HomeMy Public PortalAbout1995-029Member John Ferris introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 95-29 CONDITIONAL USE PERMIT FOR WOODRIDGE CHURCH WHEREAS, Woodridge Church (the "Applicant") has requested permission to build a church on property located at 1432 County Road 24, which land is legally described on Exhibit A attached hereto (the "Subject Property"); and WHEREAS, the Subject Property is zoned rural residential; and WHEREAS, Medina's zoning ordinance requires a conditional use permit for a church in the rural residential district; and WHEREAS, this matter was reviewed by the planning commission at its meetings of May 10, 1995 and June 13, 1995; and WHEREAS, the city council considered the Applicant's request at its meetings on June 6, 1995 and July 5, 1995; and WHEREAS, the city council has determined that the Applicant's proposal to construct a church on the Subject Property will not impede the orderly and normal development of adjacent lands for purposes for which they are zoned. NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Medina, Minnesota, that a conditional use permit to construct a church on the subject property shall be granted to the Applicant, subject to the following conditions: 1. The driveway must be located west of the tree line near the house, as shown on the site plan dated June 13, 1995, but not located on the portion of the Subject Property reserved under the life estate; RME91698 ME230-214 1 2. The driveway and parking lot must be constructed to city standards in accordance with the recommendations of the city engineer; 3. The driveway and parking lot must be graded with all base materials in place and approved by the city engineer before a building permit may be issued for construction of the sanctuary; 4. No parking will be allowed on County Road 24 or on the driveway leading to the parking lot. No parking signs must be installed in accordance with the instructions of the fire marshall; 5. Additional evergreens (minimum height of 6 feet) must be installed at the west and east lot lines to block the view of the church and the parking lot from neighboring properties. A berm and additional plantings must also be provided to screen the church and parking lot from the view of the neighbor to the west; 6. Additional landscaping must be installed within the parking lot to breakup the visual effect of the lot and additional plantings must be made on the east side of the septic area; 7. All landscaping and all areas not covered by hardcover must be seeded and maintained. Landscaping must be installed in accordance with the requirements of the zoning administrator. All landscaping must be well maintained and plant materials which die must be replaced; 8. All exterior lighting must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property or public right-of-way. The lighting must be installed in accordance with the plan submitted by the Applicant and with the recommendations of the city staff. Artificial light contribution at the property lines must be limited to zero foot candles; 9. Security lighting shall be controlled by a light sensor. All other exterior lighting must be placed on a timing device. No exterior lighting shall be permitted when the building is not in use other than the exterior security lighting. Egress lighting shall average .5 foot candles power; 10. The Applicant agrees that if the entrance driveway to County Road 24 becomes a problem in the future, the Applicant will take corrective action. The City will determine if there is a problem and evaluate the appropriateness of the Applicant's proposed corrective action; 11. All garbage or trash containers must be located inside a permanent enclosure on a concrete pad with an exterior material compatible with the masonry construction of the sanctuary building; RHB91698 ME230-214 2 12. All mechanical equipment, including all roof top mechanical, must be screened from view from adjacent parcels; 13. The building may not exceed the height limit of the zoning ordinance for structures within the rural residential district; 14. The building must be constructed in accordance with Minnesota state building code; 15. All plans for the building must be approved by the fire marshall; 16. All plans must be reviewed by the Medina chief of police; 17. There shall be no outside telephone bells, speakers or amplified sound systems; 18. The buildings and the grounds shall be used only for church -related activities. Special events will require a special use permit, even though they are sponsored by the Applicant; 19. Erosion control must be in place prior to any grading activity on the site and must be maintained throughout the period of construction; 20. The storm sewer must be constructed in accordance with city standards; 21. The Applicant must obtain permits and approvals from Hennepin County, the MPCA, the city of Medina and the Minnehaha Creek Watershed District for any measures regarding storm water and wetlands; 22. Wetland top soil must be salvaged and respread around the ponding area to the depth of 4 inches after the soil has sufficiently dried out; 23. The sediment pond depth at the outlet must be monitored annually. When the depth has decreased below 4 feet, the pond must be dredged out by the Applicant. The Applicant must review this and report to the city; 24. The Applicant must provide standard drainage and utility easements around the perimeter of the Subject Property (10 feet in width along Co. Rd. 24 and 5 feet in width elsewhere) and a drainage easement over the wetlands; 25. All septic sites must be fenced and protected prior to beginning of grading or construction; 26. The Applicant must install a stop sign at the intersection of the driveway and County Road 24; 27. Parking stalls must be constructed to meet city ordinance requirements and are limited to no more than 200; RHB91698 ME230-214 3 28. Exterior buildings materials must meet city code requirements; 29. The building must be constructed in accordance with the plan submitted to and reviewed by the city and specifically may not exceed 16,000 square feet in area; 30. There may be no permanent residential use of the facility; 31. Any sign constructed must meet city ordinance requirements; 32. This conditional use permit may be reviewed annually or as needed to insure compliance with all conditions set forth herein. Violation of any term of this conditional use permit may result in the imposition of additional conditions or in revocation of this conditional use permit; 33. A complete site plan must be provided to the city and approved by the staff and city council before this conditional use permit is approved. The site plan is hereby incorporated into and made a part of this conditional use permit; 34. The Applicant must pay to the city an administrative fee in an amount sufficient to reimburse the City for the cost of reviewing this application. Dated: August 1 , 1995. ATTEST: m Anne E.
