RESOLUTION DECLARING THE ANNEXATION OF TERRITORY TO THE MUNICIPALITY OF
MOAB, UTAH,
Whereas, a majority of the owners of real property and the owners of not
less than one-third in value of the real property as shown on the last assess-
ment rolls in territory lying contiguous to this municipality have petitioned
this municipality for annexation; and
Whereas, the petitioner was accompanied by an accurate plat or map of the
territory to be annexed prepared under the supervision of the city engineer or
a competent surveyor and certified by the engineer or surveyor; and
Whereas, the petition and plat or map have been filed in the office of
the municipal recorder.
It is hereby resolved by the council of Moab City:
Section 1. Territory Annexed. The territory described below is hereby
declared annexed to the municipality:
DESCRIPTION OF A TRACT OF LAND IN SECTION 35, T25S, R21E, S. L. B. & M.
Beginning at a fence corner on the North side of Fourth North
St. which bears S89°54"W 1821.0 feet and NO°06'W 25.0 feet from the
SE Corner, Section 35, T25S, R21E, S. L. B. & M., and proceeding thence
S88°24'14)61.2 feet with a fence line to a fence corner; thence
NO°32'E�7.86.7 feet with a fence line to a fence corner; thence
S89034 E 159.7 feet with a fence line to a fence corner; thence
SO°15"W 281.0 feet with a fence line to the point of beginning and
containing 1.05 acres, more or less. Bearings are based on the South
line SE Section 35(S89) 54'W.
Section 2. Effective Date. This resolution shall take effect immediately.
Passed by a vote of at least two-thirds of the membesr of the governing
body .this 21st day of March, 1978.

As of July 1, 1977, Utah law is changed in certain respects for annexa-
tions. The following are the steps that must be 'taken to annex territory_ to
a municipality:
FIRST. A petition signed by at least a majority of the owners of real
property and the owners of not less than one-third in value of the real property
owners as shown by the last assessment rolls must be presented to the city
recorder or town clerk. The assessment rolls are located at the office of the
county assessor.
• SECOND. The petition must be accompanied. by a map or plat prepared under
the supervision of the City .engineer or a competent surveyor and certified by the
engineer or surveyor.
THIRD. The petition and certified map or plat .must be filed with the
recorder or clerk of the municipality.
.FO.LLRTH. The governing body may,at a regular meeting by resolution prised
by a.twoOchirds vote accept the annexation. A two-thirds vote on a five luber
• council means that aE least four members must vete for the resolution.
{ FIFTH. A copy of the certified map or plat .together with a certified copy
of the resolution shall be filed at once in the office of the county recorder
declaring. the annexation.
SIXTH.. A description of the territory annexed must be provided the Utah
State Tax Commission. '
SEVENTH. After July 1, 1977, municipalities must file Articles of Amend-
ment to their Articles of Incorporation with the Secretary of State describing;
the territory of the municipality after annexation.

7TIFICATION
•
The undersigned duly acting and appointed recorder hereby certified that
the foregoing resolution is a true and correct.copy of•a resolution declaring
the annexation of the territory described therein.
