DETERMINATIONS, DECLI~RING NO 1~/IA.JORITY PROTEST, ORDERING IMPROVEMENTS, AND . LEVYING ASSESSMENTS IN THE MATTER `OF LYNWUOD STREET LIGHTING DISTRICT NOo 2 .WHEREA,S, this City Council on the second day of h/Ia.y, 1972, adopted Resolution No. 72-57 approving the Debt Limit Report prepared pursuant to, the Special Assessment Investigation, Lixx~itation and Majority Protest A.ct of 1931 and fixing the 20th day of. June, 1972, at the hour. of J 7:30 P. M. in the Council Chambers of this City Council. as tl~.e time and place for holding a hearing on said Report; and WHEREAS, after notice duly given and at the tixxze encl. place fixed in said Resolution No. 72-57 a'hea.ring was duly held by this ~~ity ' Council at which all written protests or objections, if any, were duly presented and` read and all persons desiring to be heard. on the report were heard; and WHEREAS, protests were not made by the owners of mox•e than one-half of the area of property to be assessed for th.e work or improvement proposed in said report and this City Council adopted its. Resoluti.~an No. 72- ,making certain.determinatiori; and - -.-< ~ -_WHER,EA,S,--this City. Council, has, by F~esolution No. 72-55, declared its intention .pursuant to the Street Lighting A,ct of 1919 Plan- Division 14 of the Streets. and Highways Code of the State of California, to form Lynwood Street. Lighting District No. 2, for the installation of certain street lighting improvements and 'appurtenances and a.11 appurtenance work in connection therewith, in accordance Plan 1972.--D on file in the office of the City Engineer, and the service and maintenance of thk~ street lighting systems in said City, including the annual maintenance: and. energy costs on certain Edison Company facilities as well as certain City fa~ilit.ies and' the installation of certain standards and fixtures; and WHEREAS, by Resolution No. 72-55, this City Council has approved a report prepared by the City Engineer under and pursuant to the Street Lighting Act of 1919 and, in particular°, Sections 113,040 dnd 1$041 of the California Streets and. F3'ighways Code; and WF3EREAS, said report contains, among other tr,~ing;s, plans a,nd specifications for the said work and improvements, estix~zate of the cost of said work .and. improvements, a diagram showing the assessxxient district and the boundaries and dimensions of the respective lots or .parcels of land within the assessment district, and a proposed. asses;~ment of the total amount of the costs and expenses of said work, or improsre:~ents upon the several lots or parcels of land in the, assessment district in proportion to the estimated benefits to be received by such lots or par~c:e~1s,, respectively, from the said work or improvements; and WHEREAS, in said Resolution Noe 72--55 said City Council fixed June 20, 1972, at the hour of 7:30 P. M, at the meeting place of said City Council, in the City I3aa,1, 11330 Bullis Road, Lynwood, California, as- the time and place of. hearing protests and objections to the wor°.k or irrip:cove- merits proposed in said reports .to 'be made, the extent of the assessment district proposed to be'created and/or tq the proposed assessment; and . WHEREAS, the Clerk. of said City has given the notices of the passage of the Resolution of Intention, Resolution Noo 7255, and of the filing of the report, and of the time.and place and purpose of said hes,ring, all as required by the Street Lighting A`ct of 1919; and WHEREAS, said City Clerk has filed with this City Council her affidavit setting forth the time and manner, of the compliance with the requirements of the Street Lighting A.ct of 1919 for publishing, posting, and mailing of said notices; and WHEREAS, at the time and place stated in said notices, a hearing was duly held by this City Council.at sxrhich meeting said report was duly presented and considered, and all written protests and objections received; if any, were duly presented, read, heard, and considered, and all persons appearing at said ,hearing and desiring tq be heard in the matter of said report were .heard, and a full, fair and complete hearing has been held and this City Council is fully informed in the premises, and WHEREAS, this City Council has examined and considered. the assessment proposed in said report and proceedings prior thereto, and the evidence presented at said hearing; and WHER;EA.S, all protest and objections, written and oral, made or filed in the 'matter of said. report or said .assessment have been overruled _, and denied,. i NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY, RESOLVE, DETERMINE A.ND ORDER A.S FOLLOWS: Section, 1. That said hearing has been duly held and notices thereof duly given as set forth in the recitals hereof,. and each and every step in the proceedings prior to and including the hearing has been dt;.ly and regularly taken. . Section 2. That all persons at said hearing were given tike opportunity to be heard on the extent of the assessment district, 'the work, and the assessrizents. The assessment district designated'"Lynwood Street Lighting District No. 2 ", with the exterior boundaries as shown on the map showing "Proposed Boundaries of Lynwood Street Lighting District No. 2", recorded in the office: of the County Recorder, County of Los Angeles, California, in Book of Maps of Assessment Districts, is hereby ordered formed.. The report and assessrrient diagram prepared by the City Engineer and filed with the City Clerk are hereby approved and confirmed. Section 3. That all protests and objections, written and -oral, made or filed. in the matter of said report and. or assessment contained there- in have been and are hereby overruled and denied. ,. .Section 4. -That the amount of the assessments shown. in said report should be, and the same hereby is, confirmed and .firmed. Section 5. That the amounts to be assessed against the: individual parcels show~.on the assessment dagra~rn contained. in said report are hereby approved and confirmed, and the City Clerk of the City is hereby directed to endorse the fact and date of such approval on said reporto Section 6. That the work or improvements referred to in said report are hereby ordered to be made. . Section 7.
