HomeMy Public PortalAboutRES 78/07R E S 0 L U T ION 78-7 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, PROVIDING FOR THE CONTINUITY OF THE GOVERNMENT OF THE TOWN OF GULF STREAM, FLORIDA, PURSUANT TO CHAPTER 22, FLORIDA STATUTES, AS AMENDED. WHEREAS, as a result of enemy attack, the duly elected Commissioners and Mayor of the Town of Gulf Stream, Florida, may be unavailable to dis- charge the authority, responsibility, and leadership of the elected office; and WHEREAS, due to the almost certain disruption of communications and other services of government it may be impracticable to initiate and pursue the exiting legal procedures for the election of the successors to those unavailable; and WHEREAS, Chapter 22, Florida Statutes, as amended, enables political entities to provide through appropriate resolution or ordinance for emergency, interim succession to public office to assure the continuity of essential functions of government: NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA: Section 1: That each duly elected commissioner of the Town of Gulf Stream, Florida, shall designate by title, if feasible, or by named person, three (3) emergency interim successors to his office and specify their order of succession. Section 2: That the Town Clerk shall maintain in current status the list of designees for emergency interim succession to the elective offices of the Town Commission of the Town of Gulf Stream, Florida, and that each elected commissioner shall review and revise his designees and their order of succession and so inform the Town Clerk. Section 3: The emergency interim successor shall exercise the powers and discharge the duties of the office to which designated only after an attack on the United States has occurred and then only by reason of the un- availability of the regular incumbent or the immediately preceding designated successor, and will serve only until such time as the vacancy created by the unavailability of the elected official shall be filled in accordance with the Constitution or applicable Statutes or until the elected official (or a pre- ceding designated emergency interim successor) again becomes available to exercise the powers and discharge the duties of his office. The designating offical may revise or amend the roster of his successors at his pleasure with or without cause. Section 4: Designated emergency interim successors shall, upon designation, take the oath of office prescribed for the duly elected offical with the stip- ulation that the designees shall be empowered to exercise the powers and duties of the office only as stated herein. PASSED AND ADOPTED THIS 8th DAY OF September, 1978.
