RESOLUTION NO. 72-108
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
AUTHORIZING AND DIRECTING THE CONDEMNATION OF CERTAIN
REAL PROPERTY IN THE COUNTY OF LOS ANGELES, STATE OF
CA LIFORNIA AND DECLARING THE PUBLIC NECESSITY THEREFOR
WHEREAS, the City of Lynwood is authorized by virtue
of 'the Statutes of the State of California to take property by condemnation
and t~o hold, use and enjoy said property as necessary to the full exercise
of its power,
NOW, THEREFORE, the City Council of the City of
Lynwood hereby does resolve as follows:
SECTION 1. .The City Council of the City of Lynwood has
--- found and determined and does hereby -find and' determine that the public
interest and necessity require for public use the acquisition, construction,
completion, operation and maintenance by said City of Lynwood of
certain public improvements, to wit: street right of way purposes in
fee simple absolute, and that certain real property situated in the City
of Lynwood, County of Los Angeles, State of California, is necessary'
therefor.
SECTION 2. The real property, the acquisition of which is
required for the public interest and necessity .for the uses and purposes
set ~ forth in Section 1 hereof, is situated in ~ the City of Lynwood, County
of Los Angeles, State of California, 'and is more particularly desc~'ibed
as follows:
Lots 226, 227 and 228 of Tract No. 2551, in the City of
Lynwood, in the County of. Los Angeles, State of California,
as per map recorded in Book 24. Pages 78 and 80 of Maps,
in the Office of the County Recorder of said county.
Except therefrom all oil, gas and other mineral rights in
and under said property together with the exclusive right
to use such portion of ,said property lying more than 500 feet
below the surface thereof for the extraction of oil, gas
and minerals from said property or property in the
vacinity thereof; however, with no right of surface entry
whatsoever, _ as reserved and excepted in deed recorded
November 21, 1962, in Book D-1830 Page 16, Official
Records, as Instrument No. 2511.
SECTION 3. Said public improvement is planned and located

SECTION 4. The law firm of Rutan and Tucker, attorneys
in, the manner which will be most compatible with the greatest public
good and the least -private injury.
for the City of Lynwood, is hereby directed to bring an action in the
Superior Court of the State of California in the name of the City of
Lynwood, to oondemn for eminent domain proceedings the .property
described in Section 2 hereof. Said attorneys are authorized and in-
structed to make. application to said Court for an Order fixing the amount
of security by way of money deposits as said Court may direct and for
an Order permitting the City of Lynwood to take possession and use of
said real property for the uses and purposes herein described.
SECTION 5. For the purposes of bringing such an action,
the firm of Rutan and Tucker is hereby empowered to incur, in the name
of the City of Lynwood, all obligations and expenses incidental thereto.

Lynwood at a regular meeting held on the 8th day of November
