The Council met in special session on January 27, 1959, and there was in
the chair, Mayor Groninga, presiding, and upon roll call the following Council-
men were present: H. L. Luwe, Lester Huisman, Mayo Tjaden, Chas. Staar and
Neil O'Kones. Absent - None.
The Council discussed the mothod.of enabling a full completion of the contract
to E. B. Spencer Construction Co. in the respect of removing the.seedirig";and labor
from the sewage treatment plant site from the original contract for the reason that
the comalet on time in De?erper makes it impE4ctical to attempt any preparation of
the see be or seeding o ne site at this ime.
Thereafter the following Resolution was presented and read by Councilman
Lester Huisman as follows, to -wit:
RESOLUTION 112
WHEREAS, the Town of Wellsburg and the E. B. Spencer Construction Co.
desire to close their contractural relationship and,
WHEREAS, certain seeding and labor connected therewith of seeding down the
sewage treatment plant site cannot be presently performed,
THEREFORE, BE IT RESOLVED by the Town of Wellsburg that a Change Order,
designated Change Order No. 3 be made by the parties and that the Town shall
furnish the seed and labor for seeding the plant site area. As compensation
for furnishing said labor and seed, the Contractor agrees to reduce the amount
of the contract price by the lump sum of$200.00. That the foregoing change
be effectuated by an addendum to the contract designated Change Order No. 3
and signed by the parties and the consulting engineer.

Councilman Neil O'Kones introduced and moved the adoption of Resolution
112, seconded by Councilman Mayo Tjaden. After discussion and upon roll call
the following vote was taken:
AYES: Lester Huisman, Mayo Tjaden, H. L. Luwe,
Chas. Starr and Neil O'Kones.
NAYS: None
ABSENT: None
The Mayor declared the Resolution duly adopted.
The Council discussed the price at which certain extra work was to be performed
by contractor, Ray Hansen, for repairing certain intersected tile lines and the
incident excavation and stabilizing.
Thereafter the following Resolution was presented and read by Councilman H. L.
Luwe as follows, to -wit:
RESOLUTION 113
WHEREAS, certain physical conditions existed unknown both to the
Town of Wellsburg and to Ray Hansen Construction Co. with regard to certain
agricultural drain tile intersected by the outfall sewer, and.
WHEREAS, it is necessary to complete the project without obstruct-
ing the system of agriculture,
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN OF WELLSBURG that the
following items of extra work not included in the contract be performed for
the prices indicated as follows:
1. Repairing the lines damaged for the lump
2. Rock excavation encountered for the lump
3. Stabilizing trenches for the lump sum of

be performed by Ray Hansen Construction Co. at said referred to agreed price
and that the parties effectuated such order by execution of an instrument
carrying the signature of the parties and the engineer and designated Change
Order No. 4.

Councilman Chas. Starr introduced and moved the adoption of
Resolution 113 and Councilman Mayo Tjaden seconded the motion to adopt.
The vote was taken and upon roll call the following vote wags obtained:
AYES: H. L. Luwe, Chas. Starr, Mayo Tjaden,
Lester Huisman & Neil O'Kones.
NAYS: None
ABSENT: None
The Mayor declared the Resolution duly adopted.
Motion by H. L. Luwe, seconded by Neil O'Kones that the meeting
adjourn. Motion submitted and carried.
