Member John Ferris introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO. 95-18
RESOLUTION GRANTING CONDITIONAL USE PERMIT
REGARDING ACCESSORY STRUCTURE TO JENNIE GOELZ
WHEREAS, Jennie Goelz (Applicant) has requested permission to construct an addition
to the existing accessory structure on the property located at 2325 Hamel Road; and
WHEREAS, the Applicant's property currently contains one accessory structure having
2,784 sq. ft. and the addition of 560 sq. ft. will result in an accessory structure with a total of
3,344 sq. ft.; and
WHEREAS, the city's zoning ordinance requires a conditional use permit on property
over three acres in size in order to have an accessory structure which exceeds 3,000 square feet;
and
WHEREAS, this matter was reviewed by the planning commission at its meeting of April
11, 1995, and by the city council at its meeting of May 2, 1995; and
WHEREAS, it has been determined that the proposed addition to the accessory structure
on the property will not impede the normal and orderly development of adjacent lands for
purposes for which they are zoned.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that a conditional use permit be granted to the Applicant for the stated purpose,
subject to the following conditions:
1. The total area of the accessory structure shall not exceed 3,500 square feet;
2. The Applicant acknowledges that the expanded accessory structure shall be for
Applicant's personal use and shall not be used by the Applicant in connection
with any commercial activity on the property;

3. The accessory building may not be rented or leased by the Applicant to a third
party;
4. The Applicant agrees to remove manure from the property in accordance with the
requirements of the city and the Minnesota pollution control agency; and
5. The Applicant must pay the city an administrative fee in the amount determined
by the staff to represent the actual cost to the city of reviewing this application.

The motion for the adoption of the foregoing resolution was duly seconded by member
Philip Zietlow and upon vote being taken thereon, the following voted in favor thereof:
Ferris, James Johnson, Ann 'Thies and Zietlow.
and the following voted against same: None.
Absent: Mayor Anne Theis.
Whereupon said resolution was declared duly passed and adopted.
