HomeMy Public PortalAbout1995-010Member Ann Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 95-10 RESOLUTION GRANTING CONDITIONAL USE PERMIT REGARDING ACCESSORY STRUCTURES TO NICK OEFFLING WHEREAS, Nick Oeffling (Applicant) has requested permission to remove one accessory structure on the property located at 4455 Co. Rd. 19 and replace it with a larger accessory structure; and WHEREAS, the Applicant's property is 70.72 acres and contains five accessory structures totaling 8,072 sq. ft.; and WHEREAS, after removal of one accessory structure and its replacement with a larger accessory building, the Applicant's property would have five accessory structures totalling 11,732 sq. ft.; and WHEREAS, the city's zoning ordinance requires a conditional use permit on property over three acres in size in order to have more than two accessory structures or when the cumulative area of the accessory structures exceeds 3,000 square feet; and WHEREAS, this matter was reviewed by the planning commission at its meeting of February 14, 1995, and by the city council at its meeting of March 7, 1995; and WHEREAS, it has been determined that the proposed new accessory structure on the property will not impede the normal and orderly development of adjacent lands for purposes for which they are zoned. EmE85453 ME230-221 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following conditions: 1. The total area in accessory structures on the property shall not exceed 12,000 square feet, nor shall there be more than five accessory structures; 2. The new accessory structure shall be for Applicant's personal use or for purposes related to agriculture and shall not be used by the Applicant in connection with any commercial activity on the property; 3. None of the accessory buildings may be rented or leased by the Applicant to a third party; 4. The existing 30' x 40' barn, which the Applicant wishes to replace, must be razed when the new accessory building is constructed; and 5. The Applicant must pay the city an administrative fee in the amount determined by the staff to represent the actual cost to the city of reviewing this application. Dated: March 21 , 1995. Anne E.
