CITY OF MEDINA
RESOLUTION NO. 95-32
RESOLUTION VACATING DRAINAGE AND UTILITY
EASEMENTS
WHEREAS, the city council of the city of Medina, Minnesota authorized the city clerk -
treasurer to cause notice of a hearing regarding the vacation of two 5.00 foot easements for
drainage and utility purposes centered on the common lot line between Lots 2 and 3, Block 1,
Tuckborough Farm, Hennepin County, Minnesota to be published in the official newspaper and
to be posted in the area of the affected property at least two weeks prior to the public hearing;
and
WHEREAS, the notice of said public hearing was published on July 13 & 2q 1995, in the
official newspaper and was posted in the area of the affected property; and
WHEREAS, on August 1, 1995, the city council held the public hearing on the vacation
of the described drainage utility and street easements, at which public hearing all interested
parties were heard with respect to said vacation, and the city council determined that the vacation
of said easements to be in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota as follows:
1. The city council hereby declares that the drainage and utilities easements legally
described on Exhibit A attached hereto are vacated.
2. The city clerk -treasurer is authorized and directed to prepare and present to
Hennepin county the notice that the city council has completed these vacation
proceedings and request that the same be reflected in the county's records.

The motion for the adoption of the foregoing resolution was duly seconded by member Phil i p
Zietlow and upon vote being taken thereon, the following voted in favor thereof:
Johnson, Zietlow, and Mayor Anne Theis.
and the following voted against same: None.
and the following were absent: John Ferris and Ann Thies.
Whereupon said resolution was declared duly passed and adopted.

The legal description of the vacated drainage and utility easement is as follows:
The ten foot wide drainage and utility easement centered on the
adjoining lot line of Lots 2 and 3, Block 1, Tuckborough Farm,
except the southwesterly and easterly 10 feet as measured at right
angles to the respective lot line thereof.
