September 27, 1983
The Council of Bal Harbour Village met Tuesday, September 27, 1983
at 9:30 A.M. in the Village Hall.
Present: Mrs. Antiles and Messrs. Laikin, Sherman and Taplin
Absent: Mr. Printup
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and Alan S. Gold, Village Attorney.
On motion of Mrs. Antiles the minutes of the budget hearings of August 16,
August 30 and September 13, 1983; and council meeting of August 30, 1983 were
approved as submitted.
The Village Clerk read the Budget Ordinances for the 1983-84 Fiscal Year
in full.
On motion of Mrs. Antiles, seconded by Mr. Taplin and voted
Ordinance No. 250
adopting the General Fund Budget was adopted.
Ordinance No. 251
adopting the Water Department Budget was passed on motion of Mr. Taplin, seconded
by Mr. Laikin and voted.
On motion of Mr. Taplin, seconded by Mrs. Antiles
Ordinance No. 252
adopting the Sewer Department Budget was adopted on motion of Mr. Taplin,
seconded by Mrs. Antiles and voted.
On motion of Mr. Laikin, seconded by Mrs. Antiles and voted
Ordinance No. 253
adopting the Department of Tourism was adopted.
Mr. Sherman explained that Mr. Maley has completed negotiations with the
Good Shepard Lutheran Church for use of their premises during a hurricane evacua-
tion of Bal Harbour. Mr. Maley read the Agreement in full which st&.es in part
that the village will pay the church $1,000 annually for two years and an
additional $1,000 for each 100 residents using the shelter during an evacuation.
The village will name the Church as an additional insured under our liability
policy. Discussion followed on how many people might use the facility and methods
of transportation used to bring the people to the shelter. Chief Staubesand
said that the City of Miami Beach will loan us cots. On motion of Mr. Laikin,
seconded by Mrs. Antiles and voted, Mr. Maley was authorized to sign the agree-
ment.
The Council discussed the proposed 1983-84 Collective Bargaining Agree-
ment with the Dade County Police Benevolent Association. Mr. Maley said the
new contract provides for an 8% salary increase for this year; the education
benefit has been increased to $750 per year for one-half tuitionreimbursement;
$100 will be contributed toward the cost of individual flack jackets; and
disciplinary action would be submitted to a binding arbitration committee
following set grievance procedures. On motion of Mr. Taplin, seconded by Mrs.
Antiles the agreement was approved.

The council discussed the status of litigation regarding former
police officer Sidney Marcus. On motion of Mr. Taplin, seconded by Mrs.
Antiles and voted it was agreed that the Village would offer to settle the
case with Mr. Marcus for a sum not to exceed $12,500. Mr. Gold said that
if the settlement is accepted that the village get a waiver for all future
claims as part of the settlement.
Mr. Maley said that he has two names to submit as the Bal Harbour rep-
resentatives to the Surf-Bal-Bay Library Board. Mr. Samuel Dermer, and
as alternate, Mary Wetterer. On motion of Mr. Laikin, seconded by Mrs.
Antiles and voted the persons were appointed.
Mr. Sherman and Mr. Maley reviewed the status of the newsracks in the
village. After the first USA Today racks were placed in the village,
numerous others from different publishers appeared. Some are not stocked,
and after contacting the publishers, they still are not complying with
the intent of the ordinance which was tabled. It was decided that due to
non-compliance with our requests, that formal action should be taken. Mr.
Gold read a proposed ordinance regulating the placement of newsracks on
public property by title only. On motion of Mrs. Antiles, seconded by Mr.
Laikin, and voted the ordinance was passed on first reading. Mr. Maley
said he would notify the company publishing the Real Estate bulletin to
remove their rack.
The council reviewed the eleven months operating statements.
Mr. Maley explained the process of transferring funds between depart-
ments to balance the departmental budgets at the end of the fiscal year.
Miss Wetterer requested the following transfers: $1,500 to Department 512:
(Executive); $3,500 to Department 513 (Finance); $1,000 to Department 539
(Open Space). The total of $6,000 is to be taken from Department 521 (Police).
On motion of Mrs. Antiles, seconded by Mr. Taplin and voted the transfers
were approved.
Mr. Sherman said that Mr. Printup has resigned from the Board of
Directors of the Florida League of Cities, creating a vacancy from this
Congressional District. Dr. Haas from Bay Harbor Islands is seeking the
position. On motion of Mr. Taplin, seconded by Mr. Laikin and voted
Resolution No. 287
endorsing Dr. Haas was adopted.
Mr. Sherman reported that Bal Harbour Shops have offered to donate
their 55' Christmas Tree to the village.
Mr. Maley said that our Building Inspector, George Desharnais, a
licensed contractor, is making some changes in the proposed public works
facility, and if we take our own bids possibly the building could be built
at a reasonable cost. He will report at the October meeting.
Mr. Sherman advised that he had spoken to Mr. O'Leary, our landscape
design architect, who said he would make provisions for wiring for the
large Christmas tree. Mr. Maley said that Mr. O'Leary had been apprised
of the Resort Tax Advisory Committee's needs and will bring schematics to
the October meeting. It was suggested that a workshop meeting be held with
Mr. O'Leary as soon as possible.

Mr. Maley reported that the village will be buying two new garbage
trucks at a cost of over $50,000 each. The money has been provided
yearly by transfers to the Trust Department for this purchase.
Mr. Maley said that Shutts and Bowen, attorneys for the Great Lakes
Dredge and Dock Co. litigation, have advised that they will write off $63,000
in unpaid legal fees. The council accepted their offer.
Mention was made of the articles in the Miami Herald reporting on how
bad tourism is in Dade County. It was the council's opinion that something
should be done to refute these articles concerning Bal Harbour. Mr. Sherman
said that the Sheraton Hotel has arranged a meeting with the advertising firm
of Beaver, Silverman, and Mr. Gutenstein would like the Resort Tax Advisory
Committee, Mr. Maley and any of the council, to attend. Mr. Sherman said
he had asked Dade County to set up a two day conference to analyze and re-
commend solutions to the tourism problem.
On motion of Mr. Taplin, seconded by Mr.,.I,ikin, and voted the
meeting was adjourned at 11:25 A.M.

October 25, 1983
The Council of Bal Harbour Village met Tuesday, October 25, 1983 at 9:30 A.M.
in the Village Hall.
Present: Mrs. Antiles and Messrs. Laikin, Printup and Sherman
Absent: Mr. Taplin
Also present were Fred W. Maley, Village Manger; Mary T. Wetterer, Village
Clerk; and Alan S. Gold, Village Attorney.
On motion of Mrs. Antiles, seconded by Mr. Printup and voted the minutes
of September 27, 1983 were approved as submitted.
Mr. Jack Taplin, manager of the Harbour House Apartments appeared to
request a non-use variance to place two micro -wave antenna dishes in the
front set back area of Tract E, Bal Harbour Ocean Front Addition. Dis-
cussion took place on the possibility of a roof installation, alternate
ground sites, and the setting of a precedent for other requests. It was
moved by Mr. Laikin, seconded by Mrs. Antiles and voted that the Village
Building Inspector, Mr. Desharnais, and Mr. Maley review the situation and,
if necessary, the council would conduct a special meeting in two weeks to
October 25, 1983
