HomeMy Public PortalAbout14-8780 Jose Polo for Final Site Plan Approval for Industrial Lotial Sto Sponsored by: City Manager RESOLUTION NO. 14-8780 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, TO GRANT THE REQUEST OF JOSE POLO, FOR FINAL SITE PLAN APPROVAL FOR AN INDUSTRIAL STORAGE LOT LOCATED AT 13180 NW 31ST AVENUE, DESCRIBED AS FOLIO NO. 08-2128-004-0461; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Jose Polo, the applicant, has submitted a final site plan application for property located at 13180 NW 31st Avenue, described as Folio no. 08-2128-004-0461 ("the Property"); and WHEREAS, staff review indicates the final site plan satisfies the criteria of , and is consistent with, the Land Development Code and the Comprehensive Development Master Plan, for a use which is permitted in the Industrial Liberal (1-2) zoning district; and WHEREAS, the application was approved by the Planning Council on January 7, 2014, with special conditions; and WHEREAS, the City Commission of the City of Opa-locka desires to approve the final site plan submitted by Jose Polo, the applicant, for an industrial storage lot, with special conditions. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka hereby grants final site plan approval, with special conditions as set forth herein, to the application by Jose Polo for an industrial storage lot, located at 13180 NW 31st Avenue, described as Folio No. 08-2128-004- Resolution No. 14-8780 0461, as per the recommendation of the Community Development Department, subject to the following special conditions: 1. The property must be served by sanitary sewer and water; 2. Any future signage must comply with the City sign ordinance; 3. All trash and garbage containers shall comply with City dumpster enclosure requirements as shown in the site plan; 4. Applicant must pay all required development impact fees; 5. Landscaping must be provided as shown in the site plan; 6. All storage yards for materials or company vehicles must be completely screened from off-site view by a masonry decorative block wall, at least six feet high, acceptable to the City; and 7. The Masonry wall will have to be in place, and approved by the City, and the existing chain link fence removed,before the business operation commences. Section 3. This resolution shall take effect immediately upon adoption. J.Polo Final Site Plan Review Description: On May 22, 2012 the applicant submitted an application for Final Site Plan Review. After staff review,the applicant's site plan was not found compliant with the City's Land Development Code requirements for the Liberal Industrial (1-2)zoning district. The applicant was provided with corrective comments to address site plan deficiencies on May 22,2012. On July 22, 2013 the applicant provided final corrections to his site plan. Staff reviewed this site plan and found it compliant with the City Land Development Regulations within the liberal industrial district(1-2). This item was scheduled for a September public hearing before the Planning Council, however the meeting never convened because there was not a quorum. Ordinance 13-28 reestablished the Planning Council on September 26,2013. Proposed Action: Staff recommends approval of the applicant's request for final site plan with the following conditions: 1. Analysis: The site plan meets the requirements of the Land Development Regulation, article 4.4, article 6.11, article 6.10, article 8 for parking, and article 9 for landscaping. Financial Impact: There is no financial impact to the City to approve this site plan and allow the operation of an industrial storage lot in this 1-2 zoning district site. The property is under the I-2 zoning and is located at the corner of NW 131 Street and the now open to traffic NW 31 Avenue. In 1992,this property was in a very deplorable condition inside the Nile Gardens industrial area.It was surrounded by illegal dumping debris(especially tires,furniture,etc.).The NW 31 Street was closed out between NW 131 street and NW 132 terrace with earth berms at both ends and within this area you could find the unimaginable. You could find any type of illegal dumping debris within this closed area abandoned boats and cars,truck loads of tires,construction debris,including a motorhome vehicle,where for years,a few unfortunate people used it to sleep in and in some instances drug users used to hang around. Since the acquisition of this property,I had cleaned it,graded it,fenced out,and used it for storage as permitted by the zoning. It was an improvement from the previous days,even though NW 31 street still remained closed out and full of garbage for several years beyond that improvement date. Then,not to long ago,NW 31"avenue was cleaned out and opened to traffic.What a relieve that was.Most of the garbage and drug businesses were gone!The property started to come alive and showed some eye appealing.We still have some issues,NW 31 avenue from NW 131 Street to NW 132 terrace is now opened to traffic but after every rain the street becomes a river.The flooding of the street needs to be worked out. Hopefully this can be resolved soon. Over the years,some change and progress has occurred but more is needed. Members in attendance were Chairman Calvin Russell, Councilman Elio Guerrero, and Councilwoman Leslie Dennis, Councilwoman Oria Rodriguez and Councilwoman Rose Tydus. Also present were Assistant City Attorney Steve Gellar, Community Development Director Howard W. Brown, Jr., Zoning Official Gerald J. Lee, City Planner Bhairvi Pandya and Executive Secretary Peggy Castano. II INVOCATION AND PLEDGE: Was stated immediately after roll call. III APPROVAL OF MINUTES: July 23, 2013 Upon roll call, the minutes passed 5-0. PUBLIC HEARINGS: a) JOSE POLO 13180 NW 31 AVENUE, OPA-LOCKA, FL 33054 South 209 feet of North 295 feet of West 160 feet of East 185 feet, of Tract 28, "NILE GARDENS SECTION 2" according to the Plat thereof, as recorded in Plat Book 31, page 42 of the Public Records of Miami-Dade County, Florida. Section 28 and 29 Township 52 South, Range 41 East. ZONED I (FOLIO 08-2128-004-0461) REQUEST: FINAL SITE PLAN APPROVAL Mr. Brown opened the public hearing by stating his name, position and department. Mr. Brown also introduced the Zoning Official Mr. Gerald Lee, Executive Secretary Ms. Peggy Castano, and the new City Planner Bhairvi Pandya. Mr. Brown proceeds to provide the Planning Council with a brief history of the property site and also explains that Mr. Polo has been in business with the City of Opa-locka for many years. Mr. Brown asks Mr. Lee to further explain the request he then proceeds to the power point presentation. The power presentation begins with a city aerial map to make sure everyone in the planning council meeting will know the specific area and property in question. The reason Mr. Polo was before the planning council was because he submitted an application in May of 2012 and staff reviewed the site plan which was not compliant with the City LDR within the liberal industrial district (I-2) The applicant was provided with corrective comments to address site plan deficiencies. The applicant provided final corrections to his site plan. The Community Development Department reviewed the site plan and found it to be in compliance with the City LDR within the liberal industrial district (I-2) At this time Community Development Department recommends approval of the site plan with very specific conditions like the following: • The property must be served by sanitary sewer and water. • Any future signage shall comply with city sign ordinance. • All trash and garbage containers shall comply with city dumpster enclosure requirements as shown in site plan • Must pay all development impact fees. • Landscaping must be provided as shown in the site plan. (Property is currently fenced) Mr. Polo came up to the podium to explain the purpose of the site plan approval and the long process he has endured to get the approval of the city. The Planning council for The City of Opa-locka recommends approval to the City Commission to approve the final site plan for Jose Polo. Roll call motion passed 5-0 Elio Guerrero - Yes Leslie Dennis - Yes Calvin Russell - Yes Oria Rodriguez - Yes Rose Tydus - Yes b) 3400 NW 135TH STREET, BUILDING B, OPA-LOCKA, FL 33054 CITY OF OPA-LOCKA COMMUNITY DEVELOPMENT DEPARTMENT REQUEST: AN ORDINANCE OF THE CITY OF OPA-LOCKA, OPA-LOCKA, FLORIDA, PROVIDING COMPREHENSIVE REVISIONS TO CHAPTER 17, PLANNING AND DEVELOPMENT, ARTICLE III, SUBDIVISION AND PLATTING CODE, OF THE CITY OF OPA-LOCKA, CODE OF ORDINANCES; TO PROVIDE A PROCESS FOR VACATING STREETS AND ALLEYS— GENERALLY; PAYMENT OF COSTS, EXPENSES; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. Mr. Brown explains to the Planning Council that the City currently has no regulations that govern this process. The Community Development Department researched our neighboring cities to quickly realize they all have current ordinances that deal with this matter. Mr. Lee and Mr. Brown expressed the importance of such ordinance to be in place. The City currently has no regulations that govern this process. When the city's charter was repealed and replaced with the new charter in November 2012, these procedures were repealed in its entirety.
