RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD SETTING FORTH THE SALARIES BY CLASSIFICA TION OF ITS OFFICERS AND EMPLOYEES, AND OTHER BENEFITS BE IT RESOLVED by the City Council of the City of Lynwood as follows: Section 1. That Resolution No. 62-43 of the City of Lynwood adopted the 3rd day of July, 1962,. prescribes thetime and method. of paying salaries ,and wages of the officers and employees , of said City, as required by Section 3720.6 of the Government Code of the State of California. Section 2. That the salaries and wages for officers and employees for the various classifications falling within .the schedules, included herein, effective at rtthe beginning of the first regular pay ' period subsequent to the adoption ofthis resolution, are as follows: A.. Page 5 Standby pay is determined to be a flat-rate payment for performance of all typical service and routine standby functions. Where emergency tasks develop requiring call-in of additional personnel to assist the standby man in emergency functions, all personnel including the standby man shall be paid at straight time rate during the period of such work. Should situations develop where the standby man is not required to assist in these emergency operations but continues to perform his normal standby functions, such shall be accomplished under the basic flat-rate pay program. A public works standby shift for all working days is hereby fixed as a duty period extending from 4 p. m..to 8 a, m. of the following day. From 8 a, m, on Saturdays, Sundays and holidays to 8 a. m. of the following day shall be considered as two (2) standby shifts. All employees during the period they are scheduled for such duty shall perform such services as may be designated by their respective Superintendents, Foremen, or the City Manager, and shall be available at all times during the duty shift for- emergency work. No overtime credit shall be accrued to employees working standby shifts. A police detective standby schedule is hereby fixed as any continuous seven-day period wherein a police detectivelis on emergency call to provide investigative assistance. ,All detectives during the period they are scheduled for such duty shall perform such services as may be designated by the Chief • of Police, Watch Commander, or Detective Lieutenant, and shall be available all times during the duty schedule for emergency work. . _i v • RESOLUTION NO. However, where circumstances s o warrant, appointment may be made at other than the first step, or after a ppointment, an intermediate step may be skipped when recommended by the City Manager. Increases • throughout the remainder of the steps shall be given upon recommendation of the department head and approval of the City Manager, until the highest or top step is reached. Salary increases, over and above the top step, shall be granted police officers through the rank of Lieutenant upon receipt of an "Intermediate" or "Advanced" POST certificate. H. UNIFORM AND CLOTHING ALLOWANCE A. Uniformed Police Officers shall supply their initial complements of uniforms at their own expense. Thereafter, the City will furnish annually, during each fiscal year, to each uniformed officer, one replacement uniform. Such uniform consists currently of a summer shir. t, a winter shirt, and a pair of pants, but the city reserves the right to determine and change the uniform for uniformed officers. Uniformed officers shall receive a jacket as a replacement of initial equipment on the basis of necessity upon the determination of the • Chief. of Police. The detectives shall receive annually a clothing allowance of fifty dollars ($50) for each Fiscal Year. The existing policy concerning the replacement of damaged uniforms and clothing is not char;.gF=d by the provisions of this section. B. Page lY at the end of any monthly period shall be compensated for by payment therefor in the next succeeding regular bi-weekly payroll check. If the said written election to take compensating time off for overtime in lieu of straight time pay is not on file with the department head before the expiration of said monthly period, the employee shall be deemed to have wa.i~aed his right to take compensating time off for said overtime and he shall be paid straight time therefor as hereinabove set forth. Nothing herein contained shall prevent the said employee from requesting full payment f.or all overtime on a straight time basis on the • books of the city to the credit of said employee, irrespective of previous notices of election to take compensating time for overtime in lieu of. straight time payment. All such requests shall be made in writing to the department head and such overtime shall be compensated for in the next succeeding regular bi-weekly salary check for said employee, pro- vided, however, that said employee shall have no right to straight time payment or other payment for overtime accumulated prior to July 2, 1968. Upon payment for overtime for whatever reason, the City Treasurer shall forthwith notify the City Manager and the department head the number of hours that have been compensated for by payment and the depar. tmerit head shall, upon receipt of said notice, forthwith remove the accumulated overtime thus compensated from the records of the department. RESOLUTION NO. Page 12 Resolution Not Retroactive. Nothing contained in this resolution shall apply to any overtime whatever accumulated on the books of the City to tYie credit of any classified employee before July 2, 1968. Awarding of Compensating Tirrie for Overtime Discretionary. Whether or not compensatory time off shall be given to the employee and at what tune and over what periods shall be within the discretion of the department heard. Eligibility for Overtime. The overtime provisions of this resolution shall include classified employees below the rank of Police Captain, Fire Captain, and Superintendent, Those employees who, by virtue of the provisions of this resolution, receive compensation over and above the basic five-step salar. y schedule during the time they are assigned to duties specified in this resolution, except employees of the street and water departments on "standby shift, " shall be entitled to the same benefits of. and shall be subject to the same limitations and conditions of this resolution as other classified city employees, Reasonable Discretion Defined, As used in this resolution, "reasonable discretion" is defined as the exercise of that kind of judgment. as will accord to each employee within a given category, fair and equal treatment, having due regard for the public health, safety, and general welfare. • ~ _' } RESOLUTION NO. Page 13 Prior to disability retirement, service retirement, or death of the employee, compensatory time off, or in the case of death, straight time pay, for all accumulated overtime accrued subsequent to March 15, 1966, shall be granted. This provision does not apply to voluntary termination or termination for cause. Section 4. Premium Pay. To encourage employees in undertaking outside study to the end that they may perform their duties in a more efficient manner, a system of permium pay, over and above established pa.y schedules, is hereby established. Premium pay is allowable for completed courses of approved sub- jects at accredited schools, and is fixed at $1.00 per month for each semester hour of work satisfactorily completed by the employee with a gr. ade of "C" or better. Maximum pay is fixed at $40 per month. Police Officers, upon receipt of a. salary increment as a result of attaining an Intermediate or Advanced POST certificate, shall cease to receive any premium pay accrued prior to the effective date of the above described incr. ement. Said police officers may begin anew to undertake outside studies as herein described and shall receive premium pay for acceptable courses undertaken subsequent to the receipt of the Intermediate or Advanced POST Certificate up to the maximum pay of $40 per month. ~' • A semester hour. is defined as on.e hour of classroom work per I week for one semester of 18 weeks, plus necessary outside study. All -- RESOLUTION NO. Page 14 All courses of study must have prior approval by the department head and City Manager in order to receive premium credit. Accredited schools are herein defined as colleges, junior colleges, or universities, or such other institutions as may be approved by the City Manager, Suitable written certification from the school: showing satis- factory completion of each course shall be submitted to the Personnel Officer for personnel records. Premium pay will commence the first pay period after the first of the month following the submission of the written certification. The City will contribute 50% of the cost of tuition over $10 where the cost of such tuition exceeds the sum of $10 per semester course_ while the employee is accuring the $40 per month, maximum pay. The provisions of this section do not apply to hourly employees or employees undertaking an approved course during a regular work day or assigned shift. Section 5. Longevity Program. A longevity program is hereby established for Miscellaneous, and Police personnel, excluding Management employees, as follows: 1% of base salary at the end of seven (7) years of service; an additional 1% of base salary at the end of twelve (12) years of service; and an additional 1% of base salary at the end of seventeen (17) years of service. In ,order to receive the above noted .longevity pay, an employee must demonstrate . ~ _. RESOLUTION NO. Page 15 • an interest in City service beyond straight longevity. Employees in the Police Department must obtain either an Intermediate or Advanced P. O. S. T,' Certificate prior to receiving longevity pay. Miscellaneous employees must be receiving educational incentive pay or have received a promotion since employment with the City prior to receiving .longevity pay. Section 6. Action Supervisory Compensation, A.t such time as a Miscellaneous or Police supervisory position becomes vacant for reasons of sick leave, leave of absence or injury on duty status, for a period exceeding thirty days., then the employee replacing said supervisor shall receive compensation at a rate. equal to the "A':' step of the rate of the supervisory position or sudh step in that range next higher than that rate which the officer is currently receiving. Such additional compensation would commence on the thirty-first day and would continue until such time as the supervisor returns to work. The employee performing those duties as designated in this Section shall be selected by the Department Head, Section 7. Employee's Insurance Coverage. The City will contribute the employee's share toward any health insurance, accident insurance, or life insurance policies which the City Council agrees to provide. If desired, the employee may obtain coverage for members of his family. Such premium shall be borne by the employee and .payment will be made by payroll deduction. .. . ~ :' .. ,. ,ti.. Page 16 Section 8, Nothing herein contained shall be construed in any way as affectived Personnel Ordinance No. 671 of the City of Lynwood, or the Rules and Regulations adopted pursuant thereto. Section 9. This resolution shall be effective at the beginning of the first x•egular pay period following adoption of this resolution, and Resolution Number 71-~2 ~.s hereby repealed.
