HomeMy Public PortalAboutRES 78/01RESOLUTION 79-1 A RESOLUTION OF THE TOWN COMMISSION OF TIIE TOWN OF GULFSTREAM FLORIDA, WITH RESPECT TO ORDINANCE NO. 74-5, SECTION 23(a)(6) TO CLARIFY THE UNDERSTANDING OF THE TOWN COMMISSION WITH RESPECT TO THE APPROVED ASSIGNMENT OF THE FRANCHISE FROM LEADERSHIP CABLE TELEVISION SYSTEMS, A FLORIDA LIMITED PAR- TNERSHIP, TO LEADERSHIP CABLEVISION ASSOCIATES, LTD., A FLORIDA LIMITED PARTNERSHIP, AS PROVIDED IN ORDINANCE NO. 78-1. WHEREAS, the Town of Gulfstream passed and adopted on second reading Ordinance No. 78-1 on February 10, 1978, permitting the assignment of the CATV Franchise under Ordinance No. 74-5 to Leadership Cablevision Associates, Ltd., a Florida limited partner- ship; and WHEREAS, the said Ordinances are unclear as to the time and which Leadership Cablevision Associates, Ltd. is to complete the system in Gulfstream; and WHEREAS, it has been represented to the Town Commission of the Town of Gulfstream that said CATV System would be completed within five months of the closing of the assignment and sale of assets from Leadership Cable Television Systems to Leadership Cablevision Associates, Ltd.; and WHEREAS, it has been represented to the Town Commission of the Town of Gulfstream that the closing of the assignment and sale of assets will occur on March 17, 1978, NOW THEREFORE, be it resolved by the Town Commission of the Town of Gulfstream, Florida, as follows: Leadership Cablevision Associates, Ltd. shall have five months from the date of closing of the purchase of assets of Leadership Cable Television Systems, Ltd., that is, March 17, 1978, to sub- stantially complete the CATV System in Gulfstream, Florida, and further provided that the time for completion of the system shall be ex- tended for a good cause shown, that is, acts of God or a third party beyond the control of Leadership Cablevision Associates, Ltd.
