CITY OF MEDINA
RESOLUTION NO. 95-16
RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL
TO JOSEPH BIZZANO AND NANCY BIZZANO
WHEREAS, Joseph Bizzano and Nancy Bizzano (the "Applicants") have
requested approval to plat their property located at 1592 Homestead Trail; and
WHEREAS, the planning commission reviewed the Applicants' preliminary plat
for its conformance with the ordinances and requirements of the city and following
a public hearing on March 14, 1995 recommended granting preliminary approval to
said plat.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that preliminary approval for the plat of the Applicant's property
is hereby granted, subject to the following conditions:
1. The final plat must provide the drainage and utility easements required
by the city engineer;
2. The Applicant must submit title evidence to the city attorney for his
review in order to identify the necessary parties to sign the plat;
3. The Applicants must execute a private road agreement in a form
acceptable to the city attorney which, at a minimum, addresses the
following matters:
a) public easement for emergency vehicular access;
b) vehicular access to Homestead Trail, including access over
Haislet property;
c) construction of improvements over the first 200'± of the existing
driveway;
d) agreement to be joined in by owners of all lands subject to 1975
driveway agreement; and
e) construction of fourth house served by driveway to trigger
compliance with then -current road standards.

4. The final plat must be submitted to the zoning administrator within 180
days of the date of approval of this resolution or an extension of such
time must be granted by the city council prior to its expiration; and
5. The Applicant must pay to the city an administrative fee in an amount
necessary to reimburse the city for its expenses in reviewing this
application.

The motion for the adoption of the foregoing resolution was duly seconded by member
Philip Zietlow and upon vote being taken thereon, the following voted in favor
thereof:
Ferris, Ann Thies, Zietlow and Mayor Anne Theis.
and the following voted against same: None.
Absent: James Johnson.
Whereupon said resolution was declared duly passed and adopted.
