CITY COUNCIL
MINUTES
SEPTEMBER 21, 1982
INITIATION:
1. CALL TO ORDER:
Mayor Tyrell called the regular meeting of the City Council to
order at 7:30 p.m. on Tuesday, September 21, 1982, in the Council
Chamber of the City Hall.
2. The invocation was given by Mr. John Shaw, Parks and Recreation
Commissioner.
3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell.
4. ROLL CALL:
Present: Councilmen- Atkins, Dennis, Gillanders, Swain, Tyrell
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin, Assistant
City Manager Kimbrough, Parks and Recreation Director
Kobett, and Julie Estrada, Temple City Times
At this time Ms. Janet Rizzo, Manager Temple City branch office of the
Automobile Club of Southern California presented a special citation for
1981 outstanding pedestrian program activities in the City of Temple City, .
which was accepted by Mayor Tyrell on behalf of the City Council and
residents.
5. CONSENT CALENDAR:
Councilman Atkins moved to approve Items A through F on the Consent
Calendar, as recommended, seconded by Councilman. Swain and carried.
A. APPROVAL OF MINUTES: Regular Meeting of September 7, 1982
Approved as written.
B. RECOMMENDATION FROM PARKING COMMISSION - Meeting of September 8
HOLIDAY PARKING ENFORCEMENT - PUBLIC PARKING LOTS, CENTRAL
BUSINESS DISTRICT
Approved increased parking enforcement four hours per day, Monday
through Friday, beginning December 6. and continuing through
December 23, 1982.
C. PLANNING COMMISSION ACTION - MEETING OF SEPTEMBER 14
Received and filed memo relating to action taken by the Planning
Commission at their regular meeting held September 14, 1982.
D. RECOMMENDATION FROM PARKS .& RECREATION COMMISSION - Meeting of
September 15 - REQUEST FOR USE OF LIVE OAK PARK FACILITIES,
TEMPLE CITY AMERICAN LITTLE LEAGUE
Approved use of the north and south baseball diamonds, and the
Concession stand from February 1 through July 31, 1983 for their
1983 baseball season, subject to the required Certificate of
Insurance.
E. APPROVE PLANS-AND SPECIFICATIONS - TEMPLE CITY BOULEVARD
STREET LIGHT CONVERSION
Approved plans and specifications, calendar of events, and author-
ized staff to advertise for bids.

F. RESOLUTION NO. 82 -2106: WARRANTS AND DEMANDS
Adopted Resolution No. 82 -2106 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF
$190,724.43, DEMAND NOS. 4582 THRU 4640.
6 UNFINISHED BUSINESS:
A. APPEAL FROM TRAFFIC COMMISSION DENIAL FOR OVERNIGHT PARKING PERMIT
City Manager Koski presented background information, stating the
hearing on the appeal of Daniel Lucero from Traffic Commission's
denial for an overnight parking permit was carried over to September
21 in order to give the appellants the opportunity to be present.
As requested by City Council, staff investigated and found the
garage is used for storage of various items, including lumber, a
table saw, and auto parts. The Traffic Commission denied the request
for overnight parking permit on the basis. there are 7 vehicles and
7 parking spaces on the property, although two spaces are not being
used (garage).
Mr. Daniel Lucero, 4946 Camellia Avenue, stated his nephew is living
with his family while completing training for paramedics, adding an
additional vehicle to those of his family.
In answer to questions put to him by Council, Mr. Lucero stated
his trailer, which blocks the garage, cannot be moved to another
location on the property; he has van seats, a table saw, and lumber
to re -do his patio stored in the garage; he feels the City should
not require him to go to the expense of paying to store his trailer
in a recreation vehicle parking lot; his nephew will be with them
only until April when he intends to marry.
Councilman Gillanders stated he feels the 20 ft. trailer precludes
utilization of the garage; the problem is a temporary one until
April; he feels it would be an unnecessary burden to expect the
family to scramble cars around each day and he would favor granting
a permit.
Councilman Atkins agreed the problem is a temporary one and he feels
Mr. Lucero should seek some off premise location for storage of his
trailer during the interim.
Councilman Swain stated she does not see there are special circum-
stances. Many others have been denied a permit for the same
reason and granting one here would be setting a precedent.
Councilman Dennis felt there were enough unique circumstances in
this particular application; the problem is short term, unique;
and he believes Council should bend in this particular case.
Mayor Tyrell stated he feels a person should bear the responsibility
and burden when they purchase a trailer to take the necessary steps
to store it properly and conform with all requiresment of the City.
Mrs. Marion Lucero stated they have lived in the City for many years
and have always adhered to the law; what they are asking for is a
temporary relief from their problem. She realizes the Traffic
Commission is limited in the scope of their responsibilities, but
felt she could ask the Council for help and be granted that
privilege.
Mrs. Lucinda Grant, 5434 El Monte Avenue, stated that in her neighbor-
hood people just do what they want and these people are lawfully
coming and asking for a permit.
Mayor Tyrell commented on the fact that Mr. Lucero has criticized
the Traffic Commission and stated the Council sets the policy and
the Commission attempts to follow those guidelines.

Larry Reed, Traffic Commissioner, stated no new evidence was pre-
sented this evening except that the situation is a temporary one.
He stated many requepts come before the Commission which are
similar circumstances - that the request is a matter of convenience,
not necessity, and the Commission always follows the guidelines of
the ordinance. If there are extenuating circumstances, such as
health or handicap, the Commission issues a permit.
Councilman Gillanders moved to reverse the Traffic Commission denial
for overnight parking permit, seconded by Councilman Dennis and
failed on a roll call vote:

7. NEW BUSINESS:

8. COMMUNICATIONS:
A. Church Women United - Request for permit to solict funds
for UNICEF, October 29 -31, 1982
Councilman Dennis moved to approve the request from Church Women
United to solicit door -to -door for UNICEF, October 29 -31, 1982,
seconded by Councilman Swain and carried.
B. Claim for Damages - Raymond Soo Hoo, 10036 Lynrose Street
City Manager Koski presented claim for damages to a vehicle alleged
to have occurred September 6, 1982 by a tree limb falling in his
driveway.
Councilman Gillanders moved to deny and refer to JPIA, seconded by
Councilman Atkins and carried.
9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
No one came forward.
RECESS TO CRA:
At this time Council recessed to meet as the Community Redevelopment Agency,
all members being present and approved the minutes of the regular meeting
held September 7, 1982, and approved amendment to agreement for legal
services. The minutes are set forth in full in the records of the Agency.

10. ACTION ON REQUEST BY CRA:
There was no action to be taken.
11. MATTERS FROM CITY OFFICIALS:
A. STUDY SESSION ITEMS - SEPTEMBER 20, 1982
City Manager Koski presented items discussed by City Council at
the September 20, 1982 Study Session and Council took the following
action:
1) REPORT RE: USE OF PROPOSITION A - TRANSPORTATION FUNDS
City Council received the report from Clyde Sweet and Associates.
Discussion centered around transit usage in Temple City, and Council
requested staff to gather ridership data for the month of October
and prepare a summary report for submittal to. Council, such report
to contain who rides, destination, time of day, and for what purpose.

2) PROPOSED ORDINANCE BANNING UNTREATED WOOD ROOFS
City Council reviewed staff report dated August 25, 1982
containing materials from various segments of the roofing
industry and a report from the Los Angeles County Fire
Department. In addition, Paul Decker, with California Tile
Company, and representative of the Committee for Firesafe
Roofing, made a verbal presentation on the various classi-
fications of roofing, relative costs, and the inherent
safety problems with untreated and wood shake roofs.
Council also received additional material from Robert J.
Mitton, Red Cedar Shingle & Handsplit Shake Bureau, dated
September 15, 1982 relative to the use of untreated wood
roofs.
After considerable discussion, City Council concurred that
an ordinance be prepared for further consideration, and
instructed the City Attorney to prepare the proposed ordinance
to be submitted at their next regular meeting to be held
October 5.
The other matter to be resolved is whether permits will be
required to re -roof in the R -1 and R -2 zones. Present
ordinance exempts permit provisions for re- roofing, main-
tenance, or repair of any roof on any single family dwelling
where the work is done by the owner of the building and the
material consists of either composition or wood shingles.
3) PROPOSED BUILDING CODE FEE CHANGES
City Council reviewed the staff memo dated September 9, 1982
and questioned the justification and application of funds
that are derived from building permit fees. Staff will pre-
pare a recommendation to be submitted at the City Council
meeting to be held October 5, 1982.
4) ANNEXATION (82 -1)
City Council reviewed the progress and approved citizens
efforts to join with Temple City. The tax resolution, as
required by LAFCO, will be presented to City Council on
October 5, 1982.
5) REPORT RE:•CITIZENS.CABLE TV ADVISORY COUNCIL
City Council received staff report dated September 20
recommending the formation of a Temple City Advisory Com-
mittee on local programming, the composition of membership
to be determined by City Council policy. The composition
of the committee will be finalized in a staff report to be
submitted to City Council in November.
B. TRADEWIND APARTMENT COMPLEX (ANNEXATION)
City Manager Koski presented a letter from the managing partner
of the Tradewind Apartment complex located at 5351 N. Rosemead
Boulevard requesting annexation to Temple City.
Councilman Gillanders moved to approve and refer the matter to
staff with the stated policy that the affected property owner
and /or tenants work toward their annexation with some assistance
and guidance from staff.
C. TEMPLE CITY PONY BASEBALL - REQUEST ASSISTANCE FOR IMPROVEMENTS
City Manager Koski presented a letter from Temple City Pony Baseball
League requesting financial assistance with improvements at Oak
Avenue Junior High.

Councilman Gillanders moved to refer the matter to the Parks and
Recreation Commission for their review. and recommendation, seconded
by Councilman Atkins and carried.
D. Mayor Tyrell directed Council's attention to a memo he had
forward to each member regarding the Alhambra Municipal Court
policy to dismiss citations against people who have either never
had a driver's license and arrested for driving without one, or
who have not registered their vehicle and are arrested for an un-
licensed vehicle. Councilman Atkins stated he would support the
Mayor's position and his writing a letter to the county, to the
court, and to the bar association, with Council concurring.
Mayor Tyrell also felt a letter should be forwarded to our legis-
lators protesting the County Board of Supervisors proposal to change
the distribution of municipal court fines and forfeitures, with
Council concurring.
Mayor Tyrell directed Council attention to the memo from staff
regarding the 55 mile per hour speed limit, stating he feels that
it's no longer necessary and should be changed, and inquired whether
Council felt a letter to our federal representatives should be sent
from Council or from members individually.
Councilman Gillanders stated if Council is going to become involved
with federal policy we should also become involved by stating our
position on state issues.
Councilman Swain felt that when something affects the City Council
should take action, but in this case where we don't have any street
which is even subject to the 55 mph limit, members as individuals
should do what they wish to try to influence our representatives.
Councilman Dennis stated he felt individual action would be appro-
priate in this case. He personally feels 55 mph to be a reasonable
speed and should be enforced.
Councilman Atkins stated he is opposed to the 55 mph speed limit
but doesn't feel Council can do anything to influence Washington.
12. ADJOURNMENT:
On motion by Councilman Gillanders, seconded by Councilman Swain,
meeting adjourned at 8 :25 p.m. Next regular meeting of the City
Council will be held Tuesday, October 5, 1982, 7:30 p.m. in the
Council Chamber of the City Hall.
