CITY OF MEDINA
RESOLUTION NO. 95-23
RESOLUTION GRANTING A VARIANCE FOR JAMES OTIS
AND TRACY OTIS
WHEREAS, in 1987. James Otis and Tracy Otis (the "Applicants") received permission
from the City of Medina for a setback variance to construct a 12' x 12' deck 18 feet from their
rear property line at their home at 500 Ridgeview Circle, which property is legally described as
Lot 4, Block 2, Lutz Elm Creek, Hennepin County, Minnesota; and
WHEREAS, the Applicants have requested another variance to expand the deck to 12'
x 26'; and
WHEREAS, section 826.35 of the city's zoning ordinance requires all structures in the
urban residential district to maintain a minimum rear yard setback of 30 feet; and
WHEREAS, the planning commission and city council have considered this matter and
have determined that it is not likely that granting this variance will have a detrimental effect on
the development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that the Applicants request for a variance to reduce the required rear yard setback
from 30 feet to 18 feet to construct an addition to their deck is granted, subject to the following
conditions:
1. The only structure which may be constructed pursuant to this variance is an
expansion of the existing deck, which shall not exceed 26' x 12' when completed;
2. The Applicant shall pay to the city an administrative fee in an amount sufficient
to reimburse the city for its costs of reviewing this application; and

3. This variance shall be valid for a period of one year from the date of adoption of
this resolution. Failure to construct the deck expansion or to seek an extension
of time for the variance within said period will render the variance hereby granted
null and void.
BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota that
the hardship justifying the granting of this variance is the fact that the lot is double fronted.

The motion for the adoption of the foregoing resolution was duly seconded by member James
Johnson and upon vote being taken thereon, the following voted in favor thereof:
John Ferris, Johnson, Thies, and Mayor Anne Theis.
and the following voted against same: None.
Absent: Philip Zietlow.
Whereupon said resolution was declared duly passed and adopted.
