HomeMy Public PortalAbout1995-009Member Ann Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 95-09 RESOLUTION DENYING A VARIANCE FOR PAUL JAUNICH FOR 3205 T.H. 55 WHEREAS, Paul Jaunich (the "Applicant") is the owner of the property located at 3205 T . H . 55 ( the "Property") ; and WHEREAS, the Property is zoned RR (rural residential); and WHEREAS, the Applicant wishes to develop the site for a single family dwelling; and WHEREAS, section 720.17 of the Medina Code of Ordinances requires that every lot to be used for construction of a single family dwelling contain both a primary and secondary septic system site; and WHEREAS, the Property contains only sufficient area for a primary septic system site; and WHEREAS, section 721.03 of the Medina Code of Ordinances allows the city council to grant a variance from the provisions of the individual septic system ordinance in the case of hardship, as specified in the Code of Ordinances; and WHEREAS, the planning commission recommended on May 12, 1992 against granting the variance because of the lack of a hardship; and WHEREAS, the matter has now been reviewed by the city council and the council has considered the recommendation of the planning commission as well as the comments of the staff and the Applicant. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicant's request for a variance from section 720.17 of the Medina Code of Ordinances is denied due to the lack of a hardship.
