HomeMy Public PortalAbout1995-034Member James Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 95-34 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO RANDALL MAYER WHEREAS, Randall Mayer, d/b/a Mayer Mobil (the "Applicant") has requested permission to reconstruct his automobile service station/convenience store at 762 T.H. 55; and WHEREAS, the city's zoning ordinance requires a conditional use permit for such use; and WHEREAS, this matter was reviewed by the planning commission on July 11, 1995 and by the city council on August 1, 1995; and WHEREAS, the city council has determined that the proposed use will not impair the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated use, subject to the following terms and conditions: 1. The new building authorized by this conditional use permit may not exceed 3,700 sq. ft.; 2. The exterior building materials must be in accordance with those shown on the plan submitted to and approved by the city; 3. The canopy over the gasoline islands must be designed and constructed as shown on the site plan submitted to and approved by the city; 4. The driveway and parking area must be constructed to city standards, including 9 ton capacity and a 25 foot turning radius; 5. Exterior trash containers must be screened with an opaque material; RHB92969 ME230-116 6. Exterior lighting must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property or right-of-way; 7. All roof top mechanical equipment must be screened from view from other properties; 8. The Applicant's plans must be reviewed and approved by the Hamel fire department; 9. The Medina public works department must review and approve the entrance to Clydesdale Trail; 10. The underground fuel tanks must be located at least 20 feet from the Co. Rd. 116 right-of-way; 11. There shall be no exterior storage on the site; 12. The pegasus sign is to remain as is; 13. Any plans which are revised for any reason after the date of this resolution for any reason must be submitted to the city for review by the staff; 14. Soil borings and pavement design information must be submitted to the city for approval by the city engineer; 15. The drainage plan must be revised to show the outlot control structure as a free - flow skimmer; 16. The Applicant must execute a development agreement with the city and post security in the amount of $139,743 to ensure completion of the site improvements; and 17. The Applicant must pay to the city a fee in the amount determined by the staff to represent the actual cost to the city of reviewing this application. Dated: August 15, 1995.
