Member Ann Thies introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO. 95-11
RESOLUTION GRANTING CONDITIONAL USE PERMIT TO
JAMES F. O'BRIEN FOR CONSTRUCTION OF INDUSTRIAL
BUILDING
WHEREAS, James F. O'Brien, d/b/a Straight Line Auto Body (Applicant) has requested
permission to construct a 3,480 sq. ft. industrial building on the property located at 740 Tower
Drive to conduct an auto repair and repainting business; and
WHEREAS, the property in question, which is legally described as Lot 3, Block 2,
Medina Industrial 2nd Addition, is zoned urban industrial; and
WHEREAS, the city's zoning ordinance requires a conditional use permit in order to be
able to construct the proposed facility; and
WHEREAS, this matter was reviewed by the planning commission at its meeting of
February 14, 1995 and by the city council at its meeting of March 7, 1995; and
WHEREAS, it has been determined that the construction of the proposed industrial facility
on the property will not impede the normal and orderly development of adjacent lands for
purposes for which they are zoned.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that a conditional use permit be granted to the Applicant for the stated purpose,
subject to the following conditions:
1. The Applicant shall construct the building and implement the site plan,
including the landscaping, in accordance with the plans submitted to and approved by the
city;

2. The Applicant shall comply with all requirements of the letter from city
engineer Shawn Gustafson dated February 9, 1995, except that construction standards for
the parking lot shall be controlled by paragraph 9 of this conditional use permit;
3. There shall be no exterior storage on the site;
4. Any exterior signs shall be constructed in accordance with the city's sign
regulations;
5. The number of employees shall not exceed five;
6. Exterior lighting shall be designed and installed so that the globe is
recessed and enclosed on all sides except the bottom and no light is cast directly on any
other property;
7. There shall be no outside speakers or telephone bells;
8. The Applicant shall comply with the requirements of the Hamel fire
department;
9. The construction standards of the parking lot shall be as required by the
city engineer and city staff, after consultation with the Applicant's soils engineer; and
10. The Applicant must to pay the city an administrative fee in the amount
determined by the staff to represent the actual cost to the city of reviewing this
application.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of
Medina, Minnesota that variances be granted to reduce the required side yard setback from 30
feet to 15 feet and the rear yard setback in two locations from 30 feet to 18 feet. The
justification for granting said three variances is the size and shape of the existing lot.

The motion for the adoption of the foregoing resolution was duly seconded by member
James Johnson and upon vote being taken thereon, the following voted in favor thereof:
John Ferris, Johnson, Thies, Philip Zietlow and Mayor Anne Theis.
and the following voted against same:
None.
Whereupon said resolution was declared duly passed and adopted.
