
are no windows.
Section 29. Chapter 70, of the Code of Ordinances of the Town of Gulf

Section 66. Severability.
If any provision of this ordinance or the application thereof is held
invalid, such invalidity shall not affect the other provisions or
applications of this Ordinance which can be given effect without the
invalid provisions or applications, and to this end the provisions of
this Ordinance is hereby declared severable.
Section 67. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Gulf Stream, Florida, or parts
thereof which conflict with this or any part of this Ordinance is here-
by repealed.
Section 68. Codification.
This Ordinance shall be codified and made a part of the official
code of Ordinances of the Town of Gulf Stream.
Section 69. Effective Date.
This Ordinance shall take effect immediately upon its passage and
approval, as provided by law.
PASSED AND ADOPTED in a regular, adjourned session on first
reading this 11" day of February, 2000, and for a second and final reading
on this 10th da of March , 2000.
